Mark Geraghty, an accomplished environmental and product liability attorney, joins the Los Angeles office. Mimi Lee, also a well-established environmental and product liability attorney, joins the San Francisco office. Geraghty and Lee have practiced together for more than 13 years; both were partners at Thelen Reid Brown Raysman & Steiner LLP before joining McKenna, and Geraghty was co-chair of the Toxic Tort Practice Group. McGlinchey Stafford Adds Key Addition to Leading Commercial Litigation Practice
McGlinchey Stafford, a national commercial litigation law firm, announced today the addition of Christine Lipsey to the commercial litigation team in Baton Rouge. Lipsey joins the firm as a member and brings more than 20 years of experience in litigation representing small and large businesses, insurance companies, state agencies, lenders and corporate shareholders.

"We are delighted to welcome Christine to our firm," said Managing Partner Rudy Aguilar. "She brings significant regional and national experience to our commercial litigation group, and will greatly enhance our ability to meet the growing needs of our clients."

One of her many notable accomplishments includes the representation of a major insurance company in the first case before the Louisiana Supreme Court to review whether the Employee Retirement Income Security Act (ERISA) preempted Louisiana’s own statute. Lipsey has published and presented on a number of business litigation topics including the Do-Not-Call Implementation Act, E-discovery, and HIPAA. She hails from Louisiana State University’s Paul M. Herbert Law Center.

King & Spalding Secures TAA Benefits for Former BP/Amoco Workers
King & Spalding’s Washington, D.C.-based International Trade Group secured a victory for a group of displaced workers who lost their jobs as a result of import competition in 2003. On May 4, the Department of Labor certified these former employees eligible for Trade Adjustment Assistance benefits, after denying TAA benefits to these employees for three and a half years. King & Spalding represented the employees in their appeal of Labor's adverse decision to the U.S. Court of International Trade in New York in 2004. In two opinions, the first in late 2005 and the most recent on March 30, 2007, the Court endorsed the substantive positions argued by King & Spalding and was highly critical of Labor's conduct in the prior administrative proceedings.

Through King & Spalding's efforts, this group of former BP/Amoco workers is now eligible to receive TAA benefits to which they are legally entitled. In addition, new legal precedent has been created that will allow outsourced workers, who otherwise would have been denied TAA benefits, to seek governmental aid when transitioning into new employment after experiencing trade-impacted job displacement.

These former employees were working full-time for BP/Amoco, providing accounting and business support that was essential to the company's production of oil and natural gas in the United States. Faced with increasing import competition, BP/Amoco attempted to save costs by outsourcing the employees to a third party consultant in 2000, which eventually laid off the employees in 2003.

U.S. law provides that workers who lose their jobs as a result of increased import competition from—or shifts in production to—other countries are entitled to TAA benefits that include vocational training, extended unemployment and health benefits, and job search and relocation allowances. Through a program sponsored by the U.S. Court of International Trade, King & Spalding was appointed to represent the displaced workers on a pro bono basis in their appeal from Labor's negative determination.

The King & Spalding litigation team was led by associate Mike Taylor, with support from partner Christine Savage, associate Tina Shaughnessy, and partner and International Trade practice group leader Steve Jones. Additional team members included a number of current and former King & Spalding attorneys, consultants and paralegals, including Carol Brewer, Doug Ierley, Cheng Liu, Ehren Halse-Stumberg, Louis Massard, Zeenat Iqbal and Kai Wu.
