Holland & Knight's Richard Hutchison Appointed to Judicial Nominating Commission for the Fifteenth Circuit
Richard "Rick"Hutchison, a commercial and construction litigation partner at Holland & Knight, has been appointed by Governor Jeb Bush to the Judicial Nominating Commission for the Fifteenth Judicial Circuit. The appointment is for a four-year term.

The role of the Commission is to interview, assess and then recommend nominees to the Governor for mid-term appointments to the circuit and county court when vacancies occur.

Holland & Knight Partner Leonard H. Gilbert Appointed to American Bar Association's Committee on Federal Judiciary
Leonard H. Gilbert, a partner in Holland & Knight's Tampa office, has been appointed by American Bar Association (ABA) President-Elect, Karen Mathis, to the ABA's Committee on Federal Judiciary, representing the Eleventh Circuit. In this role, he will review all Presidential nominees to the Federal Courts in Florida, Georgia and Alabama, as well as all nominees to the United States Supreme Court.

Appointments to the 15-member Committee are based on a reputation for the highest professional stature and integrity. Gilbert was appointed for a three-year term.

The Committee evaluates the professional qualifications of persons nominated for appointment to the Supreme Court of the United States, circuit courts of appeals, district courts, the Court of Appeals for the Federal Circuit and the Court of International Trade. The Committee’s goal is to support and encourage the selection of the best-qualified persons for the federal judiciary. It restricts its evaluation to issues bearing on professional qualifications and does not consider a nominee's philosophy or ideology. The Committee's peer-review process is structured to achieve impartial evaluations of the integrity, professional competence and judicial temperament of nominees for the federal judiciary.

Gilbert practices in the areas of commercial litigation, commercial finance, creditors' rights, insolvency and arbitration. He also maintains an active transactional and business practice. A former President of The Florida Bar and active in the American Bar and International Bar, Gilbert is consistently recognized in Who's Who in America, Best Lawyers in America, Who's Who Legal, Florida Trend's Legal Elite and Florida Super Lawyers.

Mariely Downey joins Hodgson Russ

Solvay Pharmaceuticals, Inc. Wins $23 Million False Advertising Settlement
Solvay Pharmaceuticals, Inc. settled its lawsuit against Global Pharmaceuticals and Impax Laboratories, Inc. alleging that the companies falsely advertised and marketed their products as generic equivalents and substitutes for the Solvay’s branded product, Creon® Minimicrospheres® (Pancrelipase Delayed-release Capsules, USP). Fulbright partners Saul H. Perloff of the San Antonio office and Marc B. Collier of the Austin office represented Solvay Pharmaceuticals.

AustinWhile the settlements are confidential, the press releases from both parties confirm that defendants have already paid Solvay $12 million of the $23 million settlement. The settlement also requires defendants to (1) discontinue marketing practices that state or imply their products are generic equivalents to Creon®products; (2) discontinue current product labeling, distribution and sales of three products; and (3) disseminate corrective advertising through written communication to customers, database companies, and managed care organizations. The communications must state that their products are not generic equivalents to Creon®brand products and should not be substituted for them without physician supervision.

Creon®products are pancreatic enzyme supplements for the treatment of pancreatic exocrine insufficiency, often associated with conditions such as cystic fibrosis and chronic pancreatitis.

Also assisting on the Solvay team were Lisa Shub, Byron Stone, Anne Grigg, Kaycie Wall, Kathy Grant, Connie Janise, Dana Thompson, Eve Gaus, Jeannie Dubbel, Garry Entress, Stacy Hay, Elizabeth Lewis and Gricelda Gonzales.

Firm Recognizes Visionary Business Leaders with Entrepreneur of the Year Awards
Faegre & Benson served as the exclusive legal sponsor of the Entrepreneur of the Year Awards in both the Minnesota/Dakota and Rocky Mountain regions in 2006. This is the sixth consecutive year that the firm has partnered with Ernst & Young to recognize regional entrepreneurs who have an entrepreneurial spirit and drive and have built successful businesses.
