Kluger Peretz Kaplan & Berlin Litigation & Bankruptcy Practices Receive Top Legal Honors
Kluger Peretz Kaplan & Berlin, one of Florida’s leading law firms, received national honors today for its litigation and dispute resolution and bankruptcy and creditor’s rights practices from the Chambers & Partners USA Guide to America’s Leading Lawyers for Business, an annual listing of the leading business lawyers and law firms in the United States. Kluger Peretz Kaplan & Berlin’s Litigation & Dispute Resolution practice went up a slot in rank. Managing director, Howard J. Berlin, and firm members Alan J. Kluger, Steve I. Silverman and Michael D. Seese all received individual recognition for being among the best in their respective fields.

“Being recognized along with such an elite and well-respected group of law firms and legal professionals is a great honor,” said Howard Berlin.“We are extremely proud of this acknowledgement of the excellent service the firm’s litigation and bankruptcy practice groups provide to our clients.”

Berlin noted that this industry accolade is particularly gratifying because of Chambers & Partner’s peer review-based ranking process. The firms and attorneys selected by Chambers USA for the 2007 listing are chosen based upon interviews with leading private practice attorneys, judges, and in-house counsel, as well as client reviews and analysis of recent legal work.

About the Chambers USA Research:

Chambers USA, a division of Chambers & Partners, conducted in-depth interviews with clients and attorneys over the telephone, each one lasting about half an hour for the current U.S. directory. The interviews were conducted across the United States, carried out by a team of 30 full-time researchers over a period of 12 months. The rankings and editorial comment about attorneys are independent and objective. Inclusion in this section of the guide is based solely on the research team’s findings. For more information,

Heller Ehrman Honors Washington, D.C. Attorney with Firmwide Pro Bono Award
Heller Ehrman has honored Brent N. Rushforth of the firm’s Washington, D.C. office with the firm’s Richard E. Guggenhime Pro Bono Award. The distinguished award is given out annually in recognition of a Heller Ehrman attorney who demonstrates commitment to significant pro bono work and community service. As part of the honor, Heller Ehrman will donate $5,000 to Rushforth’s charity of choice.

“Brent’s dedication to pro bono personifies one of the firm’s core values: community,” said Kit A. Pierson, Chair of Heller Ehrman’s Community Services Committee.” “His extraordinary achievements in pro bono over the past year and throughout his career are an inspiration for all of our attorneys at the firm, who share Brent’s commitment to justice for all.”

Among his many pro bono efforts, Rushforth, former office managing shareholder in Washington, D.C. and a member of the Antitrust Group, was recognized for his continuing work representing detainees at Guantanamo Bay. He was also recognized for representing the family of Sister Dorothy Stang, an American nun who, in 2005, was brutally murdered in the Pará region of Brazil while fighting to preserve the Amazonian rainforest. In 2005 and 2006, Rushforth and a team of attorneys traveled to Brazil to ensure that the gunman, accomplice and middlemen were tried and convicted of the murder. Last month a wealthy Brazilian landowner was also found guilty of orchestrating Sister Dorothy’s murder and received the maximum sentence allowed under Brazilian law. Human rights workers in Brazil hailed the conviction as the first sign that the government will no longer tolerate the violence and disregard for human rights perpetrated by extremely wealthy landowners in the region. Due to Heller Ehrman’s work on the Stang case, the firm was one of four law firms to receive the National Law Journal’s 2006 Pro Bono Award.

The Guggenhime Award was created in 1989 in memory of Richard E. Guggenhime, an attorney who joined Heller Ehrman in 1932 and served as managing partner from 1959 to 1973. Richard Guggenhime’s career exemplified the firm’s commitment to excellence in the practice of law and community service.

Over the past year, Heller Ehrman attorneys have been involved in a variety of important pro bono matters, including:

* Victory for Fresno’s Homeless: Heller Ehrman, together with lawyers from the Lawyers’ Committee for Civil Rights and the ACLU, brought action against the City of Fresno in U.S. District Court for the Eastern District of California to stop the City’s policy and practice of confiscating and destroying personal property of the homeless population in Fresno without adequate notice or due process. A request for a temporary restraining order and preliminary injunction was granted against the City, finding that the City’s policy and practice violated the Fourth and Fourteenth Amendments of the U.S. Constitution, the California Constitution and California statutory law. Pending further developments, a trial for a permanent injunction against the City of Fresno is expected to occur in the fall of 2007.

* California Voting Rights Act: Heller Ehrman achieved victory on behalf of Latino voters who sued the City of Modesto to enforce the California Voting Rights Act of 2001 (CVRA). The CVRA is designed to ensure that no group of voters, whatever their race, is deprived by racially polarized voting in at-large elections of the ability to elect candidates or influence the outcome of elections. The firm filed the case to end the city’s at-large voting system, which has historically prevented Latinos from electing candidates of their choice. The trial court ruled that the CVRA was invalid under the equal protection clauses of the state and federal constitutions. Later, the Fifth District Court of Appeal in Fresno reversed and adopted arguments made by our team, declaring the statute constitutional. The Court of Appeal’s decision is the first appellate-level decision upholding a state’s right to craft statutory alternatives to the Federal Voting Rights Act.

Moreover, Heller Ehrman is continually recognized for its commitment to pro bono both locally and nationally. National distinctions include:

* Ranked No. 9 nationally for pro bono work in 2005, according to The American Lawyer's AmLaw 100 Survey.
* One of four law firms in the United States to receive the National Law Journal’s 2006 Pro Bono award.
* Heller Ehrman‘s role as Charter Signatory to the American Bar Association (ABA) Pro Bono Challenge, which calls on leaders of the nation’s to 500 law firms to adopt goals for pro bono hours equivalent to five percent of the firm’s total billable hours.
