Woodcock Washburn Congratulates Microsoft On Its Supreme Court Victory
Woodcock Washburn LLP was part of the trial team behind the creative thinking that led to the April 30th United States Supreme Court victory for Microsoft in Microsoft Corp. v. AT&T Corp. At issue was whether Microsoft was liable for the infringement of an AT&T patent on copies of the Windows® operating system that were manufactured and sold abroad. The Supreme Court held that Microsoft was not liable for damages under U.S. patent law because "Microsoft does not export from the United States the copies of
Windows installed on the foreign-made computers" at issue.

The trial team for Microsoft included Woodcock attorneys Dale Heist, Lynn Morreale, David Bailey, Paul Milcetic, Erich Falke and Joseph Milowic. Mr. Heist was lead trial counsel and argued for Microsoft before the United States Court of Appeals for the Federal Circuit. Before the Supreme Court, Microsoft was represented by Theodore Olson of Gibson Dunn & Crutcher LLP.

Brad Smith, Microsoft’s Senior Vice President and General Counsel, said, “This Supreme Court decision is important for the entire information technology industry, adding clarity and balance to our patent system. This decision promotes a global patent system that works. The ruling ensures that U.S. courts, like courts elsewhere, can respect the patent laws of other countries, helping promote cooperation among patent systems worldwide.
