Locke Reynolds Presents "Insurance Law Update" to the Association of Corporate Counsel
David T. Kasper presented “Insurance Law Update” to the Indiana Chapter of the Association of Corporate Counsel. The presentation was made at the group’s monthly breakfast meeting.

The Association of Corporate Counsel is the in-house bar association, serving the professional needs of attorneys who practice in the legal departments of corporations and other private sector organizations worldwide. The association promotes the common interests of its members, contributes to their continuing education, seeks to improve understanding of the role of in-house attorneys, and encourages advancements in standards of corporate legal practice.

Mr. Kasper is a partner of Locke Reynolds with almost forty years experience. He concentrates his practice in insurance law, and has chaired over 80 trials to verdict. Mr. Kasper serves as chair of the Locke Reynolds Insurance Services Group.

Perkins Coie Expands Antitrust and Commercial Litigation Practice With the Addition of Alexis, Chiappetta and Yurasek
Perkins Coie announced today that Geraldine Alexis, David Chiappetta and Jason Yurasek have joined the firm as partners in its Commercial Litigation practice. All three will practice in Perkins Coie's San Francisco office and joined the firm from Bingham McCutchen.

"We are excited to have these three extremely talented attorneys join our team," said Jay Rossiter, San Francisco managing partner. "We are committed to enhancing our California presence as a way to ensure that our clients in this state and elsewhere continue to receive exceptional legal service. That commitment is reflected in the growth of our practices throughout the state."

Alexis, who was co-chair of Bingham's Antitrust and Trade Regulation practice, has extensive experience representing clients before courts and governmental agencies. She has represented clients before the Department of Justice, the Federal Trade Commission and state antitrust enforcement agencies in several significant mergers, acquisitions, joint ventures and government antitrust investigations. Alexis also counsels businesses on the antitrust aspects of joint ventures, distribution contracts, and intellectual property licenses as well as other transactions.

"I am delighted to join Perkins Coie's San Francisco office” said Alexis. “I know that, given the strategic locations of Perkins' offices and the superlative legal service David Chiappetta, Jason Yurasek and the many other great lawyers at Perkins will provide my clients, they will be well-served by Perkins." Prior to joining Bingham, Alexis was a partner at Sidley & Austin in Chicago. She earned her law degree from Northwestern University School of Law, her master's degree from Kellogg School of Business and her undergraduate degree from the University of Rochester.

Chiappetta was a partner in Bingham's Antitrust and Complex Commercial Litigation practice groups. He has represented clients in a wide range of matters, and has both bench and jury trial experience. Chiappetta’s areas of focus include antitrust and unfair business practice claims, professional negligence claims, and the electronic payments industry. He has also managed a number of significant electronic discovery (eDiscovery) matters relating to the organization and production of electronic documents. Chiappetta earned his law degree from the University of Washington School of Law and his undergraduate degree from Willamette University.

Yurasek has represented clients in a wide range of commercial litigation matters, including antitrust, business torts and intellectual property and trademark litigation. He has extensive experience in eDiscovery, including counseling clients on the issue and successfully litigating eDiscovery issues before state and federal courts. He is a member of the Sedona Conference's exclusive eDiscovery think-tank (WG1), and has actively participated in and organized several conferences on eDiscovery. He also has significant experience representing clients in complex state and federal class actions. As a partner in Bingham's Antitrust group, he prosecuted and defended claims involving a number of antitrust issues, including cross-over issues related to antitrust and intellectual property. His intellectual property practice includes patent, trade secret and trademark litigation. He earned his law degree from Northwestern University School of Law and his undergraduate degree from Indiana University.

Rich May Client, Galaxy Internet Services Will Launch First Town-Wide WiFi Network
Congratulations to Rich May client Galaxy Internet Services, Inc. (“Galaxy”), the regional leader in Internet services and municipal wireless networks. The town of Brookline announced that it will launch the region’s first town-wide combined WiFi/public safety network at a July 18 “wire-cutting event” as part of an innovative public/private partnership. The multi-use network will be owned and operated by Galaxy and Brookline will be the first municipality in the United States to have a “border-to-border”, multi-use first responder WiFi network providing important public safety benefits.

The goal of the project is to satisfy Brookline’s need for improved public safety and municipal communications while providing consumers and business with new options for Internet access. In addition to paid wireless Internet access for consumers and businesses, limited free access will be available in certain commercial areas, Brookline Housing Authority properties and public parks, the town said. The packages made available by Galaxy to residents and businesses will be less costly for similar plan types offered by other companies.

According to Bob Carp, Galaxy’s president, “The Brookline WiFi mesh network is an excellent example how a single wireless infrastructure can support both public safety and general public access.”

Court affirms trial victory for Ropes & Gray client
On July 10, 2007, the U.S. District Court for the District of Massachusetts denied a motion to set aside a jury verdict favoring the Massachusetts Eye and Ear Infirmary (MEEI), a client of Ropes & Gray.

Under the court's ruling, MEEI is entitled to a 3.01 percent royalty on worldwide sales of Visudyne®, a treatment for age-related macular degeneration (AMD). Visudyne® is the market leader in the U.S. and the only drug-based treatment for AMD sold in other countries, with total sales to date of about $2.3 billion. The ruling also awards MEEI prejudgment interest at an annual rate of 12 percent effective as the sales were made and the royalty would have become due. Finally, the court awarded MEEI more than $14 million in attorneys' fees.

MEEI brought suit more than five years ago against QLT, a Canadian biopharmaceutical company, seeking compensation for MEEI’s researchers' contributions to the development of Visudyne®. On November 8, 2006, after a three-week trial and two days of deliberations, a federal jury found that QLT had been unjustly enriched by MEEI's contributions and that QLT had committed unfair trade practices under Massachusetts state law. The jury awarded MEEI a 3.01 percent royalty on net sales worldwide. QLT subsequently filed a motion for judgment notwithstanding the verdict, contending that, in federal court, the jury could only serve in an advisory capacity.

In considering QLT's motion, the court waded through what it called "the murky waters of Seventh Amendment jurisprudence and a dense thicket of First Circuit precedent" and found that, while unjust enrichment was for the court and not the jury, it would defer to the jury’s factual findings on the issue of unfair trade practices. The court then went on to say: "Nonetheless, the best way conclusively to demonstrate that the jury got it right is to rehearse the facts as they would independently have been found by the court had it been the fact finder," which the court did in its 67-page decision.

"The royalties and other payments to MEEI recognize the significant contributions made by MEEI and its researchers, Drs. Joan Miller and Evan Gragoudas, to this important treatment for a major cause of blindness and will advance this renowned institution's work on curing diseases of the eye, ear and throat," said Ken Herman, the partner who led Ropes & Gray's trial team.
