Fasken Martineau receives Best Integration Award from Marketing Research and Intelligence Association
The Marketing Research and Intelligence Associate (MRIA) granted Fasken Martineau and Corbin Partners Inc. the prestigious Best Integration Award, recognizing excellence in marketing and public opinion research. The award came as a result of the efforts of May Cheng, Julie Desrosiers and Leanne Shaughnessy for their innovative work in a trade-mark infringement case involving Victoria's Secret and La Senza.

In conjunction with Corbin Partners Inc., the team integrated several different sources of information including mystery shopping raised to scientific standards, statistical analysis of worldwide advertising and sales and an expert marketing review of relevant issues in brand equity and reputational harm, in order to demonstrate confusion between the trade-marks at issue.

The mystery shopping survey was accepted by the Ontario Superior Court of Justice when tendered into evidence on an interlocutory injunction application. This represented the first time a Canadian court has accepted mystery shopping as expert survey evidence in an intellectual property dispute. Consequently, the ruling has opened the door for use of this innovative technique to present evidence of confusion in situations where there is insufficient time to obtain a more traditional form of survey evidenc

Fourteen Gordon & Rees Attorneys Named as Southern California Super Lawyers
Fourteen attorneys in the San Diego office of Gordon & Rees LLP were selected to the 2007 Southern California – San Diego Super Lawyers® list, published by Law & Politics. The attorneys were selected by their peers and represent the top 5% of all San Diego county attorneys.

Miles Scully and James McMullen were included in the Top 50 list of lawyers who received the highest point totals in the balloting process. Additionally, Richard Sybert was featured in an article on San Diego’s increasingly high-profile intellectual property community.
