D.C. Associate Fights Alongside AG to Defeat $10.5M Claim against Police
"As part of Fulbright’s Attorney Loan Program with the Office of the Attorney General for the District of Columbia, Fulbright associate Sarah E. Warlick and D.C. Assistant Attorney General Theresa Rowell successfully defended a civil suit filed against both the District of Columbia and an individually named police officer.

Four plaintiffs alleged claims of assault and battery, false arrest and imprisonment, and intentional infliction of emotional distress against D.C. and the individual officer. One plaintiff also alleged a separate civil rights claim against the individual officer for use of excessive force.

The claims stemmed from a July 2003 incident in which multiple police units responded to a D.C. home after a 911 call indicated a domestic assault was in progress at the residence. Upon arrival, Metropolitan Police Department officers, including the officer named individually in the lawsuit, were attacked by a resident of the home and compelled to use force against him in self-defense.

Other family members who tried to prevent the arrest of the aggressor were also injured when they attempted to physically intervene. At trial, plaintiffs relied on graphic photographs showing the various injuries they sustained in order to argue that the police officers had used excessive force and committed various other torts.

Plaintiffs filed suit in the U.S. District Court for the District of Columbia asking for $10.5M. After a successful Rule 50 motion, eight of the original eighteen claims were dismissed. After a five-day trial before Judge Colleen Kollar-Kotelly, the jury unanimously agreed that neither the District nor the individual officer were liable for any of the ten remaining claims.

Dorsey & Whitney Ranked High Among U.S. Legal Counsel in Canadian Offerings
According to a report by the National Post, Dorsey & Whitney is highly ranked among U.S. law firms for the number and value of Canadian-issued public offerings completed during the first quarter of 2007. The firm's Canada practice, anchored by Dorsey offices in Seattle, Toronto, Vancouver and Denver, ranked first among U.S. counsel to issuers in the number of public equity deals, and second in the amount raised. For combined debt and equity, among U.S. counsel to issuers, Dorsey ranked first in number of deals, and sixth in the amount raised. As U.S. counsel to underwriters, Dorsey ranked third by number of deals, and fourth by value. The rankings, based on public filings, are limited to firms listed as lead counsel in deals totaling $100 million or more. Read the rankings (PDF).

Cozen O’Connor Member John R. Washlick Elected to Board of Directors of AHLA
Cozen O’Connor member John R. Washlick has been elected to a three-year term on the board of directors of the American Health Lawyers Association (AHLA). One of only four attorneys chosen nationally, Washlick will join the 27-member board in June at the AHLA’s annual meeting. This position is one of the highest honors a legal professional can attain within the practice of health law.

The board assists AHLA in “leading health law to excellence through education, information and dialogue” and is responsible for setting policy for the Association. As the nation’s largest organization devoted to legal issues in the healthcare field, AHLA provides resources to address the issues facing attorneys who practice throughout the entire spectrum of the health industry.

Washlick concentrates his practice in health law and practices in the firm’s HIPAA and corporate compliance practice from the Philadelphia and Cherry Hill offices. He advises hospitals, physicians, entrepreneurs and health care organizations on a variety of corporate, tax and health care regulatory matters, serving as both general and outside counsel for health care mergers, affiliations and joint ventures, including planning and developing hospital/physician integration and incentive compensation arrangements.

Washlick is co-director of programs and member of the corporate governance task force of AHLA. He is also a member AHLA’s Quality Council and is the immediate past Chair of AHLA’s Hospitals and Health Systems Practice Group. Washlick is a member of the board of directors of the New Jersey Bar Association health law committee and co-chair of the health law committee of the Camden County Bar Association. He also serves on the health law committees of the Pennsylvania and Philadelphia Bar Associations.

Washlick is listed in The Best Lawyers in America and was named a Pennsylvania “Super Lawyer,” appearing in Philadelphia magazine and Pennsylvania Super Lawyers.


A resident of Mt. Laurel, N.J., Washlick earned his undergraduate degree from the University of Rhode Island (B.S., 1978), his law degree from Southwestern University School of Law (J.D., 1986), and his master of law from Georgetown University Law Center (LL.M., 1990).

BENJAMIN HAMMOND ELECTED CHAIR OF YOUNG LAWYERS SECTION
The Young Lawyers Section of the Grand Rapids Bar Association has announced that Benjamin H. Hammond, of the law firm Smith Haughey Rice & Roegge, was elected chair of the executive board for 2007-2008.

Ben is an associate in Smith Haughey’s Grand Rapids office where he practices construction law, business and commercial litigation, and general civil litigation. He was admitted to the State Bar of Michigan in 2002 after receiving his Juris Doctor from Michigan State University College of Law.

The Young Lawyers Section (YLS) provides networking and community service opportunities as well as continuing legal education to Grand Rapids’ emerging attorneys. Members must have less than five years of practice or be under 36 years old.

Firm hosts Bulgarian representatives during Ambassadors USA Roadshow
The firm welcomed over seventy Bulgarian ambassadors during a two week tour of the U.S. to highlight opportunities for investment and trade with Bulgaria, recently admitted to the European Union.

Frank Bailey, chair of the firm’s Litigation Department, serves as the Honorary Consul for the Republic of Bulgaria in Boston, and currently represents several clients with business interests in Eastern Europe.

Partnering with WorldBoston, a private, non-profit, non-partisan organization that provides a forum to educate the public about matters of national and international significance, Sherin and Lodgen LLP presented a luncheon seminar, U.S. and Bulgaria – New EU Member, New Opportunities. Attendees discussed business sectors of particular strength for Bulgaria, including automotive and aviation equipment and services, building products, environmental technologies, and medical equipment, among others.

K&L Gates Advises KBR, Balfour Beatty and The Weir Group on £350 Million Disposal of Devonport Royal Dockyard
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) has advised Kellogg Brown & Root Holdings (U.K.) Limited (KBR), Balfour Beatty Plc and The Weir Group Plc (together the "Sellers"), on the sale of the entire issued share capital of Devonport Management Limited (DML) to Babcock International Group Plc (Babcock) for a total consideration of £350 million.

DML is the operator of Devonport Royal Dockyard in Plymouth, England and is a prime support contractor to the Royal Navy, providing through-life support for submarines and surface ships, as well as operating in the private sector in the luxury yacht industry.

The sale is subject to the approval of both the Ministry of Defence and the shareholders of Babcock and is expected to complete within 60 days.

K&L Gates partners Howard Kleiman and Jeremy Davis led a cross-disciplinary team with assistance from corporate associates Simon Down and Patrick Eaton.

Kleiman said: "We are delighted to have advised the Sellers on this auction sale of one of Western Europe's largest naval dockyards, as part of the continuing consolidation of the UK defence industry."

The same K&L Gates team advised KBR on the sale of its Production Services Business in 2006. This transaction represents the first time the firm has acted on an M&A transaction for Balfour Beatty and The Weir Group.

PHILLIPS LYTLE LLP PARTNER DAVID P. FLYNN APPOINTED TO NATIONAL BROWNFIELD ASSOCIATION’S NEW YORK CHAPTER EXECUTIVE COMMITTEE
David P. Flynn, a Partner with Phillips Lytle LLP, a full service law firm with statewide coverage, was appointed to the executive committee of the National Brownfield Association’s New York Chapter for a two-year term. He also assumes the role of event committee chair overseeing planning for chapter conferences and workshop opportunities.

The National Brownfield Association (NBA) is a non-profit educational organization that is dedicated to the responsible redevelopment of brownfield properties. The New York Chapter creates a forum where property owners, developers, investors, professional service providers and presentatives from government, non-profits and academia can meet, exchange ideas and facilitate transactions.

At Phillips Lytle, Mr. Flynn’s practice is concentrated in the areas of environmental law and energy. With respect to environmental law, he concentrates on brownfield redevelopment and regulatory compliance consultations. A member of the American, New York and Erie County Bar Associations, Mr. Flynn holds a J.D., cum laude, from University at Buffalo School of Law and a B.A. from University at Buffalo. In addition, he serves as Vice Chair of the Amherst Chamber of Commerce and is a member of The Council of the Burchfield- Penney Art Center.
