Novartis obtained a temporary order from the U.S. Court of Appeals for the Federal Circuit prohibiting Teva Pharmaceuticals from selling its generic version of the antiviral medicine Famvir® on September 7. Representing Novartis was Fitzpatrick, Cella, Harper & Scinto.

Novartis holds valid US patents until 2015 for Famvir®. The injunction remains in effect until a decision by this court.

The Fitzpatrick Cella team was led by: Robert L. Baechtold, Hugh C. Barret, Nicholas N. Kallas, Nina Shreve and Simon D. Roberts.

Partners Ed Vassallo and Bob Fischer and associate Ralph Dengler filed successful Daubert motions in a trademark infringement case for client Condé Nast.

Judge Keenan recently granted the motions, excluding the testimony of all of plaintiff Kargo's expert witnesses.

Judge Keenan held that the survey conducted by Prof. Jacoby was so flawed that the risk of prejudice far outweighed any probative value. Major flaws included the survey's failure to simulate the real world circumstances, its use of stimuli that did not fairly characterize the products/services at issue, and its use of leading methodology and questions.

Judge Keenan also excluded testimony from the Interbrand damages experts because, without any admissible evidence of confusion, the damages testimony was irrelevant and inadmissible.
