Kenneth G. Hutcheson Joins Troutman Sanders' Public Affairs Group LLC
Troutman Sanders Public Affairs Group LLC (“TSPAG”) is pleased to announce the addition of Kenneth G. Hutcheson as Senior Vice President - Virginia. TSPAG is a wholly-owned subsidiary of Troutman Sanders LLP. Hutcheson will manage strategic matters for clients, including legislative, regulatory and grassroots issues.

Prior to joining Troutman Sanders, Hutcheson worked in numerous political capacities, including campaign manager for former gubernatorial candidate Jerry Kilgore. He also served as an advisor to the reelection campaigns of Senator John Warner and President George W. Bush. In addition, Hutcheson has served in various political roles for past Virginia governors and numerous state legislators. Other political clients he has served in various capacities over the past 11 years have been Virginia Senate Majority Leader Walter Stosch, Senate Floor Leader Tommy Norment, Senate Courts of Justice Chairman Ken Stolle and Senate Finance Chairman John Chichester.

Immediately before joining Troutman Sanders, Hutcheson operated Old Dominion Strategies, LLC, where he managed political, government relations and grass roots strategic matters. His client list included major businesses, political candidates and associations.

ATTORNEYS MARTIN, THOMAS JOIN SHEEHAN PHINNEY BASS + GREEN'S MANCHESTER OFFICE
Sheehan Phinney Bass + Green is proud to announce that attorneys Karyl Roberts Martin and Brian D. Thomas have joined the firm as associates.

Joseph DiBrigida, president and managing director of Sheehan Phinney Bass + Green, said the firm is committed to expanding its employment presence through the addition of young, up-and-coming attorneys. “Brian Thomas and Karyl Martin are bright lights that we are pleased to add to the team,” DiBrigida said.

Before joining SPB+G, Martin was a law clerk for Associate Justice James E. Duggan of the New Hampshire Supreme Court and Judge Paul J. Barbadoro of the United States District Court for the District of New Hampshire. She also spent time at Sheehan Phinney as a part-time law clerk and worked as a summer associate for Conn, Kavanaugh, Rosenthal, Peisch and Ford LLP in Boston.

Martin is a member of the New Hampshire Bar Association and licensed to practice in the New Hampshire state courts and the United States District Court for the District of New Hampshire. She is also a member of the New Hampshire Women’s Bar Association and serves on the executive committee of the Daniel Webster-Batchelder American Inns of Court.

Thomas spent several years in the high-tech industry before attending law school. From 2001 to 2003, he was a regional account executive for SkillSoft Corporation, where he sold enterprise-wide e-learning solutions at the executive level. Previously, he was a regional sales manager for General Electric.

Thomas is a member of the New Hampshire and Massachusetts Bar Associations and licensed to practice in New Hampshire and Massachusetts state courts as well as the United States District Court for the District of New Hampshire.

TIMOTHY BUMANN JOINS SMITH, GAMBRELL & RUSSELL
Smith, Gambrell & Russell LLP (SGR) has added Timothy Bumann as a partner in its Litigation section. He is practicing in the area of Product Liability Defense. He has extensive experience in litigation, product liability, firearms cases and equine law.

He and his wife, Karan, live in Jasper County, where they raise Pinto and Paint show horses.

West Legal Works Publishes "Claim Construction In The Federal Circuit" - MGB Partner Contributing Author
MGB Partner, Brad Lyerla, is a contributing author to Claim Construction In The Federal Circuit, 2006 ed., published in November by West Legal Works.

The book is a useful reference that collects and analyzes every new opinion of the Federal Circuit dealing with patent claim construction. It is a resource for everyone who has to know or give an opinion on what a patent covers, from beginners to seasoned litigators, including federal judges, patent litigation attorneys, in-house counsel, and even patent prosecutors who prepare patent specifications and claims. This book presents the cases decided in the past year on each point, as well as earlier cases where relevant.

Claim Construction In The Federal Circuit has been written as a project of the Litigation Committee of the Intellectual Property Law Association of Chicago of which Mr. Lyerla is also chair. This is the inaugural edition of what will be an annual publication.

LeBoeuf Lamb Represents Telcordia in Landmark South Africa Ruling
Telcordia Technologies, the American software company, represented by international law firm LeBoeuf, Lamb, Greene & MacRae LLP, have won a landmark ruling against Telkom, the South African telecommunications giant, in the Supreme Court of Appeal (SCA) in South Africa. The ruling could see Telkom having to pay Telcordia in the region of $200 million; the precise sum will be decided by an international arbitrator in the coming months.

The ruling overturned a High Court judgment in favour of Telkom to the effect that the company did not have to abide by an international arbitration award in favour of Telcordia. The arbitrator had found that Telcordia could recover damages from Telkom following a breach of the agreement between them.

Greg Nott, head of the firm's Johannesburg office, represented Telcordia alongside Lennard Cowan Attorneys. He commented: "This ruling will help to enhance South Africa's global commercial status as the international business community recognises that it can rely on the judicial system here.

Hughes & Luce Secures Complete Trial Victory for Compex Technologies
Hughes & Luce achieved a complete defense verdict for Compex Technologies, L.L.C. after a two-week jury trial in which the plaintiff sought in excess of $40 million in damages from Compex and co-defendant Iomed, Inc.

The case revolved around claims of trade secret misappropriation, unfair competition, breach of contract, fraud, and conspiracy, all ultimately decided after a two week jury trial by the seven-member jury in the U.S. District Court for the Northern District of Texas. The jury returned its verdict on October 27, 2006 and United States District Judge Jorge A. Solis entered Judgment on the verdict on October 30, 2006.

“Our key objective for the case was to establish that the trade secrets claimed by the plaintiff were actually publicly available and were neither secret nor confidential.” Compex lead counsel and Hughes & Luce partner Paul R. Genender said. “Simply calling something confidential does not make it so.”

Plaintiff EEMSO, Inc. sought in excess of $10 million in actual damages, $30 million in exemplary damages plus attorneys fees against Compex and Iomed, which manufactured the competing medical device at issue in the case. The case against the two companies centered around allegations that Compex provided EEMSO’s confidential information to Iomed. The plaintiff also alleged that Iomed then used that allegedly confidential information to develop its own medical device using trade secrets belonging to the plaintiff. The defendants denied the existence of any trade secrets and that there was any misappropriation.

After considering a 53-page jury charge which contained 28 possible questions, the seven-member jury panel answered every liability question in favor of Compex and/or Iomed. The jury also determined that plaintiff suffered no damages from what the Court had determined was a breach of a confidentiality agreement by Compex.

“We feel we have been totally vindicated with this verdict,” said John C. VeLure, corporate representative for Compex and a key witness in the trial. “Our honor and the way we do business were being questioned with these claims, so we chose to defend ourselves aggressively.”

“We are very pleased with this complete jury verdict and believe it correctly reflects that our company did not engage in any wrongful conduct,” said Harry L. Zimmerman, Executive Vice President and General Counsel of Encore Medical Corporation, parent company of Compex. “Our trial team at Hughes & Luce was thorough, practical and well prepared to represent Compex at trial. They warranted the trust Compex placed in them.”

The Hughes & Luce trial team included Genender and associates Matthew D. Rinaldi and Kelsey M. Weir. Plaintiff, Dallas-based EEMSO, Inc. was represented by the Dallas Office of Baker Botts, LLP. Co-Defendant Iomed, Inc. was represented by Bracewell & Guiliani partner Betsy Whitaker and Parsons Behle & Latimer partner David Mangum.

Compex is a subsidiary of Encore Medical Corporation, which completed acquisition of Compex earlier this year.

William Flynn, Public Service Commission Chair, to Join Harris Beach and Lead Energy and Telecommunications Practice Groups and Head Albany Office
William M. Flynn, chairman of the New York State Public Service Commission, will be joining the law firm of Harris Beach PLLC as a member and leader of the firm’s Energy and Telecommunications Practice Groups effective December 1, 2006. Mr. Flynn will also head the firm’s Albany office. Mr. Flynn is noted for his vast experience in regulatory, legislative and policy issues as they relate to electricity, gas, water, and all telecommunications services. Mr. Flynn will provide legal counsel to clients. He will not be a lobbyist.
