ACC "Focus" Newsletter: Data Thefts Require A Comprehensive Response
Columbus associate Brian Laliberte authored an article, ""Data Thefts Require A Comprehensive Response,"" for the Association of Corporate Counsel's Central Ohio Chapter which was published in the third quarter edition of its ""Focus"" newsletter.

According to Laliberte, ""When data thefts occur, businesses must be prepared to respond quickly and comprehensively. Taking any of the following steps may help mitigate the impact on your business.""

Laliberte goes on to detail those steps which include: Notify law enforcement; engage a forensic computer expert; prepare for regulatory investigations; brace for consumer claims; have a public relations strategy; and be proactive about IT security.

Laliberte concludes with this advice: ""Although it may not be possible to prevent data theft—no matter how tight your information security is—a proactive approach to data security and a comprehensive response after it occurs may mitigate its impact on your business.

HUP&K Panelists for Continuity of Government & Small Business Conference
Patricia McHugh Lambert, Leslie R. Stellman and M. Chad Malkus of HUP&K, will be conducting a panel discussion as part of a two-day conference at the Hyatt Chesapeake Resort in Cambridge on October 2nd and 3rd.

Below are details about the Continuity of Government & Small Business Conference, and a link to the conference website. The panel led by Pat and Les on October 3rd will focus on the legal aspects of continuity and disaster recovery. Multiple areas of law have a direct role in continuity of government and disaster preparedness for businesses.

HUP&K represents many of the target audiences and industries for the conference, such as State and Local Government officials, School Boards, Health Industry Professionals, Emergency Managers, Large and Small Business Owners, and Business & Government IT Professionals.

Continuity of Government & Small Business Conference Natural disasters, power outages, computer failures and terrorist threats are each challenges facing government and business leaders every day. Individually, any one of these events can be devastating to an organization, but if they occur together the results are many times catastrophic.

Hurricanes Isabel and Katrina demonstrated how the lack of proactive planning for a natural disaster can cripple an organization’s ability to account for their personnel, provide service to their customers and continue operating from other locations.

The East Coast Power Outages showed us that a single point of failure can interrupt or potentially destroy an organization’s ability to perform basic business functions.

Experts are projecting the Avian Flu Pandemic to cause an employee absence rate of 80%, which will directly affect how local and regional communities interact and conduct normal business.

As a government or business leader, you are cordially invited to attend a conference on Continuity of Government, Disaster Recovery and Business Continuity. This 2 day conference is being held on the Eastern Shore of Maryland at the Hyatt Regency Chesapeake Bay Resort. Attendees will receive information and guidance from industry experts, such as former Department of Homeland Security Inspector General Clark Ervin, on the following topics:

1. Threats/Vulnerabilities to the public and private sector
2. Industry standard practices (planning and execution)
3. Legal aspects of Continuity and Disaster Recovery
4. Avian Flu Pandemic
5. Emergency Preparedness Grants
