Davis Polk Opens Beijing Office
Davis Polk & Wardwell today announced that the Government of the People’s Republic of China has granted the firm a license to open an office in Beijing. The Beijing office, which joins Hong Kong and Tokyo as the firm’s third location in Asia, expands the presence and reach of Davis Polk’s broad and highly successful practice in China.

Active in China for more than a century, Davis Polk is one of the most experienced legal advisers on large, complex and groundbreaking securities offerings, mergers and acquisitions, strategic investments, project financings and other global transactions involving Chinese companies. In 2006, the firm was lead counsel to the Industrial and Commercial Bank of China (ICBC) on its $21.6 billion dual-listed initial public offering, the largest IPO in history and the first-ever on a domestic Chinese stock exchange that was part of a global offering. Davis Polk also advised ICBC on a $3.78 billion investment by Goldman Sachs, Allianz Group and American Express. Other high profile Chinese matters handled by Davis Polk include the IPOs of Air China, China Merchants Bank, China Construction Bank, Sinopec, China Unicom and Baidu.com, the proposed $18.5 billion acquisition of Unocal by CNOOC, the formation of China International Capital Corporation (CICC), and numerous other equity and high-yield debt offerings, and mergers and acquisitions and private equity transactions involving companies in China.

Davis Polk partner Show-Mao Chen will head the Beijing office. Mr. Chen has more than a decade of experience advising on transactions in China, and he is cited by numerous legal guides, including Chambers Global and the Asia Pacific Legal 500, as one of the region’s leading lawyers on global transactions. He is a native Mandarin speaker. The Beijing office will be supported by the more than 20 China Practice lawyers that the firm now has in the region.

Eaton Peabody Welcomes Attorney David C. Pierson
The law firm of Eaton Peabody has announced the addition of David Pierson to the Litigation/Dispute Resolution practice in the Brunswick office.

Pierson, who has been a member of the Maine Bar for over 13 years, built his practice by representing contractors, subcontractors, modular home manufacturers and dealers in residential and commercial construction matters. Prior to attending law school, he enjoyed a successful fifteen-year career in construction and construction management as President of Pierson –Woodward General Contractors and D. C. Pierson, Inc, Construction Management.

Pierson currently serves as corporate counsel for the Downeast Chapter of the Associated Builders and Contractors, the Maine Home Builders and Remodelers Association and the Modular Homebuilders Association of Maine. Pierson was named the Associate Member of the Year by the Homebuilders and Remodelers Association of Maine in 2002. He is also a frequent mediator in business and construction disputes.

Pierson also represents clients in commercial, land use and boundary disputes. In 2003, in a case before the Maine Supreme Judicial Court, he protected landowners’ rights to appeal certain decisions by municipal codes enforcement officers who issue building permits for neighboring properties by gaining an exception for Mainers from strict compliance for notice requirements for abutting property owners. This precedent gives comfort to Mainers, especially with those with secondary or seasonal properties, that they must be informed about their neighbor’s construction plans.

Pierson represented the City of Lewiston for five years assisting in numerous land use enforcement actions, real estate and economic development matters including the Lewiston Wal- Mart distribution center project.

"During my time as the Assistant City Administrator of the City of Lewiston, I had the honor of working with Pierson," said Greg Mitchell, Eaton Peabody Consultant. "He demonstrated a strong work ethic and I found him to be both competent and creative regarding his approaches to several challenging projects."

Pierson is a past president of the Androscoggin County Bar Association and is a Director and immediate past president of the Auburn Business Development Corporation, and a Director of the Lewiston Development Corporation, and the Good Shepherd Food Bank. He is a graduate of Bates College, The Graduate Faculty of the New School for Social Research in New York city and the University of Maine School of Law. He was recently recognized by his peers for inclusion in the 2007 edition of Best Lawyers in America for construction law.

Pierson and his family currently reside in Portland and on Great Diamond Island.

Heller Ehrman Adds Leading Emerging Technologies Team in London
Only weeks after Heller Ehrman LLP announced the opening of an office in London, the firm announces today that Europe’s leading emerging technologies corporate practice has joined the firm. The team, who represent venture capitalist firms, investment banks and technology companies, includes Richard Eaton, Christopher A. Grew and Struan Penwarden, all of whom are recognised as being among the top emerging company and technology corporate lawyers in Europe. Eaton, Grew and Penwarden were formerly partners in WilmerHale’s London office. The team joins Heller Ehrman’s Corporate/Venture Law Group (VLG) practice and will anchor the London business practice.

On 16th January, Heller Ehrman announced that it was opening a London office in a move that extended three of its core practices – corporate, real estate, and competition – and bolstered Heller Ehrman’s status as a leading legal services provider to emerging, technology industry companies. One week later, the firm announced that Lawrence (Larry) W. Keeshan, the former Global General Counsel for the PricewaterhouseCoopers organisation, had joined the firm and would oversee the development and implementation of Heller Ehrman’s business strategies in Europe and Asia and lead the firm’s Securities Litigation and Regulatory Practice.

“Richard, Chris and Struan have a technology-centered practice and client base that is identical to that of our Corporate/VLG practice,” said Heller Ehrman’s Chairman, Matthew Larrabee. “Their addition to our firm gives us a leading emerging company practice in London and underscores our initiative to create the best platform in the world for representing technology companies.”

Heller Ehrman represents more than 400 emerging private and public technology companies. The firm is consistently ranked among the top law firms in venture financings by Dow Jones VentureSource. Larrabee also said that the addition demonstrates that Heller Ehrman is executing on the firm’s strategy to build on three core practice area strengths in the U.K.: corporate/VLG, real estate private equity/hotels, and competition. The firm expects to remain opportunistic, but will focus on building the London office with these three areas as cornerstones.

“The addition of this team means that Heller Ehrman will have centers of excellence in emerging and technology company issues in Asia, Silicon Valley and London, among other places,” said Keeshan. “The geographic span of this practice, and the collaborative opportunities it offers for cross-border transactional activity in this sector, distinguishes Heller Ehrman from any other American firm in London.”

The firm has arranged to lease office space on the 29th floor at 30 St. Mary Axe, which is also known as the Gherkin building, in the City of London. When the London office opens in March 2007, it will be the firm’s fourth outside of the United States. Heller Ehrman has three offices in Asia, including Beijing, Hong Kong and Singapore.

Richard Eaton’s practice focuses on mergers and acquisitions, securities law (including public and private securities offerings), as well as a range of international matters, including public and private placements for U.K. issuers and inward- and outward-bound acquisition transactions. His clients include companies engaged in a wide range of technology sectors such as optical, semiconductor design, alternative energy, software and security products. After attending Guildford College of Law, Richard qualified in 1990.

Christopher A. Grew is an American who has practiced in London since 1992. He received a B.A. from the University of Michigan and an M.A. (Hons.) in law from Downing College, Cambridge. Chris advises technology companies in venture capital transactions, public offerings, and cross-border mergers and acquisitions. He has been recognised by Business XL as one of “The Power Top 50” – the 50 most influential venture capitalists and advisors in the technology industry in the U.K.

Struan Penwarden received his legal education from the Guilford College of Law, qualifying in 1995. His practice focuses on domestic and international corporate transactions for technology companies involving mergers and acquisitions, venture capital financings, and public offerings.

Harris Beach Selected an Approved Trainer for the Public Authorities Accountability Act
The law firm of Harris Beach PLLC has been selected by the State of New York Authority Budget Office as an approved trainer for the Public Authorities Accountability Act. Harris Beach is one of only a few organizations in the state to have its Public Authorities Accountability Act training program approved by the Authority Budget Office. Harris Beach has been engaged by more than 50 state and local entities covered by the Public Authorities Accountability Act to provide legal counsel on compliance. In addition to being a certified trainer for the Public Authorities Accountability Act, Harris Beach also provides education to governmental and quasi-governmental agencies on the Procurement Lobbying Law, the Open Meetings Law, and many others.

The Public Authorities Accountability Act is intended to improve the oversight, accountability and transparency of public authorities and to promote more effective governance practices. The Authority Budget Office is responsible for approving training organizations as well as approving the content of any training provided to board members of state and local public authorities pursuant to the Public Authorities Accountability Act.

Kaveney Serves as Honorary Panelist at USA&M Tort Reform Seminar
Brian E. Kaveney, associate at Armstrong Teasdale, was an honorary panel member for an USA&M (United States Arbitration and Mediation) seminar entitled "Current Issues in the Law: Tort Reform." The seminar was held on Friday, February 2 and presented to over 200 attorneys at the Washington University School of Law. Also participating in the seminar were Edward D. Robertson, Jr., former Justice of the Missouri Supreme Court, and Ed Martin, Chief of Staff, Office of the Governor of the State of Missouri.

David Wolfsohn of Woodcock Washburn Speaks at NYCLA on Copyright Litigation
David J. Wolfsohn, a partner with the intellectual property law firm Woodcock Washburn LLP, is speaking to the New York County Law Association's Joint Entertainment & Media Law and Labor Relations and Employment Law Committees during their February 13 meeting in New York, focusing on "Copyright for the Labor Lawyer: Who Owns Employee and Management Work Product and Why Should Lawyers Worry?"

Wolfsohn will discuss the $19 million jury verdict he recently obtained on behalf of his client in a copyright case (The Graham Company v. USI MidAtlantic) where an insurance broker employed by one company left for another, but took proprietary insurance manuals, removed the copyright notices, and used the books for Articles Nexis competitor. Wolfsohn concentrates his practice on intellectual property litigation, including matters involving patents, copyrights, and trade secrets.
