Foster Pepper Ranked Second in Nation by Thomson Financial
Foster Pepper PLLC has been listed by Thomson Financial as second in the nation for “U.S. Municipal New Issues – Bond Counsel Competitive (AT5b),” with $1.7 billion in the first half of 2007. Rankings and volume totals include all long-term municipal new issues underwritten during the period from January 1, 2007 to June 30, 2007 and from January 1, 2006 to June 30, 2006, and do not include short-term, preliminary, private placement or rank ineligible issues.

Foster Pepper’s bond counsel group is “nationally recognized,” as that term is used in the municipal securities industry, and has been for more than 60 years. Bryan R. Berry Joins Lathrop & Gage as an Associate
Joel Voran, CEO of Lathrop & Gage L.C. announced today that Bryan R. Berry has joined the Springfield, Mo. office as an associate in the business disputes practice area.

Berry focuses his practice on business disputes representing clients’ business disputes including breach of contract matters, loan enforcement actions, construction matters, insurance disputes, regulatory matters, business torts and professional liability matters. Prior to joining the firm, Berry served for three years as an assistant prosecuting attorney in Greene County, Missouri. He served as judicial clerk to the Honorable Phillip R. Garrison of the Missouri Court of Appeals from 2002 to 2004. During law school, Berry worked in the Criminal Division of the Missouri Attorney General’s Office assisting in the defense of state felony convictions at the appellate level.

Berry received his undergraduate degree from William Jewell College in 1991 and his juris doctorate from University of Missouri School of Law in 2002. He also attended Oxford University in Oxford, England in 1989-1990. He is a member of The Missouri Bar, the Missouri Young Lawyers Association and the Springfield Metropolitan Bar Association.

Harry P. Ogden Elected to Tennessee Bar Foundation Board of Trustees
Harry P. Ogden of Baker, Donelson, Bearman, Caldwell & Berkowitz, PC, was elected to the Tennessee Bar Foundation Board of Trustees at the annual meeting held in Nashville in June. The Foundation elects three new Trustees every year, one from each Grand Division of the state. Mr. Ogden, whose term will be from 2007 to 2009, was the nominee for East Tennessee this year.

A shareholder in Baker Donelson's Knoxville office, Mr. Ogden represents nursing homes and other health care providers and professionals as well as accountants, lawyers, agents and brokers. He has handled multiple premises liability claims for grocery stores, discount merchandisers, home improvement stores and industrial facilities and has defended manufacturers and distributors of products, including medical devices, industrial equipment, automotive components, asbestos and other chemical and alleged toxic tort matters. A graduate of the University of Tennessee School of Law, Mr. Ogden is a member of the Defense Research Institute and the American Health Lawyers Association. He has been recognized by The Best Lawyers in America® list (Copyright 2007 by Woodward/White, Inc., of Aiken, S.C.) in the practice areas of medical malpractice law and product liability litigation.

Stephen Oleskey Testified Before the Senate Armed Services Committee on the Topic of Habeas Restoration
Stephen Oleskey testified before the Senate Armed Services Committee on the need to restore habeas corpus protections. Stephen, and a team of WilmerHale lawyers, represent six men from Bosnia and Algeria who have been imprisoned without charge at Guantanamo Bay since January 2002.

The 9:00 a.m. EST hearing entitled, “Upholding the Principle of Habeas Corpus for Detainees” also included the following witnesses: David Keene, Chairman of American Conservation Union; Patrick Philbin, Former Associate Deputy Attorney General of the Department of Justice; Lt. Col. Stephen E. Abraham of the US Army Reserves, and; Greg Katsas, Principal Deputy Associate Attorney General of the Department of Justice.

This hearing follows on the heels of the team’s recent Supreme Court permission for a rehearing in the Guantanamo case that will allow the Court to address some of the most important constitutional issues of our time. To read more about this rehearing, click here.

RDB Files Motion on Behalf of San Diego Catholic Parishioners
RDB partners Fletcher W. Paddison and Michael J. Whitton filed a motion in bankruptcy court today on behalf of individual parishioners who are part of a committee devoted to protecting the schools, churches, and charities of the Catholic Diocese of San Diego from potential sale as part of a bankruptcy settlement.

The San Diego Diocese filed bankruptcy in February 2007 before the first of the numerous sex abuse trials involving members of the clergy got started. The group representing the plaintiffs in the sex abuse cases has filed a related lawsuit seeking to have the Catholic churches and Parish schools included as assets in the bankruptcy estate, which puts the churches and schools at risk of being liquidated to satisfy victims’ claims.

The motion filed today by Mr. Paddison and Mr. Whitton seeks to intervene in this lawsuit in order to give a voice to the local parishioners of San Diego and Imperial counties who have funded the acquisition, construction, and maintenance of the churches and schools through individual contributions.

“We believe the parish schools, churches and accounts are not the property of the Bankruptcy Estate, as these institutions have been built and paid for solely through parishioner resources,” said Mr. Paddison. “We further believe that the possible dissolution of these faith-based resources would be a tremendous loss to our community of faith and negatively impact the community at large.”

The parishioners hope for a rapid and fair settlement for the victims of clergy abuse in a way that does not cripple the Parishes. Mr. Paddison said, “these people deserve just compensation, but we have to find a way to accomplish that with fairness for all.”
