Matheson Ormsby Prentice announces new appointments in Dublin, New York and Palo Alto
Matheson Ormsby Prentice is pleased to announce recent appointments in its Dublin, New York and Palo Alto offices.

Mark O’Sullivan has been appointed head of the firm’s US offices. Effective 1 August 2007, Mark will be based in the firm’s Palo Alto office. Mark is a senior member of the firm’s Tax Department. His practice is concentrated on advising international businesses establishing operations and doing business in and through Ireland. Mark also advises extensively on cross-border reorganisations and financing transactions with a particular focus on structured finance and securitisation transactions.

Asset Finance lawyer Marie O’Brien is also relocating to the US. Effective 1 October 2007, Marie will be based in the firm’s New York office. Marie’s practice focuses on asset finance, leasing, structured and cross-border financing and securitisations. She advises financial institutions, investment banks, aircraft financing banks, aircraft owners, aircraft lessors, airlines, financial arrangers, security trustees and investment advisers located in Ireland and throughout the world.

Tax partner Caitriona McGonagle returns to the firm’s Dublin office from New York in August 2007. Caitriona has headed the firm’s US offices for the last two years. Her tax practice is primarily focussed on advising international businesses doing business in and through Ireland. She also advises on mergers and acquisitions, re-organisations and the structuring of corporate acquisitions.

Matheson Ormsby Prentice opened its first US office ten years ago and was the first European law firm to establish an office in Silicon Valley. It is the only Irish law firm to have offices on both the east and west coasts of the United States.

Managing Partner Liam Quirke commented, “There are more than 500 US companies employing over 100,000 people in Ireland and we are confident that Ireland will continue to be the country of choice for US companies to access the European market. Having a presence on both the east and west coasts of the US puts us in a pre-eminent position to advise US companies on their Irish law requirements.”

Lamb McErlane PC Announces Merger with Schumacker & Lunkenheimer, LLP New Attorneys Expand Lamb McErlane's Business Law Group
Lamb McErlane, PC, a full-service law firm in West Chester since 1948, announced today that the Wayne, Pa., firm of Schumacker & Lunkenheimer, LLP has merged with the Lamb McErlane firm. Attorneys Robert A. Alston and Jonathan K. Wright will serve Of Counsel for Lamb McErlane, and Attorney Scott F. Schumacker will maintain an affiliate part-time practice.

“We’re thrilled to be able to offer our clients the expertise and resources of our three latest additions from Schumacker and Lunkenheimer, who have established a reputation for excellence in the practice of business law,” said Joel Frank, a Lamb McErlane partner and Chairman of the Firm’s Executive Committee. “In turn, we look forward to offering their clients our many other services in the practice areas of Business and Real Estate Law, Litigation, Family Law and Appellate Law”

The merger expands Lamb McErlane’s Business Law Department to seven practitioners, and builds the group’s bench strength in all facets of business law, from mergers and acquisitions, to taxation, estate planning, employment matters, litigation and alternative dispute resolution. Alston and Wright join James E. McErlane, managing partner; Vincent T. Donohue, John Kehner, Thomas J. O’Neill, and Steven G. Soles in providing Business Law services.

Founded by Lloyd J. Schumacker and Paul W. Lunkenheimer in Philadelphia, Schumacker and Lunkenheimer, LLP has served the Southeast Pennsylvania region since 1932. The firm began representing manufacturers and distributors, and through the years, maintained a focus on representing small to mid-size closely held businesses and their owners. The firm
moved to the Valley Forge area in 1986, and evolved to serve clients ranging from start-ups to businesses with annual sales in excess of $100 million.

Robert Alston concentrates his practice on the general business representation of clients from counseling through litigation; estate and succession planning. He also serves as an arbitrator for business and employment cases for the American Arbitration Association. A graduate of the University of Pittsburgh School of Law, Alston holds a LLM degree in taxation
from Temple University and teaches Estate Planning courses in College and Community Schools throughout the area, He also speaks to lawyer groups on litigating in an American Arbitration Association forum.

Seyfarth Shaw Expands California Labor and Employment Practice Group with Addition of Jeffrey A. Wortman as Partner in Los Angeles Office
Jeffrey A. Wortman comes to Seyfarth Shaw with extensive litigation experience in a full range of labor and employment issues, especially with regard to wage and hour issues, discrimination, retaliation, sexual harassment, whistle-blowing and similar matters. He has particular depth of experience serving the financial services and utilities industries in such matters. He also frequently counsels clients regarding personnel policies and procedures, reductions in force, employment agreements, EEOC compliance and drug and alcohol testing. Wortman has represented clients’ employment interests in state and federal court, administrative proceedings, NASD proceedings and in proceedings under the National Labor Relations Act and the Railway Labor Act.

Denis Braham and John Nolan Named Leading Dealmakers for 2007

U.S. Court of Appeals for the 6th Circuit Upholds Dismissal of Class Action Lawsuits against Coors and Other Major American Beer and Spirits Manufacturers
The United States Court of Appeals for the Sixth Circuit has upheld the judgment of the federal district courts in Cleveland and Detroit that dismissed two class action lawsuits brought in Ohio and Michigan against Wiley Rein client Molson Coors, as well as other major American beer and spirits manufacturers, alleging that alcoholic beverage industry advertising is to blame for underage drinking.

In rejecting the viability of the suits, Circuit Court Judge Alice M. Batchelder, writing for the Court, stated: “If these plaintiffs are convinced that alcohol advertising [i.e., First Amendment commercial speech] should be outlawed, then the means must be by legislation or constitutional amendment, not judicial fiat.”

This decision—by the first federal appellate court to rule on the issue to date—is the second in several pending appeals of similar district court decisions in state and federal courts across the country. In all but one of these nearly identical cases, all claims against Coors and the other defendants have been dismissed on the grounds of lack of standing or failure to state a claim. (A motion to dismiss currently is pending in North Carolina.) Each case has been brought by the same group of lawyers on behalf of plaintiffs claiming to represent a broad group of parents and guardians. These plaintiffs accused the defendants of false and misleading advertising, unfair trade practices in violation of consumer protection laws, unjust enrichment and negligence.
