Cozen O’Connor Attorney Kevin F. Berry Inducted Into Litigation Counsel of America
Cozen O’Connor member Kevin F. Berry was recently inducted into the Litigation Counsel of America (LCA). The LCA is an organization that recognizes deserving, experienced and highly qualified lawyers; provides outlets for scholarly authorship of legal articles on trial and litigation practice; provides for professional development; promotes superior advocacy and ethical standards in the practice of law; and assists in community involvement activities. Members are invited to join based on effectiveness and accomplishment in litigation and trial work, along with ethical reputation.

Berry, resident in the firm’s Philadelphia office, has more than 25 years of legal experience practicing in commercial and business litigation, involving insurance, reinsurance, banking, bad faith litigation, directors’ and officers’ liability, real estate litigation, and corporate matters. He has tried more than 140 civil matters to jury verdict.

Berry is a managing director and chair of the Burn Foundation and a member of the Pennsylvania Society, Maritime Law Association and International Association of Defense Counsel. He is also a member of the American, Pennsylvania and Philadelphia bar associations. He is admitted to practice in Pennsylvania and New Jersey, and before numerous federal courts. He was selected a "Pennsylvania Super Lawyer" by his peers, appearing in Philadelphia magazine and Pennsylvania Super Lawyers.

Berry received his undergraduate degree from Columbia University (B.A., 1976) and his law degree from Suffolk University Law School (J.D., cum laude, 1979), where he was case comment editor and a staff member of the Law Review.

Cozen O’Connor Attorney James M. Stanton Named to DAYL 2007 Leadership Class
Cozen O’Connor attorney James M. Stanton has been named to the 2007 Leadership Class of the Dallas Association of Young Lawyers (DAYL). The DAYL chooses a leadership class each year, and class members meet for professional enrichment programs, community service projects, and meetings with local, state and national leaders, in an effort to prepare these young lawyers for positions of leadership in the bar and the community.

An associate in the Dallas office, Stanton represents clients on trial and appeal in cases involving breach of contract, negligence, employment discrimination, and products liability. He also has experience in complex commercial litigation, products liability, antitrust, civil rights, employment and personal injury cases. In addition, his scholarly writing projects have been published in the Baylor Law Review and the Thurgood Marshall Law Review.

Admitted to practice in Colorado and Texas, Stanton is also admitted to practice before the U.S. Court of Appeals for the Fifth Circuit and the U.S. District Courts for the Northern, Eastern, Southern and Western Districts of Texas and the Eastern and Western Districts of Arkansas. He is a member of the American, Colorado, Dallas and Denver Bar Associations.

A resident of Dallas, Stanton is a graduate of the University of Colorado at Colorado Springs (B.A., with high distinction, magna cum laude, 1999) and Baylor University School of Law (J.D., 2002), where he served as president of his class, senior executive editor of the Baylor Law Review and a member of Baylor’s interscholastic Moot Court and Mock Trial teams.

Baker & McKenzie Advise Healthtech on Russian Plant Sale to Coca Cola Hellenic Bottling Company
Baker & McKenzie has advised HealthTech Corporation Limited on its sale of 100% of its Aquavision soft drinks manufacturer bottling facility in Russia to the Coca-Cola Hellenic Bottling Company for €191.5 million. The sale is subject to regulatory clearances.

Aquavision is a newly constructed production facility near Moscow, the largest consumer market in Russia. The facility covers 35 hectares and has four production lines, warehousing facilities and office space.

HealthTech Corporation Limited is one of the largest corporations in Eurasia in the biotechnologies, health and healthy lifestyle markets.

James Richards, corporate Partner at Baker & McKenzie, said: ''We were very pleased to act for our client, HTC, on the sale of this strategic bottling facility to Coca-Cola. It is another example of the strength of our M&A practice in Russia, as well as our expertise in English law M&A transactions in Russia.''

Vahagn Manukyan, Managing Director of HTC, said: ''We are grateful to Baker & McKenzie, in signing the deal with Coca-Cola. We were impressed by their outstanding professionalism, and by the exceptional enthusiasm and energy displayed by the M&A teams in London and in Moscow.”

The Baker & McKenzie team in London was led by Partner James Richards, and associates David Allen and Simon Cleobury. Baker & McKenzie in Moscow was led by Partners Paul Melling and Alexey Trusov and associate Dmitry Fedotov.

Coca Cola Hellenic Bottling Company was advised by Orrick in Moscow.

Baker & McKenzie Acts in Landmark Saudi IPO for Kingdom Holding Company
Baker & McKenzie has advised Kingdom Holding Company, as transaction counsel, on its IPO on the Saudi Stock Exchange, which is expected to raise US$860 million.

Kingdom Holding Company is one of the world's largest and most diversified private investment companies, with holdings in a large number of Saudi Arabian, Middle Eastern and international companies. It is also one of the world's leading hotel investors, with a portfolio that includes the Savoy in London, and Four Season and Fairmont hotels around the world. Its assets are valued at US$25 billion (as of 31 December 2006).

Edward Bibko, Corporate Partner at Baker & McKenzie, said: ''This transaction was significant not only because of its size and the profile of the issuer, but also because it was one of the first transactions to use an institutional offer and bookbuilding structure.''

''The Saudi regulators were, in many respects, developing new market practice alongside the IPO. Having previously advised the regulators in drafting the relevant securities laws, and considering our extensive IPO experience, we were uniquely qualified to act as transaction counsel,'' he added.

Susan C. Mathews Re-Elected to Board of Trustees of Spring Branch Independent School District
Susan C. Mathews, a partner in the Houston office of Adams and Reese, was recently re-elected to serve on the Board of Trustees for the Spring Branch Independent School District. The Board is composed of seven citizens who serve as a guiding force for the school district that operates 32 elementary schools, nine middle schools and six high schools. Each trustee serves in a voluntary capacity to establish policies which govern the school district that encompasses approximately 44 square miles and has a student population of more than 32,000.

In her law practice, Mathews is a member of the Bankruptcy Practice Team in the Transactions and Corporate Advisory Services Practice Group. She focuses on representation of debtors, creditors, creditors’ committees, and bankruptcy litigation including debtor-in-possession credit facilities, drafting of plan and disclosure statement, stay litigation, claims objections, preference litigation, lease litigation and related matters, and representation of purchasers in asset sales in bankruptcy cases.

Mathews formerly served as Assistant Counsel for Weingarten Realty Investors, a national real estate investment trust that is publicly traded on the New York Stock Exchange. There she handled all in-house litigation and bankruptcy matters, managed outside litigation counsel, drafted and negotiated transactional documents and assisted in due diligence lease review in connection with acquisitions. She also drafted proposed legislation and testified before the Texas House of Representatives’ Business & Industries’ Committee in support of proposed legislation during the 2001 regular legislative session. Mathews served as a law clerk to the Honorable Robert B. Maloney, U.S. District Court, Northern District of Texas.

Mathews received her Bachelor of Arts degree with honors from the University of Texas at Austin in 1981. In 1984, she received her juris doctorate with distinction from St. Mary’s University, where she was Senior Associate Editor of St. Mary’s Law Journal, and was a member of the John M. Harlan Honor Society and Phi Delta Phi. She is admitted to practice law in all state and federal courts in Texas, as well as the U.S. Court of Appeals for the Fifth Circuit. She is a member of the Texas and American Bar Associations and the American Bankruptcy Institute. Aside from serving her community as Trustee of the Spring Branch Independent School District, Mathews is a member of the Junior League of Houston and the National Charity League.

Louisiana Bar Association Recognizes Christy Kane with Committee Appointment and Invitation to Join Foundation
Because of her efforts and dedication to providing pro bono service, Adams and Reese Partner Christy Kane has been appointed to the Louisiana State Bar Association's Access to Justice Committee for 2007-08. The committee seeks to support and strengthen an integrated statewide network to increase the delivery of legal services to the poor. Kane, who is a partner in the firm’s New Orleans office, currently serves as the Executive Director of Louisiana Appleseed, a nonprofit organization that works to advance pro bono efforts focused on changing policy in the legal arena. Her position is being funded this year by Adams and Reese, ConocoPhillips and National Appleseed.

In addition to being selected to the Access to Justice Committee, Kane has also been invited to join the Louisiana Bar Foundation as a Fellow. Fellowship consists of judges, lawyers, and law professors who have demonstrated dedication in upholding the Louisiana Bar Foundation's mission to preserve, honor, and improve the justice system by funding, developing and promoting efforts which enhance the legal profession, increase public understanding of the legal system and advance the reality of equal justice under the law.

Kane is a member Adams and Reese's Litigation Practice Group. Although she has experience in casualty and employment discrimination defense, her emphasis is on complex litigation/class actions and products liability defense. Kane has worked on several class action cases, including what has been deemed the largest class action in Louisiana history. She has valuable experience in all stages of the class action case: certification, discovery, trial preparation, trial, post-trial motions and appellate briefs. She has also represented numerous products liability defendants, including manufacturers of guns, truck trailers and other consumer products.

Kane earned her Bachelor of Arts degree magna cum laude from Loyola University in 1994. She received her Juris Doctorate from George Washington University Law School in 1997, and was a managing editor of The George Washington Journal of International Law and Economics. She was also a quarter-finalist in the 1996 Van Vleck Constitutional Law Moot Court Competition and a member of the Moot Court Board, as well as a dean's fellow for the Legal Research and Writing/Oral Advocacy Program.

Ms. Kane has participated in the Metropolitan Leadership Forum, and is a Fellow of the Institute of Politics and the Litigation Council of America. She is a member of the New Orleans, Louisiana State, and Federal Bar Associations, and is also a member of the New Orleans Bar Association Inn of Court.

Michael B. Pullano Wins Trial of Personal Injury Action
Michael B. Pullano, a partner in the Firm's Philadelphia office, successfully defended a client in a personal injury action at trial before the Hon. Marlene Lachman in the Philadelphia Court of Common Pleas. The plaintiff was a waiter who suffered an allegedly career-threatening injury on the property owned by Mr. Pullano's client, a limited partnership.

The plaintiff's case-in-chief took four days and after the plaintiff rested, Mr. Pullano moved for non-suit based on the argument that knowledge of the condition on the premises could not be imputed to his client just because a limited partner in the Limited Partnership had knowledge of the condition. Because there was no proof that the general partner had knowledge of the accident (or that the limited partner who allegedly had knowledge was anything other than a limited partner), the Judge granted non-suit. The plaintiff's claim for lost earnings was approximately $150,000 and lost future earnings was $1.2 million.
