HRO Attorney Appointed as Trial Attorney to SEC
Holme Roberts & Owen LLP (“HRO”) is proud to announce that Senior Partner Nancy Gegenheimer has accepted an appointment as a Trial Attorney with the United States Securities and Exchange Commission in the Denver Regional Office. She was an attorney at HRO for over 25 years.

“We are extremely proud and excited that one of our own has the opportunity to serve the public’s interest in this important position,” said the firm’s managing partner Ken Lund.

Ms. Gegenheimer was a member of HRO’s Litigation Department. She managed the firm’s Boulder office from 1999 to 2001. For the last five years, she served on HRO’s six-person Executive Committee. As a lead trial attorney, Ms. Gegenheimer obtained many notable verdicts during her tenure at HRO, including a $69 million jury verdict for StorageTek, a $7 million verdict for the Securities Investor Protection Corporation, and a $14 million judgment for a local development company. In 2007, she was named one of Colorado’s Super Lawyers and was included in the Chambers USA guide to leading national attorneys.

Ms. Gegenheimer is from Colorado and received her B.A., magna cum laude, from the University of Colorado and her J.D. from the University of Denver. She has over 25 published cases and is admitted to practice law in three states and in the United States Supreme Court.

Jon Strauss Receives Public Service Award from MSBA
"Minnesota State Bar Association presented Jon Strauss with its Raeder Larson Public Service Award. The award is given annually to an individual who provides exceptional service to the public through pro bono legal services and a demonstrated commitment to justice for all. Jon was nominated for the award because of his defense of a mentally ill debtor, in Reynolds v. Pennsylvania Higher Educ. Assistance Agency, 425 F.3d 526 (8th Cir. 2005).

Jon was not only recognized yesterday by the MSBA for his commitment to pro bono representation, but he was also highlighted in a 2005 Special Legal Issue of the Corporate Board Member magazine in an article entitled, ""Lives that Legal Angels Saved,"" regarding his representation on the same matter referenced above. Jon spent close to 6 years on this pro bono matter. Jon's commitment to his pro bono client, and the Bar's recognition of that, says volumes about the kind of lawyer Jon is. "

The Honorable Bernard J. Goodheart Joins EG&S
"EG&S is honored to announce that the Honorable Bernard J. Goodheart, following over 31 years of distinguished service as a member of the Philadelphia County Court of Common Pleas, has decided to join the firm. Judge Goodheart, a renowned expert in commercial and tort litigation and dispute resolution in a wide variety of sophisticated litigations, will focus his attention on the Firm’s litigation matters. Judge Goodheart, a native Philadelphian, is a graduate of Central High School, The Wharton School and The Law School of the University of Pennsylvania and has completed courses at the National Judicial College in Reno, Nevada. He has been a frequent lecturer on mediation at The Law School of the University of Pennsylvania and has served as faculty in continuing legal education seminars for lawyers and judges.

Judge Goodheart became a member of the Court of Common Pleas of the First Judicial District of Pennsylvania on January 2, 1976 and remained with the Court until joining the Firm on July 2, 2007."

Young Named Chair of Bankruptcy Section of the DC Bar
Craig B. Young, Of Counsel in the firm's Business Law Group, has been named Chair of the Bankruptcy Committee of the Corporation, Finance and Securities Law Section of the D.C. Bar. The Bankruptcy Committee annually presents continuing legal education programs on bankruptcy law for members of the D.C. Bar.

Louisiana Appleseed Introduces Financial Access Program
"Louisiana Appleseed, a non-profit organization dedicated to legal philanthropy, announces a financial access program that links lower income groups with mainstream banking institutions.

In partnership with the Urban League; Catholic Charities/Hispanic Apostolate; and Puentes New Orleans, Louisiana Appleseed’s objective is to educate members of underserved communities about how to access financial services, while at the same time to conduct a survey of local banks to determine what products and services are already offered to low income community members.

With a growing population of Hispanics in Post-Katrina New Orleans, Louisiana Appleseed developed this initiative modeled on similar programs carried out by Nebraska, Georgia and Texas Appleseed centers.

According to Christy Kane, executive director of Louisiana Appleseed and the ConocoPhillips/Adams and Reese Fellow, “It is often unclear to this population, especially if there is a language or cultural barrier, what financial services are available, how they can access them and whether they qualify. By instituting this financial access program, Appleseed hopes to better equip these often underserved, multicultural residents, many of whom do not speak English, to be banking consumers so that they will not fall prey to subprime lending and out of control check cashing fees.”

She adds, “Serving as the bridge between lower income groups and the banking community, Appleseed’s financial access program, we hope, will ultimately lead to an increase in homeownership and better credit scores.”

The financial literacy initiative is divided into two phases: research and implementation.

Kane explains, “We have a team of volunteer lawyers who have attended Appleseed training and are in the process of meeting with banks and credit unions to conduct a face-to-face survey to determine the financial institution’s current offerings to this segment of the population.”

Next, Appleseed will conduct focus groups with members of the Hispanic population to determine what barriers these individuals face when considering mainstream banking services. Appleseed will compile a report with the banks’ information and the focus group results, hoping that this will lead to discussions between the banks and community leaders as to how to better reach these individuals.

There is also a financial literacy component to the program. With support and direction from the LSU AgCenter, Louisiana Appleseed hopes to work with local non-profit Puentes New Orleans to participate in financial literacy classes geared toward the Hispanic community, providing training and materials in Spanish. This will be especially helpful for consumers who may not be getting the information they need directly in a language they understand.

The Louisiana Appleseed program was re-energized in January 2007 to more actively address New Orleans’ legal issues in the recovery from Hurricane Katrina, and it is open to attorneys statewide.

According to Martin Stern, a national Appleseed board member and attorney with Adams and Reese, “We are pleased that Louisiana Appleseed is off and running with an excellent Advisory Council led by Harry Hardin of Jones Walker.”

He adds, “The financial access program presents a great way for lawyers to do pro bono work and serve our community. At Adams and Reese, where pro bono service is mandatory for every lawyer, many of our lawyers are already involved, and lawyers from other firms are also volunteering to help.” "

Description:

Recent litigation, regulations, fiduciary issues, and operational issues should all be taken into account by service providers that maintain these accounts for retirement plans. Industry trends that are moving towards increased use of managed accounts, non-mutual fund investments, and plan level investment accounts have accelerated the growth and use of unitized accounts. At the same time litigation involving unitized company stock remains an issue. However, improved techniques for unitization and the ability to trade unitized assets on national trading platforms make offering and servicing unitized assets more viable for plan service providers and plan sponsors.
