Governor Appoints Thompson Hine Partner to Ohio Tax Credit Authority
Alan Berliner, a partner at Thompson Hine LLP, has been appointed by Ohio Governor Ted Strickland to serve as a member of the Ohio Tax Credit Authority, which is charged with the duty of reviewing and approving tax credits for job creation and retention projects throughout the state. The authority consists of five members appointed by the governor, the speaker of the Ohio House of Representatives and the president of the Ohio Senate.

“I am honored to be selected to serve as part of the Ohio Tax Credit Authority,” says Berliner. “The Tax Credit Authority is an important driver of our state’s economic and job growth, and to have the opportunity to participate as a member of this group is extremely gratifying. I look forward to serving the governor and the needs of the citizens of Ohio.”

Berliner leads Thompson Hine’s Insurance Regulation practice. He has extensive experience with the insurance industry and focuses his practice in a variety of areas relevant to the industry, including working with insurance companies, trade associations, insurance agencies and financial institutions on corporate, regulatory, government relations and litigation matters.

Berliner previously served in several positions at the Ohio Department of Insurance, including interim director, assistant director and chief legal counsel.

Roetzel & Andress' Orlando Office Relocates
The law firm of Roetzel & Andress is pleased to announce the relocation of its Orlando, Florida, office.

Barbara-Ann C. Gustaferro Joins Roetzel & Andress
The law firm of Roetzel & Andress is pleased to announce Barbara-Ann C. Gustaferro has joined the Cleveland office as Of Counsel in the Labor & Employment Practice Group.

Ms. Gustaferro focuses her practice in the area of employee benefits with a concentration on executive compensation arrangements and retirement plans. She works with public and private companies on the development and implementation of executive employment agreements, stock and stock-based incentive plans and similar matters. Ms. Gustaferro has a wealth of experience in both qualified retirement plans and securities. In addition, her general corporate and business services experience includes mergers and acquisitions, contract negotiation and preparation, corporate governance, and insider trading policies.

She earned her juris doctor ate degree, cum laude, from Harvard Law School and her B.A. from the University of Notre Dame, graduating with highest honors.

Stephen G. Harvey of Pepper Hamilton to Co-Moderate Program on Subprime Lending at ABA Annual Meeting in San Francisco
Stephen G. Harvey, a partner with Pepper Hamilton LLP, will co-moderate a program focusing on subprime lending at the American Bar Association’s Annual Meeting in San Francisco, Ca., on Sunday, August 12, 2007. The program is entitled “Subprime Shift – Crisis or Market Correction: Discussion of Legal, Regulatory and Policy Implications.”

Mr. Harvey will moderate the program with Juliana Schulte O’Reilly, Deputy General Counsel of E*Trade Bank. The speakers for the program are Richard DeMong, Ph.D., of the University of Virginia; Dale W. Lum of Sidley & Austin LLP; Martin Eakes, Chief Executive Officer of Self-Help Credit Union and Center for Responsible Lending; Sara Kelsey, General Counsel of the Federal Deposit Insurance Corporation; and Thomas James, Senior Assistant Attorney General in the Office of the Illinois Attorney General.

The program is being presented by the American Bar Association, Section of Business, Committee on Banking Law, and co-sponsored by the Committees on Consumer Financial Services, Developments in Business Financing, and Commercial Financial Services. Mr. Harvey serves as chair of the Subcommittee on Consumer Litigation and Arbitration for the Committee on Consumer Financial Services. He concentrates his practice in financial services litigation.

Five DC Attorneys from Ober|Kaler Selected for Best Lawyers
Five Ober|Kaler attorneys have been selected for inclusion in the 2008 edition of The Best Lawyers in America for the Washington, DC area.

Thomas K. Hyatt, Patrick K. O'Hare, and Martha P. Rogers were selected for the Health Care Law category. Mr. Hyatt and Mr. O'Hare were also recognized in the Non-Profit/Charities Law section, while Ms. Rogers was additionally noted in the White-Collar Criminal Defense category.

Carlyle C. Ring, Jr. was recognized for his work in Information Technology Law, and John J. Miles was selected for his work in Antitrust Law.

Fewer than 3% of all attorneys in the country are selected for inclusion in The Best Lawyers in America. Inclusion in the publication is the culmination of an extensive nationwide survey based on more than 1.5 million peer-review evaluations. The publication is regarded as the "definitive guide to legal excellence in the United States."

David E. Cassidy Named Among New Jersey Super Lawyers Rising Stars

He regularly counsels companies regarding all facets of employment law and drafts employment policies and procedures to ensure employer compliance with federal and state laws.

Cassidy was featured in New Jersey Monthly for being named among the 2006 Super Lawyers Rising Stars in labor and employment law.

Cassidy is admitted to the Bars of New Jersey, New York, the U.S. District Court for the District of New Jersey and the Southern and Eastern Districts of New York, and the U.S. Court of Appeals for the Second and Third Circuits. King & Spalding Prevails on Behalf of Mortgage Insurer in Denial of Nationwide Class Action
King & Spalding, a leading international law firm, earned a significant victory for its client Triad Guaranty Insurance Corporation in a long-running litigation case. After more than three years of litigation, the United States District Court for the Western District of Kentucky dismissed all Fair Credit Reporting Act (FCRA) class action claims against Triad. The court also denied the plaintiff’s motion to certify a nationwide class and dismissed the plaintiff’s individual willfulness and punitive damage claims, leaving only plaintiff’s nominal claim for actual damages.

In addition to the class action against Triad, plaintiff’s counsel also had brought nationwide class actions in Texas, Illinois, California, Florida, North Carolina and Pennsylvania against each of the other companies which provide mortgage insurance in the United States. Last year, five of those companies settled their lawsuits on a class-wide basis. Triad refused plaintiff’s settlement demands and determined to fight the claims to a conclusion. This is the second time that King & Spalding has defeated a nationwide class action against Triad where the other defendant companies settled on a class-wide basis.

Triad Guaranty Insurance Corporation, a wholly owned subsidiary of Triad Guaranty Inc., offers private mortgage insurance to residential mortgage lenders nationwide.

The King & Spalding defense team representing Triad Guaranty Insurance Corporation was led by business litigation partner Nolan C. Leake.

Other members of King & Spalding’s Atlanta business litigation team representing Triad in this victory are the following associates: Jennifer R. Vala, Lisa Wolgast, Martha S. Henley, Scott Zweigel and Akua Coppock.
