Addie Ries and Matt Rhoad Win Pro Bono Case for Evicted Mother and Children
Smith Anderson lawyers Addie Ries and Matt Rhoad, serving as pro bono counsel, helped an evicted family recover damages from a landlord who had unlawfully removed and disposed of the family's belongings. In a case of first impression, a district court in Wake County ruled that the landlord improperly deprived the family--a mother and her two young children--of the full ten-day period allowed by North Carolina law to remove their personal items following an eviction. The court also ruled that the landlord would be liable for treble damages based upon the violation of state law. After the court's ruling, and facing a trial to determine the amount of damages for this wrongful action, the landlord agreed to pay damages through a settlement. As a result of the landlord's actions, the family was forced to do without such essential items as beds and clothing for the children, and will never recover other items like the family's pictures. "It was really a sad situation," said Ms. Ries. "At the time the matter was finally resolved, the children were still sleeping on air mattresses and had few clothes. The mother was very happy to collect damages to allow the family to start over."

Smith Anderson is very proud of the work of its lawyers, like Ms. Ries and Mr. Rhoad, who devote their time to pro bono legal work to help meet the needs of individuals and families who cannot afford legal representation. Ms. Ries and Mr. Rhoad accepted this case through the Wake County Volunteer Lawyers Program, which works with Legal Aid of North Carolina to find lawyers to represent the indigent. Firm lawyers participate in many other pro bono activities, including handling appeals on behalf of the North Carolina Guardian ad Litem Program and providing legal services to non-profit organizations that assist those in need.

$115M Loan Closes on Block 37 Office Building
Leading real estate industry trade publication, GlobeSt.com, reported on Schwartz Cooper's involvement in LaSalle Bank N.A.'s new Block 37 financing deal on November 17, 2006.

Schwartz Cooper assisted LaSalle Bank in closing loans totaling $115 million for the development of the 440,000-square-foot office tower planned for 22 W. Washington, St., part of the area known as Block 37. The loan includes a $106 million syndicated senior loan facility and a $9 mezzanine loan facility. Plans for the mixed-use building, of which 80 percent has already been leased to CBS2 and Morningstar Inc., include a 416-unit apartment building and 381-unit condominium tower .

Attorney Michael Kurtzon tells GlobeSt.com "that the LaSalle loan should guarantee that the project will be completed." He goes on to note, "This is the key piece of redevelopment on the block. This is the first piece of it and should really get things going. The office building is definitely going up.

Salans advises Asmita, an international residential real estate developer, on its joint venture with investment fund Charlemagne Capital
Multinational law firm Salans represented international residential real estate developer Asmita in connection with the financing and acquisition of the Asmita Gardens project through a 50-50 joint venture set up with British investment fund Charlemagne Capital. Capital Partners acted as the investment banker of Charlemagne Capital, through which it acquired a 50% stake in the project, estimated at 110 million euros at completion.

Asmita Gardens residential project addresses middle class consumers and is located in the Splaiul Unirii - Calea Vacaresti area. The project consists of seven apartment buildings 16 to 24 levels high, totalling 788 apartments. The project is expected to be finalized in two phases, with the first three apartment buildings slated to be delivered in September 2008 and the rest by spring 2009.

Commenting on the deal, Mr. James Anthony, Head of Asmita Romania stated: "We were very pleased with the legal expertise, hard work and dedication that Salans put forward, which facilitated the transaction to be carried out smoothly."

Capital Partners partner, Vlad Busila, who represented the investment banking boutique in this transaction, commented: "Salans' knowledge of the real estate market, international and local know-how and significant experience in real estate financing experience was invaluable in successfully finalizing this equity joint venture transaction."

Perry Zizzi, Salans senior attorney who acted as lead advisor to Asmita on the transaction remarked, "We were honored to help close the joint venture set up by Asmita with Charlemagne Capital.

Four New Associates Join Porzio, Bromberg & Newman
The law firm of Porzio, Bromberg & Newman has announced that Avana M. Desai, Joseph A. Manzo, Geoffrey Phelan, and Sarah M. Samp have become associated with the firm.

Avana M. Desai returns to the firm as a Fall Associate on the Mass Tort and Products Liability Practice Group. During the summer of 2005, Avana worked as a Summer Associate. she served as the associate editor of the Rutgers Computer and Technology Law Journal.

Joseph A. Manzo returns to the firm as a Fall Associate on the Land Use, Real Estate and Environmental Practice Group. During the summer of 2005, Joseph worked as a Summer Associate. He is also a Certified Public Accountant, and maintained a part-time CPA tax and accounting practice from 1982-2005.

Geoffrey Phelan returns to the firm as a Fall Associate on the Land Use, Real Estate and Environmental Practice Group. During the summer of 2005, Geoffrey worked as a Summer Associate.

The South Florida Legal Guide Lists Katz Barron Attorneys as Top Lawyers

Garza Honored for Diversity Work
Hughes & Luce partner Martin Garza received the Diversity Leadership Award from the Texas Diversity Council at its North Texas Diversity Best Practices & Awards Luncheon Oct. 30. In addition to his service in bar leadership, Garza was recognized in part for his role as a founder and member of the Dallas Diversity Task Force, which tracks and analyzes diversity efforts of area law firms.

“Martin’s ability and willingness to take a leadership role in diversity efforts both in the firm, as an active member of our Diversity Committee, and in the community, as a committed driver of the Dallas Diversity Task Force, benefits us all,” said Cindy Ohlenforst, chair of the Hughes & Luce Diversity Committee. “We are proud to see his work honored and privileged to be a part of that work.”

Garza has served as president of the Dallas Hispanic Bar Association and as an officer in the Hispanic National Bar Association and Mexican-American Bar Association of Texas. Most recently, he helped to establish the DHBA Scholarship Foundation, which provides scholarship and other opportunities for Latino students throughout Texas.

During his time as president of the DHBA, Garza placed particular emphasis on increasing minority participation in the legal profession and the bar associations through programs designed to involve more law students at Southern Methodist University Dedman School of Law in the DBA and DHBA. He was also instrumental in organizing a now-annual H&L event to bring minority students from SMU’s law school into the firm to talk with attorneys, members of the judiciary and city attorneys about opportunities in the Dallas legal market. The goal of this program is to encourage minority law students to stay and work in Dallas when they have completed their degrees.

“Martin is a powerful representative of the Dallas legal community whose service to and promotion of minorities and the opportunities provided them in our community is a credit to us all,” said David Luther, H&L Executive Committee member who also serves on the Diversity Committee.

The Texas Diversity Council works to foster a learning environment for organizations to increase their knowledge of diversity by providing them opportunities to learn from some of the top corporate leaders in the area of diversity. The Texas Council is currently made up of five Councils serving the greater metropolitan areas of Austin, Corpus Christi, Dallas, Houston and San Antonio.
