The American Apparel & Footwear Association and The Hosiery Association Recommend Farella Braun + Martel Products Law Services to Members
In accordance with the Safe Drinking Water and Toxic Enforcement Act of 1986, also known as Proposition 65, each year California publishes the Proposition 65 list, a list of chemicals known to cause cancer or reproductive toxicity. As the list grows, so do the regulations and restrictions imposed on manufacturers, importers, distributors, retailers, property owners and managers. Farella Braun + Martel is being recommended by the American Apparel & Footwear Association (AAFA) and The Hosiery Association to provide services regarding Proposition 65 and other product laws to its members.

Farella Braun + Martel will provide AAFA and THA members with regular advisories regarding developments in Proposition 65 and other product laws relevant to the apparel, footwear and hosiery industries. The annual Proposition 65 list has grown to include nearly 775 chemicals to date, and companies doing business in California must provide a warning if their products or premises cause people to be exposed to any of the listed chemicals, or if they are released into the environment.

"We are honored to provide AAFA and THA members with the latest in product law information and services," said Jim Bruen, partner, Farella Braun + Martel. "Our international leadership role on product stewardship issues relevant to the apparel, hosiery and footwear industries will benefit members as consumer product laws and standards become increasingly stringent and complex. We look forward to assisting individual members to address legal risks that might arise from the enforcement of California's Proposition 65 and other product laws." Farella products and environmental lawyers Chris Locke and Ruth Ann Castro will work with Jim Bruen on the AAFA/THA member engagements.

In addition to published advisories, Farella Braun + Martel will offer company-specific guidance concerning Proposition 65, similar product design, manufacturing or labeling laws, product defect claims, Consumer Product Safety Act, product recall counseling and other product stewardship advice upon request to association members for a discounted rate.

Foster Pepper Welcomes Colm Nelson and Allison Schwartzman
Foster Pepper PLLC is pleased to welcome Colm P. Nelson and Allison C. Schwartzman to its Seattle office.

Colm Nelson, a former associate at Oles Morrison Rinker & Baker in Seattle, joins Foster Pepper as an Associate in its Litigation and Dispute Resolution practice group. Nelson has extensive experience in construction defect litigation, representing subcontractors or general contractors in multi-party lawsuits. He earned his J.D. from Indiana University School of Law in Indianapolis, Indiana in 2005 and his B.A. from Western Washington University in Bellingham, Washington, in 2000

Allison Schwartzman joins Foster Pepper as an Associate in its Municipal Government and Public Finance practice groups. Prior to joining Foster Pepper, Schwartzman was a Public Finance Associate at Dilworth Paxson LLP in Philadelphia, Pennsylvania where she assisted in financings by a variety of issuers, including traditional municipal and school district revenue issues, and project finances. She served in roles such as Bond Counsel, Underwriter’s Counsel and Borrower’s Counsel. Schwartzman received her J.D. from Boston College Law School in Newton, Massachusetts in 2004 and her B.A. from Pomona College in Claremont, California in May 2001

Gide Loyrette Nouel advises BNP Paribas in connection with the privatisation of Sahara Bank:
Gide Loyrette Nouel (Paris and Tunis Offices) advised BNP Paribas in connection with the privatisation of Sahara Bank. On 18 July 2007, the Libyan Central Bank selected BNP Paribas as the strategic partner of Sahara Bank following a competitive tendering procedure.

According to the terms of this agreement with the Libyan Central Bank and SEDF, a Libyan State investment fund, BNP Paribas will acquire 19 % of the capital of Sahara Bank (for a consideration of 145 million euros, valuing the company at 763 million euros) and will immediately take over operational control. BNP Paribas will have an option to purchase additional shares over the next three to five years to increase its stake to 51%. The conditions for the purchase of the additional 32% have already been established.

Sahara Bank has a network of 48 branches, with a market share of 17% in loans and 22% in deposits. It has a staff of 1,500 employees and more than 300,000 individual and professional customers. This transaction represents the first bank privatisation in Libya. It will also be the first share block sale on the Tripoli Stock Exchange.

Nelson Mullins Participates in S.C. Bar Foundation Donation
The S.C. Bar Foundation received a check for more than $650,000 Thursday that will allow it to fund two significant South Carolina projects.

The funds were presented by Nelson Mullins Riley & Scarborough LLP; Richardson, Patrick, Westbrook & Brickman, LLC, and the National Bank of South Carolina. The money came from an account set up during a multi-district litigation that began in the early 1990s and was assigned to U.S. District Judge Matthew Perry in Columbia. The two law firms participated in the multidistrict litigation as liaison counsel, and the bank served as account custodian. All cases consolidated in the litigation recently ended.

"This is a wonderful example of South Carolina law firms working to assist the public and the profession, and we hope it will be an inspiration to other firms in the state," said S.C. Bar President Lanny Lambert.

One-half of the funds will serve as the initial loan awards for the Ness-Blatt Loan Repayment Assistance Program (LRAP) to assist with educational debts of legal service lawyers. The naming of the LRAP honors the public service commitment exemplified by Chief Justice Julius “Bubba” Ness and Speaker Sol Blatt. The other half has been awarded to the SC Appleseed Legal Justice Center to assist in the purchase of a new facility. This nonprofit center provides and promotes access to justice for all South Carolinians

“Through the Loan Repayment Assistance Program, the Foundation seeks to further its support of civil legal aid by easing the debt that burdens many of our legal services lawyers,” said Foundation President John McDougall. “We also are pleased that this gift will allow Appleseed Legal Justice Center to increase its capacity to serve as a resource for attorneys who work on behalf of poverty-stricken South Carolinians.”

"The funding through this generous award is being used to purchase a building for our organization," said Jack Barnes, chair of the SC Appleseed Legal Justice Center. "Through this purchase we will now have a building that will provide us strong fiscal stability and allow us to grow our programming. We will have more space for volunteers, law students and to add staff who can continue to provide advocacy and programming to assist attorneys, nonprofits and the low income community."

Incorporated in South Carolina as a not-for-profit, charitable and educational organization, the South Carolina Bar Foundation supports the goals of the legal profession by funding law-related services for the public and professional enrichment of members of the Bar. The Foundation also administers the Interest On Lawyer Trust Accounts (IOLTA) program and is tax exempt under Section 501(c)(3) of the Internal Revenue Code.

Legal Community Mourns Richard A. Hetlage
Blackwell Sanders LLP is sad to announce the death of Richard A. Hetlage, former partner of Blackwell Sanders’ merger partner Peper, Martin, Jensen, Maichel and Hetlage. Mr. Hetlage passed away on July 15, 2007; he was 81.

“Dick Hetlage was known as ‘Mr. Redevelopment’ in St. Louis because of the many major real estate redevelopment projects he handled,” said Blackwell Sanders Managing Partner Robert Tomaso. “He was a pillar of the St. Louis legal community, and his sterling reputation for integrity and premier legal work shaped the careers of generations of first-rate lawyers who were privileged to work with him.”

Mr. Hetlage was born on December 25, 1925, in St. Louis, Mo. He was a 1948 graduate of Washington University and a 1950 graduate of Washington University School of Law, where he was a member of Omicron Delta Kappa, Beta Theta Pi and Phi Delta Phi.

After finishing law school, Mr. Hetlage took a position with the new law firm of Kaufman and Stemmler, consisting of the then most recent former Mayor of St. Louis and his City counselor, respectively. It was a time when interest was growing in urban redevelopment. Mr. Hetlage represented the newly formed Urban Redevelopment Corporation of St. Louis, a civic venture of the major St. Louis banking and business firms that developed the Plaza Square Apartments in downtown St. Louis. The Plaza Square Apartments project, consisting of 1,100 apartment units in six new high-rise buildings, was the first major project in St. Louis undertaken using the then new Missouri Urban Redevelopment Corporations Law.

Mr. Hetlage quickly developed a reputation as “Mr. Redevelopment” in St. Louis and went on to represent many of the most important redevelopment projects in St. Louis from the 1950s through the 1990s, including Mill Creek Valley, Laclede’s Landing, the Manchester-Chouteau Industrial area, Lafayette Towne, Murphy-Blair, St. Louis Centre, and many other downtown office buildings, hotels and shopping centers. Mr. Hetlage was counsel of record in many of the early litigation cases establishing the constitutionality of Chapter 353, Chapter 99 and many of the other urban renewal and redevelopment statutes adopted in the State of Missouri.

Mr. Dick Hetlage and his younger brother, Robert O. Hetlage formed the Hetlage & Hetlage law firm in 1958. In 1966, they joined Christian Peper, Malcolm Martin, George A. Jensen, Warren Maichel and William Richter to form Peper, Martin, Jensen, Maichel and Hetlage, which merged with the Blackwell Sanders law firm of Kansas City in 1998.

Mr. Hetlage was elected to the St. Louis County Council and served from 1957 to 1960, including as vice-chair in 1958. Mr. Hetlage’s professional affiliations included the American Bar Association, The Missouri Bar Association and The Bar Association of Metropolitan St. Louis.
