Michael W. Hawkins Named a Fellow in The College of Labor and Employment Lawyers
Michael W. Hawkins, a Partner at Dinsmore & Shohl LLP, was named a Fellow in The College of Labor and Employment Lawyers. Election as a Fellow is the highest recognition by ones colleagues of sustained outstanding performance in the profession, exemplifying integrity, dedication and excellence.

The twelfth installation of Fellows will be held November 10, 2007 in Philadelphia, PA, coincident with the American Bar Association's Labor and Employment Law Section's Continuing Legal Education Conference. With the current installation, the College is represented by members in 42 states, the District of Columbia, Puerto Rico and Canada.

About The College of Labor and Employment Lawyers

The College was the vision of a member of the Fellows. The idea was to further establish this profession in all its aspects as one uniquely important to the world of labor and employment law, individual rights, collective bargaining and dispute resolution. The College was established in 1995 through an initiative of the Council of The Section of Labor and Employment Law of The American Bar Association. It operates as a free standing organization recognizing those, who, by long and outstanding service, have distinguished themselves as leaders in the field.

Sands Anderson’s Bill Gray Leads Henrico Business Council
William A. Gray, counsel in the Business, Finance and Real Estate practice at Sands Anderson Marks & Miller, was elevated to the chairman’s position at the Greater Richmond Chamber of Commerce’s Henrico Business Council last week, firm President C. Thomas Ebel announced recently.

Gray, whose law practice is focused mainly in government relations, creditor’s rights and bankruptcy, has been active with the Henrico Business Council for several years. As chair, he will lead a group of twenty business and government leaders in seeking ways for the business community to recognize and join in the solution of community needs such as labor force development, economic growth and transportation. The group holds monthly Wednesday morning inVision meetings for Chamber members and guests at the Lewis Ginter Botanical Gardens.

”As Chair of the Council, I plan to have programs and events that will help businesses address issues they confront every day, such as planning, growth, employee recruitment and retention, and the like,” said Gray.

“I will also work to foster working relationships with other community and political leaders, so that the Council can be the voice of Henrico County businesses in regional and state-wide matters,” he explained.

Gray earned his law degree at Western State University College of Law, Fullerton, California, after receiving his bachelors degree in political science from Virginia Tech. He worked for 12 years for the Federal Deposit Insurance Corporation during the thick of the “savings and loan crisis”, and also gained experience as staff attorney for a Chapter 13 Trustee after beginning his bankruptcy practice at a firm specializing in debtor Chapter 7 and 13 filings. He is also a 2001 Fellow of the Sorensen Institute of Political Leaders.

Frantz Ward LLP Bolsters Labor and Employment Practice With the Addition of Thomas J. Piatak and Emily C. Fiftal
The Cleveland law firm Frantz Ward LLP continues to strengthen its labor and employment practice with the addition of Thomas J. Piatak and Emily C. Fiftal.

Mr. Piatak joins Frantz Ward as counsel in the firm's Labor and Employment Group. Prior to joining Frantz Ward, Mr. Piatak was a partner in the Cleveland office of Baker & Hostetler.

In nearly twenty years of practice, Mr. Piatak has represented employers in all aspects of employment law. He handles employment-related litigation in state and federal courts and arbitrations, and represents clients before the Equal Employment Opportunity Commission and the Ohio Civil Rights Commission. Mr. Piatak also advises employers on compliance with the Family and Medical Leave Act, the Fair Labor Standards Act, the Occupational Safety and Health Act and other employment-related statutes and regulations. He also represents clients in connection with proceedings before the National Labor Relations Board (NLRB).

Mr. Piatak received his law degree from the University of Michigan Law School, cum laude, and his undergraduate degree from Case Western Reserve University, summa cum laude.

Ms. Fiftal joins Frantz Ward as an associate, having spent the past three years at a Cleveland labor law firm. She will continue to focus on counseling employers on human resources issues and representation of employers in litigation involving employment discrimination, harassment, and wrongful discharge.

Ms. Fiftal received her law degree from Case Western Reserve University School of Law, and her undergraduate degree from Truman State University.

Frantz Ward LLP Adds Ashley M. Arvin to Business Counseling Practice
Cleveland, OH. The Cleveland law firm Frantz Ward LLP has added Ashley M. Arvin to its Business Counseling Group.

Ms. Arvin will focus her practice on mergers, acquisitions, divestitures, corporate governance and general contract matters for corporations, companies and partnerships. She also represents companies and individuals in zoning and land use matters, and she counsels clients regarding real estate acquisitions, divestitures and drafting and negotiating purchase agreements and leases.

Ms. Arvin is a graduate of Cleveland-Marshall College of Law, and obtained her undergraduate degree at Purdue University.

Morris, Manning & Martin Receives Summary Judgment in High Profile Patent Case
Morris, Manning & Martin, LLP has won a high profile patent infringement case filed against its client, General Protecht Group. General Protecht, based in China, recently announced that it will build a large manufacturing plant in Georgia.

“This is a significant win and a vindication of our client’s rights,” said Morris, Manning & Martin Partner Bryan Harrison, who litigated the case with partners John Fry and Tim Xia “This excellent result is a testament to our dedicated patent litigation team at Morris, Manning & Martin,” continued John Fry, who leads the firm’s patent litigation practice

Leviton sued several of General Protecht’s U.S. customers, alleging infringement of a Leviton patent for a ground fault circuit interrupter, or GFCI, a small device that can reduce the risk of electrocution. GFCI devices are often used in kitchen and bath electrical outlets.

In April 2004, Leviton filed suit in New Mexico, where one of General Protecht’s customers is located. General Protecht intervened in the case to lead the litigation. Federal Judge James Browning in Albuquerque awarded summary judgment of non-infringement on July 10, 2007, in favor of General Protecht. The order found that the General Protecht devices at issue
do not infringe upon Leviton’s asserted GFCI patent, either literally or under the doctrine of equivalence.

“This is not only a great win for General Protecht, which has always respected the intellectual property rights of others, but also a terrific win for the U.S. legal system,” said Tim Xia, who heads the firm’s intellectual property and international practices. “It shows that a Chinese company, which conducts business in the U.S., can be treated fairly and impartially according to the rule of law, which will encourage more Chinese companies to invest and conduct business in the United States,” he concluded.

In May, Georgia Governor Sonny Perdue formally announced that General Protecht Group would build a new plant in Barnesville, Georgia. The electrical component factory is expected to employ 240 people at the conclusion of the first, $30 million phase, with employment and investment expected to increase to approximately 350 employees and $100 million. Attorneys from Morris, Manning & Martin, LLP were instrumental in bringing the plant to Georgia.
