Hunton & Williams assists Iranian pro-democracy activist in obtaining H-1B employment authorization and U.S. permanent residence
Washington Associate Suzan Kern assisted a leading Iranian student dissident and pro-democracy activist who had been imprisoned in Iran for his political activities. The client was in the US meeting with academics, scholars, and members of Congress to build support for a constitutional referendum in Iran. First, Suzan helped him to extend his business visitor status to one year. Then, when he was offered a job by an Iran-focused US human rights organization, she assisted in obtaining H-1B work-authorized status for him. Ultimately, when he expressed his desire to remain in the US long-term to continue his pro-democracy political work legally and safely, she helped him file a "self-petition" for US permanent residence (a "green card") as an "alien of extraordinary ability" in political science. His green-card application was approved in June.

KEEVICAN WEISS BAUERLE & HIRSCH ADDS THREE ATTORNEYS
Jared N. Leland, Richard T. Watling and Andrew C. Lake have joined Keevican Weiss Bauerle & Hirsch LLC in the firm's Pittsburgh's office. Lake is a partner in the Intellectual Property Practice Group and Leland and Watling are associates in the Corporate Practice Group.

Lake's practice concentrates in intellectual property protection in the US and in foreign countries. His experience includes the preparation, prosecution and litigation of patents, trademarks, copy rights and trade secrets in a wide variety of mechanical, electrical, electronic and computer related arts; infringement and validity studies, licensing, design around strategies, due diligence studies. He received his B.A. from College of Wooster, his M.B.A. from John Carroll University, M.S. in Electrical Engineering from Cleveland State University and his J.D. degree from The University of Akron.

Leland's practice concentrates in mergers and acquisitions, corporate finance and securities. Before joining the firm, he was spokesman and legal counsel for a nonprofit law firm specializing in constitutional, federal and state law pertaining to religious exercise and expression. He received his B.A. degree from Boston College and his J.D. degree from The Catholic University of America Columbia School of Law.

Watling's practice concentrates in real estate, with an emphasis on land use, land development, zoning and environmental rights. He received his B.A. magna cum laude from the University of California and his J.D. degree from the UCLA School of Law.

Briggs and Morgan Attorneys Contribute to Newest Eighth Circuit Appellate Practice Manual
Appellate attorneys Eric J. Magnuson and Diane B. Bratvold, shareholders in the firm of Briggs and Morgan, Professional Association, made significant contributions to the most recent edition of the Eighth Circuit Appellate Practice Manual . Both attorneys write and edit various federal and state appellate treatises.

Published by Minnesota Continuing Legal Education , the manual’s fourth edition was released in July 2007. It includes the contributions of experienced practitioners throughout the 8th Circuit. Magnuson (founding president of the 8th Circuit Bar Association and fellow and past president of the American Academy of Appellate Lawyers) served as co-editor of the work and authored two chapters, “Professional Responsibility and the Appellate Advocate and Effect of Appeal” and “Stays and Supersedeas.”

Bratvold (a board member of the 8th Circuit Bar Association, fellow in the American Academy of Appellate Lawyers and chair of the Minnesota State Bar Association Appellate Practice Section) authored the chapter entitled, “Post-Judgment Proceedings,” which discusses rehearing procedures in the Court of Appeals, among other topics.

Judge: Storm Water agency violated law when raising fees
A judge said yesterday that the Storm Water Management Authority (SWMA) violated a statutory requirement when it attempted to impose a 140 percent increase in fees in 2005.

Circuit Court Judge Tom King Jr. ruled that SWMA did not hold required public hearings prior to adopting its fee-increase proposal, therefore impacting "the Plaintiffs' and the general public's right and ability to participate in the decision-making process."

Among those that filed the lawsuit against SWMA last year included the Business Alliance for Responsible Development, the Greater Birmingham Association of Home Builders, Sen. E.B. McClain and Bessemer Mayor Ed May.

A news release issued by the Business Alliance for Responsible Development (BARD) said that the 140 percent fee increase would mean area residents would pay an additional $2.9 million a year, or roughly $30 million over 10 years.

"Judge King's ruling today recognized that the Storm Water Management Authority failed to give the general public a meaningful opportunity to be heard prior to passing a fee increase of nearly $30 million over the next ten years," said Rob Fowler of Balch & Bingham LLP and attorney for the plaintiffs.

"We are pleased with this victory today, but we will continue to work to ensure that SWMA abides by the law and stays within the role carved out for it by the Alabama Legislature," he said.

Zhaleh McCullers, director of SWMA, said she was not able to comment on the ruling.

David Wolfsohn of Woodcock Washburn Moderates Trial Strategies Panel at ABA Annual Meeting
David J. Wolfsohn, a partner with the intellectual property law firm Woodcock Washburn LLP, moderated a panel session at the annual American Bar Association meeting in San Francisco on August 11. The topic, “An Argument by Any Other Name: How to ‘Argue’ Permissibly in Opening Statements” covered strategies by top trial attorneys for opening a trial.

Morris, Manning & Martin Partners to Speak on Doing Business in China
Attorneys Jeff Schulte and Tim Xia will participate in a panel this month titled “Driving Revenues from the China Market: Opportunities and Challenges.” AeA, or the American Electronic Association, will host the seminar, which will address some of the challenges and opportunities faced by US companies interested in doing business in China.

Xia is a partner in Morris Manning & Martin, LLP’s Intellectual Property Group and leads the firm’s international practice and intellectual property practice. He represents several China-based companies, including General Protecht Group, which manufactures electrical components. He was instrumental in attracting one of the company’s plants to Barnesville, Georgia, and was part of the litigation team that recently won a high-profile patent infringement case for the company.

Schulte is a senior partner in the firm’s corporate practice and leads the firm’s securities practice. He is also the lead counsel for General Protecht Group’s corporate affairs. Schulte will be a moderator in the panel. Other speakers include Greg Shea, President & Managing Director of USITO, AeA’s office in China; Todd Cutler, Sr. Manager for Agilent Technologies; David Markovich, Sr. VP, Asia Pacific, for Telelogic’s Shanghai Office; and John Ho of Colliers International, Multimodal Services Group.

Opportunities for high tech companies to expand into the Asian-Pacific market are growing. Between 2000 and 2006, US tech products exported to China more than tripled from $4.6 billion to $14.1 billion. This seminar will offer practical insights into developing new business markets.

The agenda includes topics such as:
