Leonard P. Goldberger Presents to Professional Liability Underwriting Society at Annual International Conference
Leonard P. Goldberger was a featured speaker at the Professional Liability Underwriting Society’s Annual International Conference held November 8-10 at Hyatt Regency in Chicago, IL.
Mr. Goldberger, a Shareholder at Stevens & Lee, joined other panelists to discuss the topic, “Risks and Rewards of Bankrupt Companies,” where they identified aspects of bankruptcy cases that may implicate D&O (directors and officers) insurance coverage. They identified strategies and tactics for litigating D&O insurance coverage disputes in the context of bankruptcy cases and negotiating settlements of D&O insurance coverage disputes in connection with funding plans of reorganization and other tools only available in bankruptcy cases. In addition the panelists discussed how E&O claims may impact insurance relating to directors and officers, fiduciaries, financial institutions, accountants and lawyers.

Mr. Goldberger has 30 years of experience in business bankruptcy law. He represents insurers in asbestos, mass tort and environmental bankruptcy cases and works with clients in the acquisition and financing of financially distressed businesses. A former Vice President, Director and Executive Committee member of the American Bankruptcy Institute, Mr. Goldberger is the current Chair of the American Bar Association’s Committee on Insurance Coverage Subcommittee on Insolvency and a member of the ABA’s Litigation Section and its Tort Trial and Insurance Practice Section.

Mr. Goldberger lectures and writes extensively on bankruptcy law topics and serves on the editorial board of the American Bankruptcy Institute Journal. He has appeared as a guest commentator on Court TV. He received a J.D. from Villanova University School of Law and graduated summa cum laude from Temple University.

Margaret H. Paget recently presented a seminar at the Massachusetts Bar Association. The seminar "Handling Depositions with Confidence" offered a unique opportunity for attorneys with little or no experience in taking depositions to learn how to handle specific issues that may arise when preparing for, taking or defending a deposition.

Cemetery Premises Found to be Safe by Houston Jury
A Harris County jury deliberated less than one hour before finding a Houston area cemetery was not liable for negligence after a 72 year-old woman allegedly stepped into a hole on the premises. The woman had been visiting the Houston cemetery on Christmas day in 2003 to visit the gravesite of her daughter. As she walked to the gravesite, she testified her leg sank into the ground 18 to 20 inches deep, up to her right kneecap. She claimed when she fell into the hole, she "wrenched" her knee and ultimately required a total knee replacement. Plaintiff asked the jury to award nearly $200,000 in damages for her medical bills, mental anguish, disfigurement, and pain and suffering.

Plaintiff denied any preexisting problems to her knee, but two treating physicians admitted that Plaintiff had arthritis in her knee prior to her incident at the funeral home that day. One physician, who testiifed live at trial, explained the severity of Plaintiff's preexisting arthritic problems based upon a 2002 x-ray of her knee.

After two and a half days of testimony, the jury ultimately was persuaded by the fact that Plaintiff admitted the alleged hole did not exist prior to her foot creating it on the premises. Plaintiff also admitted during cross examination that she "did not know if she was hurt" when she reported the incident to the manager on duty at the funeral home, and did not seek medical attention for nearly 13 days. She further conceded that she even drove to a Christmas party following the incident, and did not take any pain medication for her claimed knee condition during that period.

The cemetery representative testified that the facility is nearly 250 acres, and inspected daily for grounds keeping issues which may pose a hazard to guests like the plaintiff, including holes. This was the first time a hole, as described by Plaintiff, was ever encountered on the premises. The manager on duty noted the hole to be 3 to 5 inches deep after the incident was reported, which sharply contrasted with Plaintiff's recollection.

The funeral home was represented by Mr. Steve Grubbs, an attorney with the law firm of Sheehy, Serpe & Ware, P.C., in Houston, Texas. Mr. Grubbs regularly represents cemeteries and funeral homes in Texas, including large corporate funeral directing firms and small family owned businesses. He also regularly defends licensed funeral directors and embalmers from licensure claims made by the Texas Funeral Service Commission. He is a member of the Texas Funeral Director's Association and a regular speaker for that group. Mr. Grubbs is certified by the Texas Board of Legal Specialization in Labor and Employment Law.

ATTORNEYS TOMOSOVICH AND ZATKOS NAMED RISING STARS
Chad D. Tomosovich and John W. Zatkos, Jr., both associates at the law firm Rothman Gordon, P.C., have been named Pennsylvania Super Lawyers Rising Stars by Law & Politics. Mr. Tomosovich was selected for Business/Corporate and Mr. Zatkos was selected for Workers' Compensation. To be eligible for selection, an attorney must be age 40 or younger or in practice for 10 years or less. Only 2.5% of the attorneys in Pennsylvania are selected as Rising Stars.

Mr. Tomosovich received his B.S. in Business Administration from Elon University and his J.D. from the University of Michigan Law School. He is a member of the Allegheny, Pennsylvania, and American Bar Associations, the Association of Corporate Growth, the CEO Forum of Pittsburgh and Rainmakers of Pennsylvania, where he serves on the Board of Directors.

Mr. Zatkos received his B.A. from Rutgers University and his J.D. from Duquesne University. He is a member of the Allegheny County Bar Association and the Pennsylvania Trial Lawyers Association. In addition to his practice, Mr. Zatkos has made it his mission to educate the public about their rights regarding Workers' Compensation. Recent presentations have included The Carnegie Library Business Series, the Center for Education Management and numerous union meetings. Mr. Zatkos also teaches at CCAC's Center for Professional Development. He resides in Moon Township.

Matheson Ormsby Prentice advises on new Digital River Irish Operations
Matheson Ormsby Prentice has recently advised US e-commerce firm Digital River in the creation of 350 jobs over five years in Ireland, with the establishment of a European headquarters in the Shannon Free Zone, to support the business of its subsidiary Digital River Ireland.
The US company, which is based in Minneapolis, builds and manages online businesses for more than 40,000 software publishers, manufacturers, distributors and online retailers.

Three Zuckerman Spaeder Attorneys Contribute to Larry King's New Book
Attorneys Roger Spaeder, William Taylor and Roger Zuckerman, partners in the Washington DC office, have contributed to the newly published book entitled "Beyond a Reasonable Doubt: Letters and Essays from the Famous and Infamous on the True Legal Definition of Guilt in America's Courtrooms." In "Beyond a Reasonable Doubt," the contributors reflect on what this standard really means and how it is applied. The book has an introduction by Larry King, and each author applies his own interpretation of America's cherished standard.`

Maureen P. Alger is a litigation attorney in the Firm’s Palo Alto, CA office. In her role as the Firm’s pro bono counsel, Ms. Alger has been responsible for the development and management of the pro bono practice firmwide. Her practice also includes representing pro bono clients in a wide variety of substantive areas including asylum, guardianship, landlord-tenant, civil rights, employment discrimination and general litigation. Ms. Alger received a J.D. from Columbia University School of Law, where she served as an editor for the Columbia Law Review. She received a B.A. degree with high honors from the University of California at Berkeley and was elected to Phi Beta Kappa.

Nicole C. Brookshire is a business attorney in the Firm’s Palo Alto, CA office. Paul E. Gross is a business attorney in the Firm’s Broomfield, CO office. His practice focuses on the representation of public and private companies in a variety of corporate and securities transactions including venture capital financings, private placements, mergers and acquisitions and public offerings. His practice also includes the formation and representation of venture capital partnerships. Benjamin D. Pierson is a business attorney in the Firm’s New York office. He practices corporate law, with an emphasis on the formation, financing, structuring and general representation of joint ventures which acquire, finance and develop real estate in the United States, the Caribbean and Latin America, and other structured real estate investments, including the representation of promoters, institutional investors, structured lenders and other investors in real estate-related assets.
