Legal bloggers have been having fun over the last week with Ken Starr's latest Supreme Court appeal. Who can blame them, when they've got the phrase "Bong Hits 4 Jesus" to work with? It seems that a high schooler in Juneau, Alaska was suspended in 2002 for putting out a banner with those words at an Olympic torch relay off-campus. In March, the Ninth U.S. Circuit Court of Appeals ruled that this was a violation of free speech; as the case waits to be heard or passed over, Gawker observes, "We love: That Kenneth Starr took the case pro bono. We love: That the Supreme Court, whether they decide to hear the case or not, will have to read the words 'Bong Hits 4 Jesus.'"

It only gets better when Decision of the Day connects the case with a Second Circuit case, Guiles v. Marineau,

involving a student's an anti-Bush t-shirt, which showed the President using illegal drugs.

The Circuit Court

overruled a former district court's decision, saying that the message was essentially political, not drug-related, and should

therefore be considered as free speech. Bob Loblaw's catch phrase: "Bong Hits 4 Bush."

One of the many, many sites commenting on the Forbes piece mentioned yesterday, and the kerfluffle which followed it, was Bag and Baggage http://bgbg.blogspot.com/2006/08/idle-man-in-f rench-maid-outfit-is-good.html, maintained by appellate and intellectual property lawyer Denise Howell.  Howell herself has been the subject of a lot of blogging recently http://legalblogwatch.typepad.com/legal_blog_w atch/2006/07/bloggers_react_.html, concerning her departure from her position at Reed Smith http://bgbg.blogspot.com/2006/07/have-aeron-wi ll-travel.html.  She’s found a new position at zdnet.com, and the new blog launched last Thursday, Lawgarithms http://blogs.zdnet.com/Howell/, will be one to watch, with the strong hope that having always had more substantial commentary will leave her immune to the Opinionistas curse.

And on a more purposeful note, Counter to the popular notion that the two main political parties are nigh-indistinguishable, Ascription is an Anathema to any Enthusiasm (http://enthusiasm.cozy.org/) has analyzed the statistics of the last 50 votes from the US Senate, and created two animated charts.  No, not animated with cartoon animals.  Settle down, I'm talking about Important Issues.

Each point on the charts represents one US Senator; they don’t move. The idea of this technique, “Optimal Classification Estimates”, is to reduce each legislator to two numbers and them pin them onto that graph. It’s extremely reductionist, but it works. The lines slicing thru the chart illustrate how voting proceeds on various bills. A line running from top to bottom reveals that a bill was decided largely on economic issues; while a line running left to right is a bill that was decided on social issues. The democrats on the left are economically liberal, i.e. they tend to look out for the weaker and more numerous economic actors. The Republicans on the right are economically conservative; look after the economically large, but few.

So is voting based on economics or social issues?  Check it out and see how it all works.
