Weltman, Weinberg & Reis Co., L.P.A. Partner is Selected for ARMDI Board
Alan Hochheiser, managing partner of the bankruptcy practice group at Weltman, Weinberg & Reis Co., L.P.A., the nation’s largest creditors’ rights law firm based on revenue and placements according to Collections & Credit Risk magazine, was selected to the Board of the American Friends of Magen David Adom (AFMDA), American Red Magen David for Israel (ARMDI) - David Berger Chapter in Shaker Heights, Ohio.

Now known as American Friends of Magen David Adom (MDA) with its national headquarters in New York City, MDA is celebrating its 67th year of supporting the vital work of MDA in Israel. Founded in 1940, the ARMDI was incorporated in the State of New York to give medical assistance to the people of Israel (then Palestine). The MDA and its team of trained volunteer and professional medical responders depend on AFMDA support to provide the entire nation’s pre-hospital emergency needs, including medical, disaster, ambulance and blood services.

Al Hochheiser explained, “It is quite an honor to be selected to the Board of ARMDI and I look forward to the opportunity.” Al will help with the fundraising efforts of the local branch, David Berger Chapter of the ARMDI, to support the Israeli ambulance and blood services. In the past five years, AFMDA has raised over $90 million to purchase medical supplies and ambulance for MDA in Israel, while the David Berger Chapter was able to contribute $18,000 of that last year alone. Al is also on the committee for a 5k race that is taking place in October 2007 that will help contribute to their fundraising efforts for the year.

Alan Hochheiser is the managing partner of the Bankruptcy department of Weltman, Weinberg & Reis Co., L.P.A. and is located in the Brooklyn Heights, Ohio operations center. Mr. Hochheiser earned his J.D. from Case Western Reserve University School of Law in 1988 and his B.A. cum laude from the State University of New York at Albany in 1985. A member of the Ohio State and Cleveland Bar Associations, Mr. Hochheiser is licensed in Ohio. He is admitted to practice before the Sixth Circuit Court of Appeals and the U.S. District Court (Northern District of OH, Western District of PA). Mr. Hochheiser is currently a member of the American Bankruptcy Institute (Consumer Committee member), Commercial Law League of America, National Association of Chapter 13 Trustees (Creditors Auxillary member) and Phi Delta Phi. He is a frequent lecturer on bankruptcy issues and has been published in CUES Credit Union Management. His community involvement includes volunteering with the Fairmount Temple (Board Member and past Brotherhood President) and the Montifiore-Fairmount Temple Mitzvah Corp.

Governor Signs Long-Awaited PE Reform Bill
Representing a first step of many in restoring physical education to Oregon schools, Governor Ted Kulongoski signed House Bill 3141 into law today to arrest the obesity epidemic and the growing levels of inactivity of Oregon’s youth. The new legislation establishes a standard of 150 minutes per week or PE instruction for elementary and 225 minutes per week for middle school students to ensure that physical education is a component of every K-8 school curriculum throughout Oregon.

The new legislation provides $1 million, with $860,000 targeted for a grant program to support schools in meeting the new minimum standards for PE instruction. The remaining $140,000 is allocated to fund a much-needed statewide inventory of PE instruction around the state’s 200-plus school districts. The inventory will provide future legislatures with data to determine future funding needs to fully implement the PE grant program within the decade.

Childhood obesity is a serious problem in Oregon. 25 percent of Oregon’s 8th graders are overweight or at risk for becoming overweight and this number has been increasing. The rise in childhood obesity is partly due to the fact that physical education was no longer a mandatory part of the school day. Lack of PE not only leads to overweight, unhealthy children, but also makes children less ready to learn in the classroom. The cost of obesity is alarming: $781 million was spent in Oregon in 2003 on obesity-related medical costs.

The enlightened PE legislation, seen as a victory for more healthy kids, was championed by Senate President Peter Courtney, Majority Leader Richard Devlin, and Senator Kate Brown. More than 35 organizations from across the state that actively endorsed the legislation included the American Heart Association, Oregon Sports Authority Foundation, Council for Children’s Expanded Physical Education and Oregon Medical Association. Nike, part of this coalition, represented strong business community leadership for the passage of the PE reform.

“Starting here in our own backyard, Nike is committed to helping kids have access to play, sports and physical activity,” said Julia Brim-Edwards, Nike¹s Director of State and Public Affairs. “This is a great day for Oregon¹s kids as we once again recognize the importance and benefits of physical fitness and physical education.”

Dr. Minot Cleveland, a coalition leader who worked on this issue for the past two decades stated, “Passage of this bill is the first critical step in restoring quality physical education to its rightful place in Oregon schools. We cannot “treat” our way out of the obesity epidemic. From a public health standpoint, we must move upstream. Quality, standards-based PE will improve the health, fitness, and academic performance of Oregon children.”

Owen Blank, who spearheaded the support of the Oregon Sports Authority Foundation for PE reform remarked, "Our Legislature deserves the thanks of all Oregonians who care about kids. Legislation bringing PE back to and setting nutrition standards for our schools and significantly increasing funding for Head Start programs will positively impact the lives of our children for years to come."

Sharon G. Newman Elected Board President of the Congregation Bet Ha'am in S. Portland, ME
Preti Flaherty’s Sharon G. Newman has been elected President of The Congregation Bet Ha’am Board of Directors in South Portland, Maine. Congregation Bet Ha’am is the spiritual home for an active and growing community of Reform Jews. During Ms. Newman's term as president, Bet Ha'am will complete a capital campaign to fund construction of a new sanctuary and renovation of its current building at its South Portland campus, the former Thornton Heights elementary school. Work is anticipated to begin during 2008.

As an attorney with Preti Flaherty, Sharon practices with the firm’s Environmental Law Group. She advises developers, lenders, and other clients seeking to assess and limit potential environmental liabilities in the purchase and sale of real property and businesses. She also counsels industrial and manufacturing clients on environmental compliance issues and has represented clients before State and Federal environmental and regulatory agencies. She is a former Regional Counsel with the U.S. Environmental Protection Agency.

After practicing in Seattle, Washington and Cleveland, Ohio, Sharon relocated to Maine in 1996. She lives in South Portland with husband, Perry Newman, and daughters, Hallie and Lennie. In 1978, she graduated from Barnard College, Columbia University, magna cum laude, with honors in psychology, and in 1984 received her law degree from Stanford Law School.

Race and Color Class Action Settlement with Morgan Stanley Announced
Today, the law firms of Lieff Cabraser Heimann & Bernstein, LLP, Outten & Golden LLP, and Altshuler Berzon LLP announced a settlement in principle with Morgan Stanley & Co. Incorporated f/k/a Morgan Stanley DW Inc., on behalf of approximately 1,200 African-American and Latino Financial Advisors and Registered Financial Advisor Trainees employed at Morgan Stanley at any time since October 12, 2002. This lawsuit challenged inequities in opportunities for African Americans and Latinos in the distribution of accounts and other business opportunities.

The parties entered into a five year settlement agreement that is subject to Court approval. It includes comprehensive injunctive relief regarding recruiting and hiring, account distribution policies, partnership arrangements, promotions, retention, diversity training, and complaint processing, among other things. The settlement also provides that an independent Diversity Monitor will be appointed to effectuate the terms of the Agreement. In addition, the settlement establishes a significant class monetary settlement fund. A Special Master is expected to determine the allocation of monies among the class. The terms of the settlement are presently confidential and will be revealed in a public filing with Federal Judge Thelton Henderson of San Francisco in the near future

. "This settlement commits Morgan Stanley to implementing policies and programs to ensure that African American and Latino Financial Advisors are able to compete and thrive on the same terms as their white colleagues. We commend Morgan Stanley for its decision to adopt the positive and innovative changes in the agreement," said Kelly M. Dermody, a partner at Lieff Cabraser Heimann & Bernstein, LLP, Co-Lead Class Counsel.

Co-Lead Class Counsel Adam Klein stated, "By agreeing to this ground breaking agreement, Morgan Stanley has demonstrated its strong commitment to being a market leader on Wall Street."

Co-Lead Class Counsel Jim Finberg stated, "The injunctive relief in this agreement will be a win/win, because it will enhance employment opportunities for African Americans and Latinos, while enabling Morgan Stanley to benefit from the skills and talents of a diverse FA workforce."

In a statement issued by Morgan Stanley, the Firm stated: "Morgan Stanley is committed to the success of our Financial Advisors, regardless of race or color, and we view this settlement as a positive step forward."

The settlement was the result of intensive negotiations supervised by experienced neutral mediator Hunter Hughes, Esq., of Atlanta, Georgia.

Hughes & Luce Ranked Among the Top Five Outsourcing Legal Advisors by Brown-Wilson Group
The Black Book of Outsourcing survey, conducted by Brown-Wilson Group, recently ranked Hughes & Luce law firm among the nation’s top five law firms handling outsourcing transactions.

First published in 2005, The Black Book is the only annual, independent ranking of 300 outsourcing advisors and 4,500 vendors. The results and rankings are based on surveys of 20,000 outsourcing users and clients that measure 26 areas of service and satisfaction, including:

Chris Gilbert, Partner

Mr. Gilbert specializes in complex commercial litigation, bankruptcy, and intellectual property matters. He received his law degree from the University of North Carolina and both his Masters and Bachelors degrees from Midwestern State University.

David Henry, Partner

Mr. Henry’s practice centers on patent prosecution and complex commercial litigation. He also serves as a Lieutenant Colonel in the United States Air Force Auxiliary. He received his law degree from Baylor University School of Law and his Bachelors degree with honors from Baylor University.
