Maureen Witt Named Outstanding Woman In Business
Holland & Hart partner Maureen Witt was named the Outstanding Woman in Business in the Professional category by the Denver Business Journal.

Witt is a trial attorney in the firm's Denver Tech Center office. She has represented plaintiffs and defendants in cutting-edge, high-stakes complex litigation locally and nationally. She has handled significant cases of first impression and precedent-setting trials and appeals. Within Holland & Hart she has held several leadership roles, which include serving as one of the first female managing partners of a large U.S. law firm. She also has dedicated time to improving the legal profession as a whole. She helped increase juror's roles through the Colorado Jury Reform Committee, and she regularly teaches and mentors young lawyers through the National Institute of Trial Advocacy.

"Maureen exemplifies an outstanding lawyer, business woman, community leader, and parent," said Paul Phillips, chairman of Holland & Hart. "She is devoted to helping and serving others through her legal practice and civic activities and is truly deserving of this honor."

In 2006, the Denver Business Journal named Holland & Hart partner Betty Arkell as the Outstanding Woman in Business in the same category. The publication's annual event recognizes Denver's leading business women in a variety of industries.

Aaron Successfully Defends Mortgage Company in Fraud Claims
Blackwell Sanders Partner Steve Aaron, with assistance from Associate David Walsh, received a directed verdict in Jackson County Missouri Court from Judge J.D. Williamson on July 19 in a mortgage fraud case in favor of client Clarion Mortgage Capital, Inc. Unlike most mortgage fraud cases, this case involved an individual claiming that she was defrauded by the mortgage company and others (the reverse is alleged in most mortgage fraud cases).

The plaintiff entered into a contract with K.C. Builders for home remodeling. To pay for the remodeling, the plaintiff sought a home equity loan from Clarion, allowing her to consolidate debts, receive cash back and pay for the remodeling. The plaintiff was approved for and received a 30-year fixed interest loan with a rate of 5.625%. K.C. Builders completed the remodeling. Afterwards, the plaintiff complained that the remodeling was done poorly. The plaintiff sued the remodeling company, the mortgage loan company and the appraisers, claiming a conspiracy between K.C. Builders to inflate the cost of the remodeling, Marie Ann Gunja Appraisers to inflate the value of the home, allowing for a larger remodeling loan, and increased closing fees for Clarion.

Senniger Powers Announces Key Victory for MEMC Electronic Materials, Inc.
Senniger Powers today announced a key victory for MEMC Electronic Materials, Inc., in an antitrust lawsuit filed by Sumitomo Mitsubishi Silicon Corporation (SUMCO) and SUMCO USA Corporation. The suit involved an attempted monopolization claim under § 2 of the Sherman Act. SUMCO sought $137 million in actual damages, treble damages, and attorneys' fees. Senniger Powers' Partners David Harlan and Robert Evans, Jr., and Associates Marc Vander Tuig and Michael Hartley were involved in the case and were instrumental to its successful outcome.

SUMCO alleged that MEMC's procurement and enforcement of U.S. Patent No. 5,919,302 was improper and anticompetitive. MEMC's patent covers "perfect silicon" wafers-silicon wafers that are free of yield-reducing agglomerated intrinsic point defects. This proprietary MEMC technology is becoming increasingly important as integrated circuit fabricators move to advanced technology nodes. MEMC originally filed suit against SUMCO in 2001 for supplying infringing silicon wafers to the United States from Japan. SUMCO claimed that MEMC's patent infringement lawsuit against SUMCO caused the closure of SUMCO's Salem, Oregon plants.

The United States District Court for the Northern District of California granted summary judgment against SUMCO's attempted monopolization claim. The Court found MEMC was immune from liability under the Noerr-Pennington doctrine, rejecting SUMCO's numerous Walker Process and sham litigation allegations.

"We are gratified that the Court recognized that MEMC had a reasonable basis for its patent infringement lawsuit against SUMCO," Partner David Harlan said.

Senniger Powers has represented MEMC, a world leader in the supply of wafers to semiconductor device manufacturers, for 18 years. In addition to the antitrust ruling, the firm has won favorable rulings in recent years for MEMC with the European Patent Office and in the United States Court of Appeals for the Federal Circuit.

RQ&N Announces Changes in Firm Management
John A. Adams has been elected Managing Director of the Firm, succeeding James S. Jardine, who has served in that position since 1990. Mr. Jardine has been elected as President of the Firm, succeeding Clark P. Giles. Mr. Jardine stated, "John Adams has a wonderful history of leadership, in the Bar and in our community, and our Firm is very pleased that John is willing to assume this important responsibility of leadership."

Mr. Adams is a Shareholder in the Firm’s litigation section. His practice focuses on prosecuting and defending commercial litigation matters, particularly complex business disputes. Mr. Adams is a former President of the Utah State Bar (2002-2003). He maintains an “AV” rating with Martindale-Hubbell, the highest rating awarded to attorneys for professional competence and ethics. He has been included on the list of The Best Lawyers in America 2007 in Commercial Litigation and has been voted by his peers throughout the state as one of Utah’s Legal Elite in the category of Business Litigation. Mr. Adams graduated from the J. Reuben Clark Law School at Brigham Young University in 1981 and was Editor of the BYU Law Review. He was a law clerk to the Honorable George E. MacKinnon, United States Court of Appeals, D.C. Circuit.

Annette W. Jarvis has been elected to the Firm's Executive Committee. Ms. Jarvis is a Shareholder at the Firm and for the last 5 years has served as the chair of RQ&N’s Bankruptcy Section. She was the recipient of the 2005 Dorathy Merrill Brothers Award for the Advancement of Women in the Legal Profession, and will receive the 2007 Pathfinder Award from the Salt Lake Chamber of Commerce at their annual Athena Award Luncheon in November. Ms. Jarvis maintains an “AV” rating with Martindale-Hubbell, which is the highest rating awarded to attorneys for professional competence and ethics. Noted Product Liability Specialist Anthony J. Laura Joins Patton Boggs LLP: Addition Enhances New Jersey Mass Tort Litigation Practice
Patton Boggs LLP welcomes Anthony J. Laura to the firm as a partner in the New Jersey office. Mr. Laura, a past Chair of the New Jersey State Bar Association’s Product Liability and Toxic Tort Section, represents pharmaceutical companies and medical device manufacturers in product liability matters and in complex commercial litigation. In addition, he also advises employers across the spectrum of employee relations matters, including discrimination defense and wrongful discharge claims, as well as on restrictive covenants and their enforcement. His experience in the financial services industry includes representing some of the nation’s largest banks in commercial and class action litigation.

Before joining Patton Boggs, Mr. Laura was partner at a top-15 international law firm counseling a number of the world’s leading companies in complex litigation and other high-stakes disputes. He formerly served as head of the firm’s New Jersey Trial Practice Group.

Two Leading Intellectual Property Patent Litigators Join Patton Boggs LLP
Patton Boggs LLP continues to add top talent to its growing intellectual property practice, hiring two new partners in the firm’s Northern Virginia office, Mark R. Shanks and Toni-Junell Herbert. Mr. Shanks and Ms. Herbert were founding partners of the IP firm Shanks & Herbert, where they provided counsel to clients on intellectual property and patent litigation, auditing and due diligence, licensing and technology transfer, and corporate issues related to pharmaceutical drug development.

“We are pleased that Toni and Mark have joined our expanding IP group,” noted Scott Chambers, Chair of the firm’s Intellectual Property department. “I've had the pleasure of working closely with them in the past; their combined experience handling a broad range of complex matters compliments our present expertise and enhances our ability to more effectively serve our clients.”

Ms. Herbert will assist clients in identifying and developing intellectual property (IP) protection strategies, overseeing the preparation and prosecution of patent applications before the U.S. Patent and Trademark Office (USPTO), and serving as lead counsel in Interference Proceedings and trial counsel in patent infringement actions. Her litigation background has provided her with extensive experience for advising clients during all phases of the discovery process, including drafting/filing and responding to document requests and interrogatories, preparing and filing discovery motions, deposing witnesses, defending witnesses, and selecting, deposing, and preparing experts.

Before practicing law, Ms. Herbert worked in the fields of biochemistry and physics, receiving a B.A. in Chemistry and Biochemistry from the University of Colorado at Boulder in 1981. She conducted post graduate biochemical research studying cellular protein mechanisms as the Senior Research Technician at Massachusetts General Hospital/Harvard, participated in the development of diagnostic histochemical profiles for breast cancer at New England Medical Center/Tufts, and carried out experiments in high-energy physics at the University of Colorado Cyclotron. She attended the University of Baltimore School of Law, earning a J.D. in 1990, and interned/clerked for the Hon. Phillip Baldwin at the U.S. Court of Appeals for the Federal Circuit in 1989.

Mr. Shanks’ practice focuses on representing parties involved in IP litigation, including the representation of branded pharmaceutical manufacturers in patent infringement actions brought against generic drug-makers. His work in this area involves case management and strategy development, expert preparation and analysis of expert theories and reports, supervision of discovery request and response preparation, drafting of discovery and dispositive motions, deposition defense, and settlement negotiations. In addition, Mr. Shanks counsels clients on IP matters as they affect mergers and acquisitions and other commercial and technology-related transactions, including due diligence and contract drafting and review.

After co-founding Shanks & Herbert, he was later a partner at one of the world’s 15 largest full-service law firms, while earlier in his career he served as an associate at a leading IP law firm and patent counsel at a prominent Fortune 500 diversified technology corporation. He has represented domestic and international clients in nearly every aspect of patent acquisition and enforcement before the U.S. Patent and Trademark Office (USPTO) and numerous U.S. courts.

Mr. Shanks graduated with a J.D. from the University of Iowa College of Law, with distinction, in 1987 and earned a B.S. from Iowa State University in Chemical Engineering in 1985.

Miller Johnson Welcomes New Attorney to Employment and Labor Section
A local employment law attorney has joined Miller Johnson, announced Managing Member Jeffrey S. Ammon. Gregory P. Ripple joins the employment and labor section as an Associate.

Mr. Ripple brings several years of experience with labor and employment matters. He will continue to counsel and assist clients with issues such as employment discrimination, workplace harassment and wrongful discharge. Mr. Ripple has defended employers in federal court on a wide variety of labor and employment issues. He has formulated employee handbooks and personnel policies in addition to conducting management and employee training. Mr. Ripple has also worked with traditional labor issues including union-management relations. He previously practiced at Barnes and Thornburg in South Bend, Indiana and Grand Rapids.

Mr. Ripple earned his bachelor’s degree, magna cum laude, from the University of Notre Dame and his Juris Doctorate, magna cum laude, from the University of Notre Dame Law School. He is admitted to practice in Michigan and Indiana.

Mr. Ripple received both M.A. and M.Phil. degrees from Fordham University. He taught history for several years at Fordham University and the State University of New York at Purchase
