Wendy Madden, a partner in the Birmingham office, has been invited to be the featured Speaker in the Sixth Annual Latin American Youth Conference "Pursuing the American Dream" sponsored by Nasa, and project Mi Futuro from Stillman College in Tuscaloosa and Oakwood College in Huntsville. There are over 150 youths confirmed as attendees of the conference which is designed to motivate Alabama's Hispanic high-school students to continue their education and inspire their interest in attending college.

A judge said yesterday that the Storm Water Management Authority (SWMA) violated a statutory requirement when it attempted to impose a 140 percent increase in fees in 2005.

Circuit Court Judge Tom King Jr. ruled that SWMA did not hold required public hearings prior to adopting its fee-increase proposal, therefore impacting "the Plaintiffs' and the general public's right and ability to participate in the decision-making process."

Among those that filed the lawsuit against SWMA last year included the Business Alliance for Responsible Development, the Greater Birmingham Association of Home Builders, Sen. E.B. McClain and Bessemer Mayor Ed May.

A news release issued by the Business Alliance for Responsible Development (BARD) said that the 140 percent fee increase would mean area residents would pay an additional $2.9 million a year, or roughly $30 million over 10 years.

"Judge King's ruling today recognized that the Storm Water Management Authority failed to give the general public a meaningful opportunity to be heard prior to passing a fee increase of nearly $30 million over the next ten years," said Rob Fowler of Balch & Bingham LLP and attorney for the plaintiffs.

"We are pleased with this victory today, but we will continue to work to ensure that SWMA abides by the law and stays within the role carved out for it by the Alabama Legislature," he said.

Zhaleh McCullers, director of SWMA, said she was not able to comment on the ruling.
