Parker Named to Who's Who in Technology
The St. Louis Business Journal recently profiled Blackwell Sanders Partner Saraann Parker in its “Who’s Who in Technology” section. The section features two categories of people: designers and builders of high-tech and biotech facilities and lawyers who work with tech and biotech clients.

Since joining the firm in 2001, Parker advises clients on their rights to license, own, use and protect proprietary technology, intellectual property, and celebrity rights of publicity; prepares and negotiates agreements governing the license, development, manufacture, and sale of products containing proprietary technology, trademarks, and celebrity likenesses. She has expertise in technology and merchandise licensing, commercial transactions and Internet law.

Parker also frequently counsels clients on Internet law issues, including current legislation governing privacy rights and FTC enforcement of COPPA and the Can-Spam Act; prepares and negotiates Internet hosting, development, subscription, and web-based license agreements, and Internet user terms and privacy policies

She graduated from Saint Louis University School of Law, cum laude, in 1996, where she was a recipient of the Melvin Friedman Real Estate Fellowship. She is a member of the American Bar Association, the Bar Association of Metropolitan St. Louis, the California Bar Association and The Missouri Bar.

Wilson Sonsini Goodrich & Rosati Expands Outsourcing & IT Procurement Practice
Wilson Sonsini Goodrich & Rosati, the premier provider of legal services to technology, life sciences, and growth enterprises worldwide, today announced that Adam Sak has joined the firm as a partner in its outsourcing and IT procurement practice.

"With his focus on outsourcing and his broad expertise, Adam is a great addition to our technology transactions team," said CEO John Roos. "He has extensive experience working with Global 1000 and Fortune 200 companies, and will be able to serve clients in a wide range of industries. We are very pleased to welcome Adam to the firm."

Prior to joining Wilson Sonsini Goodrich & Rosati, Sak was a founding member of the transaction architecture and negotiations management practice at EquaTerra, a leading outsourcing advisory group. In that role, he served as the lead commercial advisor in the structuring, negotiation, and implementation of strategic BPO and ITO transactions spanning North America, Europe, Asia, Latin America, and South America. He also advised clients on such matters as RFP development, contract strategy, and emerging standards and trends in the outsourcing arena. His clients have included prominent global companies in a variety of industries, including consumer goods, financial services, airlines, pharmaceuticals, food and agriculture, energy, oil & gas, apparel, entertainment, electronics, and information technology.

Sak previously worked as director of legal affairs at Exult, where he structured and negotiated human resources business process outsourcing (HR BPO) transactions between the company and its clients, and negotiated third-party sourcing agreements to support the HR BPO service model. He also was responsible for maintaining Exult's compliance with U.S., European, and Canadian privacy and data protection laws, including HIPAA, the E.U. Privacy Directive/Safe Harbor, and Canada's Personal Information Protection and Electronic Documents Act.

Earlier in his career, Sak practiced at Cooley Godward LLP; Quinn Emanuel Urquhart Oliver & Hedges; and Pillsbury Madison & Sutro. He earned his J.D. from UC Berkeley's Boalt Hall School of Law and received a B.S. in finance from Miami University. Prior to law school, he held consultant positions at SAP America and Andersen Consulting.

Sak will be based in the firm's Palo Alto office.

John Hurlbut Honored by Public Law Center as Attorney of the Year
Rutan & Tucker partner John Hurlbut was honored as the Public Law Center's (PLC) 2007 Attorney of the Year at the annual Volunteers for Justice Dinner along with PLC's Law Firm of the Year, Minyard Morris LLP, and Corporate Partner of the Year, Macy's West, on July 26, 2007. The annual event spotlights leadership and exemplary service to the community.

In his comments Ken Babcock, the Executive Director of the Public Law Center, noted, "One of the reasons Mr. Hurbut, Jr. was nominated for this important award is his long-term dedication to the Public Law Center. Mr. Hurlbut, Jr. of Rutan & Tucker LLP made a pledge a number of years ago to always have at least one case open with PLC. Patton Boggs Attorney Stephen Molina Selected International Committee Chair of the Interstate Oil and Gas Compact Commission (IOGCC)
Patton Boggs LLP is pleased to announce that Robert Stephen Molina has been named Chairman of the Interstate Oil and Gas Compact Commission (IOGCC) International Committee. This follows his appointment early last year by Texas Governor Rick Perry to serve as a Texas Member to the Commission.

The IOGCC, representing the governors of 30 member and seven associate states, promotes the conservation and efficient recovery of the nation’s oil and natural gas resources while emphasizing health, safety, and the environment. Established by the charter member states’ governors in 1935, it is the oldest, largest, and most effective interstate compact in the nation. The International Committee coordinates the affiliation and activities of International Affiliate nations, such as various Canadian provinces, Venezuela, Egypt, and others.

In a letter, North Dakota Governor and current IOGCC Chairman John Hoeven praised Mr. Molina’s commitment and abilities writing, “The time you have invested through your leadership of the IOGCC International Task Force and your willingness to serve as chairman of this important standing committee is a service to me and all the member governors.….I look forward to working with you to further the goals of the states and of the IOGCC.”

Mr. Molina was formerly the General Attorney of ARCO Oil and Gas Company, Vice President General Counsel at Vastar Resources, Inc., Chief Counsel for ARCO Latin America (Caracas, Venezuela), Vice President and General Counsel for Benton Oil and Gas Company (now Harvest Natural Resources), and General Counsel to the Oman Oil Company in the Sultanate of Oman.

He is a 1970 graduate of the University of Texas at Austin (B.A.) and 1974 graduate of Southern Methodist University School of Law (J.D.), and will continue to serve as an Of Counsel with the law firm of Patton Boggs LLP, in Dallas.

Patton Boggs LLP Honors Colleagues for Outstanding Pro Bono Achievements
Patton Boggs LLP s pleased to announce the winners of the firm’s 2006 Pro Bono Awards. The Pro Bono Awards are presented each year to associates and partners in recognition of their outstanding pro bono achievements.

Marci Fulton from the Patton Boggs Denver office was named the 2006 Pro Bono Associate of the Year, and Deborah Lodge, a Washington, D.C.-based attorney, was named the 2006 Pro Bono Partner of the Year. These awards are based on the recommendations of the Pro Bono Committee, co-chaired by partners Denise Vanison and Mike Forshey. Firm Managing Partner Stuart M. Pape conferred the awards and honorable mention recognitions to a diverse group of associates and partners from many of the firm’s offices.

Ms. Fulton was presented with the Associate of the Year for demonstrating her exceptional advocacy skills in a variety of pro bono matters, regularly taking on one challenge after another in 2006. She is currently part of a team representing a widow and her seven children in a product liability action against a truck manufacturer whose truck struck and killed a miner working at a mine site. Her involvement began at the appellate level, preparing legal briefs and arguments on appeal. The appeal resulted in two oral arguments before the Louisiana Third Circuit Court of Appeals and the denial of a writ petition by the Louisiana Supreme Court. Marci and the team have recently distributed the judgment proceeds from the truck manufacturer to the family.

Marci has also served as a volunteer attorney for the Colorado Lawyers Committee “Project Homeless Connect,” a one-day event focusing on providing homeless individuals with much-needed information regarding housing, benefits, social security, child support, and other legal issues. In addition, Marci is a member of the Lawyers Committee’s Legal Night at Mi Casa steering committee. She also served as the firm’s representative at the ABA Equal Justice Conference this year.

In the Partner of the Year category, Ms. Lodge was singled out for her unwavering dedication to pro bono and exemplifying the firm’s continuing commitment to public service. Deborah provided pro bono IP assistance to several non-profit organizations. Her work consisted of protecting clients’ trademarks, perfecting their claims to trademark rights, and helping clients select unique and protectable trademarks.

Deborah also assisted the Shafallah Center (a state of the art medical center designed to treat children with genetic abnormalities in Qatar) with patent licensing issues. Additionally, Deborah contributed significant pro bono hours to the Vietnam Women’s Memorial Foundation, Inc., working with the foundation on a copyright infringement lawsuit in federal court.

“In presenting these honors, the firm considers not only the quantity of pro bono work, but also such factors as the variety and depth of pro bono work, a consistent commitment to public interest law, initiative in seeking pro bono opportunities, and a willingness to take on low-profile work that is unlikely to attract attention, as well as work for high-profile causes”, stated Stuart Pape, Firm Managing Partner. “We are exceptionally proud of our colleagues for their dedication and commitment to these worthy causes.”

Associate honorable mention awards were presented to attorneys who have made a significant impact on the firm’s pro bono success. These awards were presented to Christine Williams (Anchorage), Robert Hawkins (Dallas), John Sharp (Denver), Steven Savage (New Jersey), Alexandra Metzner, Edward D. Gehres, III, Nigel Wilkinson, Cordell Hull, Travis Seegmiller, Alexandra Chopin, and Karen Thiel, all from the Washington, D.C. office.

Partner honorable mentions included Michael White (Anchorage), Christopher Richie (Dallas), James Lewis (Denver), William Cattan (Doha), Scott Chambers (Northern Virginia), and Susan Temkin (Washington, D.C.).

This is the twelfth year for which an Associate of the Year Award has been given and the eighth year for the Partner Award.

Moses & Singer settles copyright royalty rate dispute for client Music Choice®.
Moses & Singer has been representing Music Choice in litigation to adjust the rate paid for a compulsory license to use sound recordings in Music Choice's digital music service. The litigation has been proceeding before the Judges of the newly-created Copyright Royalty Board, which is tasked with setting rates for various compulsory licenses provided by the Copyright Act. SoundExchange, the licensing body representing the interests of record labels and performing artists was seeking an increase from Music Choice's current rate of 7.25% of revenue to a proposed rate of 30% of revenue. In the middle of trial, which also involved setting the rates for satellite radio services XM and Sirius, SoundExchange agreed to settle with Music Choice. The terms of the settlement are currently confidential. SoundExchange has not settled with XM or Sirius, and the trial continues with respect to those services. The Music Choice trial team was led by Paul Fakler, with assistance from David Rabinowitz, Julie Stark, Amanda Schaffer, Chris Gresh and Michelle Byron. In describing Moses & Singer’s representation of Music Choice in this matter -- Paula Calhoun, Senior Vice President and General Counsel of Music Choice, stated "Paul [Fakler] and his team at Moses & Singer did an excellent job in representing Music Choice through each step of the trial process and achieving this settlement. These rate proceedings are not typical litigation - this proceeding was particularly challenging given the complex legal issues at play, business implications and parties involved. Moses and Singer's copyright expertise, trial skill and counsel were invaluable."

Court of Appeals Upholds Decision in Ngo Case
In the July 26, 2007 edition of the Minneapolis Star Tribune, reporters Dan Browning and David Chanen detail the decision by the 8th Circuit Court of Appeals to unanimously uphold the denial of summary judgment to the individual defendant in the shooting of a Minneapolis police officer.
