Matheson Ormsby Prentice advised on the joint venture between An Post and Fortis Bank SA/NA for the provision of retail banking services through the An Post branch network throughout Ireland. This transaction is evidence of a growing trend among postal operators to leverage their strong distribution networks by providing a focused financial services offering. In this case, An Post, the Irish national postal operator, has partnered with Fortis Bank SA/NV, which has significant experience in partnerships generally and with considerable success in postal banking. The move is supported by the Irish Government, An Post's shareholder, which sees it as, among other things, sustaining a viable post office network.

IRS's 2007 Cost-of-Living Adjustments Available
The Internal Revenue Service ("IRS") has announced its annual cost-of-living adjustments for the 2007 tax year. These IRS adjustments affect the amount of benefits payable and the amount of contributions allocable under retirement plans, including 401(k) plans, defined benefit pension plans, employee stock ownership plans ("ESOPs"), and simplified employee pensions ("SEPs"). The chart will be updated again when new limits from the Social Security Administration and Pension benefit Guaranty Corporation are announced.

Foster granted class action status for landmark Tyson Foods wage-scheme case
Judge Curtis Collier of the U.S. District Court, Chattanooga, Tennessee, has granted class action status for Attorney Howard W. Foster’s landmark case Trollinger v. Tyson Foods, Inc., which seeks back pay for U.S. workers. The case alleges that Tyson, reportedly the world’s largest processor and marketer of poultry, has employed many illegal immigrants at eight of its chicken processing plants in order to depress wage levels. The decision signifies that Johnson & Bell is now class counsel for all the legally employed hourly paid workers at these plants. Foster will serve as co-lead counsel for the class and a trial date will be set by Judge Collier in January 2007.

Foster is one of the leading attorneys in the nation for using RICO as a tool to counter the hiring of illegal immigrants, since 1998 bringing class-action lawsuits against employers who allegedly engage in the practice to reduce labor costs. His first such case, Mendoza v. Zirkle (E.D. Wash.), was settled in January 2006 for $1.3 million, which is being distributed to legal workers of that company to compensate them for wage depression.

According to Foster, the Tyson decision means, “legal American workers can finally do something about the employment of illegal immigrants. They can sue for wage depression, which is what civil RICO was intended for. We are delighted with this decision and believe it will be upheld if Tyson seeks review in the Court of Appeals, where we have already won.
