CHRISTOPHER JONES JOINS WHITEFORD, TAYLOR & PRESTON
Whiteford, Taylor & Preston (WTP) is pleased to welcome Christopher A. Jones, Esq. as Partner in the firm's Bankruptcy section. Stationed in the firm's new Falls Church office, Jones is formerly of LeClair Ryan in Richmond, Virginia, and has a wealth of experience in handling insolvency matters for both debtors and creditors, as well as handling complex commercial litigation.

"Chris' sophisticated understanding of insolvency matters and his extensive experience representing debtors and serving as creditors' counsel make him a strong addition to our practice," explained Paul M. Nussbaum, chair of WTP's Bankruptcy section. "Virginia is a key market for us, and we're delighted to add someone of his stature and reputation in the Virginia bar."

With over a decade of legal experience, Jones advises secured lenders and creditors in litigation and insolvency matters in addition to representing reorganizing debtors. Most notably, he has experience handling large chapter 11 cases for Heilig-Meyers Company and Tultex Corporation. Named as a Rising Star by Virginia Super Lawyers, Jones has lectured for the Virginia Bar Association's Bankruptcy section and served as faculty for a Virginia Bankers' Bankruptcy Reform seminar. A 1996 graduate of the University of Richmond School of Law, he is admitted to the Virginia bar. Jones holds a B.A. in Political Science from Duke University.

WHITEFORD, TAYLOR & PRESTON EXPANDS INTO DELAWARE
Whiteford, Taylor & Preston LLP (WTP) is pleased to announce the opening of its Delaware office. The office, temporarily located at 1000 N. West Street, Wilmington, DE 19801, officially opened for business on August 1, 2007. The phone number is 302.295.4912. This major geographic expansion follows on the heels of the firm’s move into Northern Virginia earlier this year.

“This is an exciting move for us and our clients, whose needs are driving our growth into both Virginia and Delaware,” explained Albert Mezzanotte, Jr., the firm’s managing partner.

The first Wilmington-based lawyer to join the Delaware office is Margaret M. Manning, formerly of Buchanan Ingersoll & Rooney, who joins as Counsel in the Bankruptcy group.

Mezzanotte noted, “We have been pleased by the intense interest shown in the Delaware legal community in this move. We plan to grow the Wilmington office aggressively, particularly in the areas of bankruptcy, litigation, corporate and real estate.”

Meg Manning commented, “Whiteford has an excellent reputation, particularly for its strong Bankruptcy practice, which is well-known for its national scope and sophistication. It’s great to get in on the ground floor of this major expansion for the firm, and I’m looking forward to welcoming many new colleagues to the Wilmington office and practice over the next year.”

The firm is actively negotiating for sufficient permanent space in Wilmington to accommodate ten or more lawyers.

John D. Wendler Joins Lathrop & Gage as Of Counsel
Joel Voran, CEO of Lathrop & Gage L.C. announced today John D. Wendler has joined the St. Louis office as an of counsel in the toxic tort law group.

Wendler’s practice focuses on toxic tort, products liability, construction contracting, defect and casualty, other civil litigation, workers’ compensation defense for Missouri and Illinois, insurance coverage and contract law. Wendler has been a School of Engineering Asst. Professor and Visiting Lecturer, Construction Program, at the Southern Illinois University at Edwardsville since 1984.

Wendler received his undergraduate degree from Southern Illinois University in 1998 and his juris doctorate from St. Louis University School of Law in 1977. He has an “AV” rating with Martindale-Hubbell® and is currently a member of The Missouri Bar, Illinois State Bar Association, American Corporate Counsel Association, Illinois Association of Defense Counsel, Madison County Bar Association, St. Clair County Bar Association and the Bar Association of Metropolitan St. Louis. He was selected as “Leading Lawyer, Construction Law, Leading Lawyer Magazine in 2007.

Heller Ehrman Receives California Bar Association's Pro Bono Service Award
Heller Ehrman LLP has been selected by the State Bar of California as recipient of the 2007 President’s Pro Bono Service Award in the Distinguished Pro Bono Category. The award will be given at a special awards reception during the 2007 State Bar Annual Meeting on September 28.

Established in 1983 by the State Bar Board of Governors, the President’s Pro Bono Service Awards recognize California attorneys who have provided or enabled the direct provision of legal services to poor persons or to organizations whose primary purpose is to provide legal services to the poor without expectation of compensation from the client.

Heller Ehrman was selected to receive the award for its work in the case of Kincaid, et al. v. City of Fresno, a civil rights action brought in the U.S. District Court for the Eastern District of California, which opposes the City of Fresno’s practice of conducting “clean-up” practices in areas where homeless people live. The case challenges Fresno's practice of "cleaning up" by destroying property of homeless people who were not present during clean up or were unable to move their belongings. City attorneys claimed the destruction was unavoidable because the homeless "abandoned" their property, leaving it unattended and that health hazards prevented workers from preserving it.

In November 2006, the District Court granted a preliminary injunction, prohibiting the City of Fresno from seizing and immediately destroying property of homeless people, pending a final judgment. The judge found that the city's practices violated the Fourth and Fourteenth Amendments of the U.S. Constitution, the California Constitution and California statutory law. On July 30, 2007, the Court certified the case as a class action on behalf of all homeless people in Fresno whose property was destroyed by the defendants. A trial of the case is scheduled for May, 2008.

“The result in the Kincaid case raises important constitutional issues regarding the property and rights of homeless people,” says Kit A. Pierson, Chair of Heller Ehrman’s Community Services Committee. “The firm is grateful for the dedication our attorneys and staff have brought to this important matter, and we are honored to be recognized by the California Bar Association for these efforts.”

Robinson & Cole Insurance Group Attorneys Help Secure Major Victory in Hurricane Katrina Property Damage Litigation
The principal issue in In re Katrina Canal Breaches Litigation was whether the "flood" exclusion in standard homeowners' policies barred coverage for damage caused by water released by breaches in certain levees surrounding New Orleans. The appellate court unanimously overturned a federal district court ruling that found that the term "flood" was ambiguous and should be limited to only inundations resulting from "natural" causes. The district court's ruling would have required most carriers to pay for flood damage arising from Hurricane Katrina if it were determined that negligence in the design, construction or maintenance of the levees was the cause of the flooding. Media sources have reported that, if the district court's decision had been upheld, it could have required the insurance industry to pay over $1 billion for flood damage that they did not intend to cover.
