Jessica Cox Joins Tuggle Duggins

Prior to law school, she received her B.S.B.A. in Economics from Appalachian State University, summa cum laude, where she was a member of Alpha Chi, Beta Gamma Sigma, Phi Kappa Phi, and Omicron Delta Epsilon.

David Bury joins tuggle duggins
David Bury, an Associate, is a member of the Business & Tax and Bankruptcy practice groups. His practice focuses in the area of corporations, limited liability companies, mergers and acquisitions, commercial transactions, tax, and representing creditors in federal bankruptcy proceedings and bankruptcy-related litigation.

David received his law degree from the Wake Forest University School of Law in 2006, where he served as a Notes and Comments Editor on the Wake Forest Law Review and a teaching assistant in the writing program. Before law school, he was a management consultant at a Chicago-based firm where he served various Fortune 500 companies.

David received a B.B.A. in Accounting and Finance from the University of Georgia in 1999, where he was a Georgia Governor's Scholar, a University of Georgia Alumni Scholar, and a recipient of the Honors Program Certificate of Achievement.

David is admitted to practice law in North Carolina.

EXCESS RECOVERY FORBIDDEN FOR INSUREDS OWNING SEPARATE POLICIES
The Court of Appeal has opined that two owners of separate fire insurance policies covering the same residence cannot each collect the full value of the home under their respective insurance policies when the home is destroyed.

In the case of Ann Burns v. California Fair Plan, et al., Los Angeles County Superior Court case no. BC323595, the holder of a life estate on a residence, and a trust holding the remainder interest, each purchased fire insurance policies on the dwelling from different carriers.

When the home was destroyed by fire, the life tenant and the trust brought this action, both seeking to obtain the full value of the residence under their respective policies of insurance - which amounts (when combined) would have exceeded the value of the home itself.

Invoking the "other insurance" provision contained in each policy, the insurers moved for Summary Judgment on the basis that they had fulfilled their contractual obligations by paying the life tenant and the trust the full value of the home on a pro-rata basis according to the value of their insureds' respective interests in the destroyed home. The trial court agreed and granted Summary Judgment in favor of the carriers.

On appeal, the Appellate Court confirmed the trial court's decision by opining that multiple insureds cannot collectively recover more than the full value of the property destroyed.

Chambers USA 2007 Edition Describes Smith Pachter McWhorter as "Deeply Respected"
In its 2007 edition, Chambers USA, America's Leading Lawyers for Business, described Smith Pachter McWhorter as a "deeply respected" construction and government contract "boutique" that "handles a steady stream of project administration and construction disputes." The publication pointed to the firm's representation of "both local and national contractors in relation to large infrastructure projects." Clients identified Val McWhorter as a "go-to construction lawyer" who "can be entrusted to handle really complex litigation." "Interviewees endorsed his wealth of construction experience as well as his strong courtroom presence." Mark Hanson was mentioned as a "rising star" in representing contractors, sureties and design professionals on commercial, industrial and power generation projects. Chambers described Richard Smith as a "seasoned practitioner" who "devotes his practice to acting as mediator and arbitrator in the resolution of construction and contract disputes."

Chambers also reported that the four partners who practice in the area of government contracts (Richard Johnson, Stephen Knight, Jonathan Shaffer and John Pachter) "each won significant praise from market sources for having 'in-depth expertise.'" Interviewees reported that the team "works effectively together to maximize resources," allowing it to work on major disputes and protests. Rivkin Radler to Call RexCorp Plaza Home for Another 15 Years
Rivkin Radler is staying at RexCorp Plaza. The news was announced today after the law firm signed a new 15 year lease with RexCorp Realty, owners of RexCorp Plaza. The lease includes the nearly 80,000 square feet the firm presently occupies and provides for future growth.

"My partners and I are proud to continue to call RexCorp Plaza our home," said William M. Savino, Rivkin Radler's Managing Partner. "We believe that the prominence and centrality of this location, and quality of services RexCorp Plaza provides best complement the stature of our firm as we continue to grow our local and national practices."

The decision came after nearly two years of concerted efforts by the firm's Move Committee. Committee members, Managing Partner, William Savino, Real Estate Partners, Stephen Weissman and William Cornachio, Partner Cheryl Korman, and Executive Director Paul Czeladnicki, worked in pursuit of a first class professional home for Long Island's largest law firm, its clients and employees. After a great deal of research and effort, the decision was made to remain at RexCorp Plaza.

"The selection process was both complex and challenging," remarked Partner Stephen Weissman. "In the end, our Move Committee persisted and achieved a gratifying result."

In response to the firm's continued growth, world-class architects, Mancini Duffy, were hired to redesign the space in a form that will serve Rivkin Radler well into the future. The redesign will employ the very latest technologies and most importantly will immediately accommodate the firm's recent growth as well as allowing for additional expansion. The redesign is focused not only on meeting the firm's need for additional space, but also on enhancing services for the firm's clients.
