JURY FINDS GENERAL ELECTRIC RESPONSIBLE IN ASBESTOS-LINED BRAKE CASE
Plaintiffs' litigation firm Motley Rice LLC announced today that a jury in Baltimore Circuit Court has found General Electric Company (NYSE:GE) liable in the death of three former Bethlehem Steel plant workers. All three died of lung cancer that the plaintiffs argued was caused in part by the brakes on overhead crane and mill motors at the Sparrows Point mill. The jury awarded more than $3.9 million dollars to the families.

"As co-counsel for the victims' families, we are very pleased that the jury recognized General Electric's responsibility to these families for the asbestos-lined brake products it sold," stated Fritz Jekel, a Motley Rice attorney who tried the case.

Motley Rice co-counseled with The Law Offices of Peter Nicholl of Maryland on this case.

General Electric Company (GE) is a diversified industrial corporation. It is engaged in developing, manufacturing and marketing a variety of products for the generation, transmission, distribution, control and utilization of electricity. It is headquartered in Fairfield, CT.

Foster Pepper Welcomes New Member Douglas L. Davies
Foster Pepper PLLC is pleased to welcome Douglas L. Davies to its Seattle office.

Douglas L. Davies joins Foster Pepper as a Member in its Litigation and Dispute Resolution and Financial Institutions practice groups. Formerly a Shareholder at Lane Powell, he has extensive experience in representing national and regional businesses in litigation and business matters. Davies’ practice includes counseling and representing clients in complex and class action litigation, employment, transactional, and intellectual property matters. He has an active trial practice, serving as regional counsel to a number of the largest lending institutions in the country.

Davies’ practice also includes the representation of banks, asset based lenders, and mortgage companies in litigation brought under the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Fair Housing Act, and related state laws including the Washington Mortgage Broker Practices Act and Consumer Protection Act. He also represents and counsels clients in the course of regulatory enforcement and compliance actions, including matters before the Department of Financial Institutions and U.S. Housing and Urban Development.

2010 ALLTECH FEI World Equestrian Games Name Joseph Terry As Board Member
Joseph H. Terry, a Partner at law firm Dinsmore & Shohl LLP, is one of seven selected to join the current 10-member World Games 2010 Foundation, Inc. Board. The World Equestrian Games are the world championships for eight equestrian sports—from show jumping (a course with 10 to 13 obstacles) to vaulting (gymnastics performed on a moving horse).

The games will take place at the Kentucky Horse Park in Lexington, Sept. 25 to Oct. 10, 2010. Held outside of Europe for the first time, it will be the largest equestrian sporting event ever hosted by the US; at least 500,000 are expected to attend More than 60 nations, 800 athletes and 900 horses will participate.

The Board consists of individuals with experience and knowledge in a variety of areas, including banking and finance, sports marketing, arts and local government. Terry practices in sports marketing, general business, corporate law and mergers and acquisitions; he is listed in The Best Lawyers in America, and Law & Politics named him a Kentucky Super Lawyer in 2007. Terry also serves as a Downtown Lexington Corporation Board Member, Lexington Area Sports Authority Board Member and Kentucky Sports Authority Board Member.

Donald W. Mallory To Participate In Leadership Northern Kentucky
Donald W. Mallory, an attorney at Dinsmore & Shohl LLP, was selected to participate in Leadership Northern Kentucky. Entrance into the program is competitive with approximately 38 participants accepted each session. This session kicks off with orientation on Sept.19, 2007, and continues until graduation on May 16, 2008. Dreier LLP Files Multi-Million Dollar Class Action Suit Alleging Conspiracy to Control Market for Andy Warhol Artwork
Dreier LLP (www.dreierllp.com) and its co-counsel Redniss & Associates LLC filed suit in the U.S. District Court for the Southern District of New York against The Andy Warhol Foundation For The Visual Arts, Inc., The Andy Warhol Art Authentication Board, Inc., the Estate of Andy Warhol and Vincent Fremont for allegedly illegally manipulating the art market.

Plaintiff in the action, Joe Simon-Whelan, seeks relief on behalf of himself and other owners of Warhol artwork who have had original works by Warhol falsely branded as “fakes”. Mr. Simon-Whelan is the owner of a 1964 Warhol self-portrait painting (“Double Denied”), whose authenticity was definitively and repeatedly confirmed by Warhol’s estate and others who are involved in the conspiracy alleged in the complaint. Thereafter, the Authentication Board mysteriously rejected the painting and defaced it with two red “Denied” stamps.

Mr. Simon-Whelan claims damages at $20 million, while anti-trust violations are expected to result in further damages.
Mr. Simon-Whelan is represented by Lee A. Weiss and Brian C. Kerr, partners in Dreier LLP’s Class Action Group, and Seth Redniss, managing member of Redniss & Associates LLC.

“It appears that the Warhol Authentication Board is closer to a corrupt star chamber than a non-profit,” said Seth Redniss, plaintiff’s co-counsel. “As the sole market determinant of what is and what is not a work by Warhol – and therefore what can be sold – it is all powerful in today’s art world. This Board should be run by non-conflicted Warhol experts or it should be eliminated completely from the market. As long as the Board continues to issue its authentication rulings based on financial motives instead of provenance, owners of genuine, valuable Warhol works, like Joe Simon, will suffer millions in damages.”

The complaint alleges that one of the principal tools that furthers defendants’ conspiracy is a non-negotiable submission agreement that anyone who wants to sell a Warhol is forced to sign. The submission agreement gives the Authentication Board the right to deface the artwork it rejects with a physical stamp of “Denied.” The Board also

maintains total discretion to reverse its opinion at any time and for no apparent reason – even after it has defaced a painting. Because no auction house, dealer or collector will purchase a Warhol without the Authentication Board’s stamp of approval, owners of Warhol’s have no choice but to sign the agreement – giving the Authentication Board absolute control over the future of the artwork.
