Firm receives third consecutive top company honor
For the third consecutive year, the Michigan Business & Professional Association (MBPA) has named Plunkett Cooney as one of “Metropolitan Detroit’s 101 Best and Brightest Companies to Work For.”

“We are extremely pleased to have won this award three years in a row,” said Henry B. Cooney, President and CEO of Plunkett Cooney. “The firm’s management team is focused on retaining our excellent people through new and innovative programs. It’s nice to see that effort acknowledged again this year.”

The MBPA award selection is a three-part process. First, an employee submits an application to nominate his or her company for consideration. Second, the MBPA contacts each company’s Human Resources Department to complete an extensive written survey along with an employee roster. Third, the MBPA randomly surveys a number of employees to validate the anonymous recommendation and the information submitted in the company questionnaire.

When selecting award winners, the MBPA’s market research firm examines each application statistically for both quantitative and qualitative data. An independent panel of volunteer judges then examines the applications, which are scored on a point system, and companies receiving the highest points totals are selected as award recipients.

The criteria for selecting the 101 Best & Brightest Companies to Work For in Metropolitan Detroit includes communications within the company; the organization’s commitment to the community; compensation and benefits packages; diversity and multi-culturalism initiatives; employee continuing education and development; employee connection and commitment to their work and their organization; recognition and retention of the company’s best and brightest employees; methods for recruiting people who best fit the organization; and balancing work, family and other demands.

Plunkett Cooney maintains a “Great Place to Work” program firm wide to enhance the work experience for all employees. This program goes beyond compensation to focus on added value benefits in addition to the traditional health, vision, dental and insurance plans offered by most companies. The program includes such opportunities as continuing education, special events, employee convenience services, diversity recruitment and retention, mentoring and much more.

As in past years, the firm is among excellent company in winning the 2007 MBPA award. Matheson Ormsby Prentice expands Projects and Construction team with new partner appointment
Matheson Ormsby Prentice is pleased to announce the appointment of Nicola Dunleavy as a partner in the firm’s Projects and Construction Group.

Nicola specialises in construction law and has advised on some of the largest Public Private Partnership (PPP) and infrastructure projects and claims in Ireland in recent years. Linda Foster-Wells Selected for USPS Mediation Panel
Linda Foster-Wells, a principal with the firm, was recently selected as a mediator for the United States Postal Service REDRESS mediation panel. The REDRESS program, which stands for Resolve Employment Disputes Reach Equitable Solutions Swiftly, was designed to address the employment-related complaints of Postal Service employees through alternative dispute resolution, as opposed to traditional litigation. The program exclusively utilizes the "transformative" method of mediation, in which Ms. Foster-Wells has been trained and certified.

Haynes and Boone Pro Bono Team Wins Judge’s Call For New Trial in Littlefield, TX Murder Case
A Littlefield, TX, judge has recommended new trials for two indigent Mexican nationals who have spent the last 11 years in prison on life sentences for the Aug. 6, 1996 killing of a Panhandle convenience store clerk.

The findings of fact and conclusions of law from 154th District Judge Felix Klein in Lamb County have been filed with the Texas Court of Criminal Appeals, which defense lawyers expect will order new trials for defendants Alberto Sifuentes and Jesus Ramirez. The two men were convicted in 1998 for murdering Evangelina "Angie" Cruz, attendant at the Jolly Roger convenience store just off Texas Highway 84 in Littlefield northwest of Lubbock.

“This is a great day for these two men who are finally on the verge of vindication for a crime they could never have committed,” said Dallas-based attorney Barry McNeil, who has led the five-year Haynes and Boone, LLP pro bono fight for Mr. Sifuentes, 34, and Mr. Ramirez, 59. ”It is inconceivable that the prosecutors would retry these cases. There is simply no evidence of any wrongdoing by our clients. They weren’t even there.”

The defense team – McNeil, Ron Breaux, Sarah Teachout and former Haynes and Boone associate Ashley Brown Duffie – had argued during a 2005 habeas corpus hearing that Mr. Sifuentes and Mr. Ramirez were convicted based on false testimony by a questionable eyewitness.

The night Ms. Cruz was shot nine times and killed, Mr. Sifuentes and Mr. Ramirez were stopped by authorities while returning home to Muleshoe from a Lubbock bar. No evidence was discovered linking the men to the crime and they did not match the description Ms. Cruz gave of her assailants as she lay dying. They were allowed to leave.

Sifuentes and Ramirez only became the prime suspects the following day when an acquaintance inquired about a Crime Stoppers reward. After that, a bungled photo lineup and testimony from a mistaken eyewitness resulted in the convictions, the Haynes and Boone trial lawyers contended.

The Klein "findings of fact" concluded the defendants were denied their constitutional rights when the trial juries were never informed:

* about the existence of a known alibi witness, Pauline Robles, who would have testified the defendants were at a Lubbock nightclub at the time of the murder;
* that evidence implicated two brothers who matched the victim’s description of her attackers;
* and that critical evidence that could have led the jury to doubt the defendants’ guilt was never investigated.

Simpson Thacher Represents Amici Curiae in U.S. Supreme Court Cases Over Guantánamo Detentions
Simpson Thacher filed an amicus curiae brief in support of Petitioners in the United States Supreme Court in Boumediene v. Bush (No. 06-1195) and Al Odah v. United States (No. 06-1196). These two consolidated actions involve the rights of detainees held by the United States military at Guantanamo Bay, Cuba to petition for the writ of habeas corpus. Specifically, Petitioners in both Boumediene and Al Odah appeal from the D.C. Circuit's decision that the Military Commissions Act of 2006 precludes jurisdiction over detainees' pending habeas petitions and that such an ex post deprivation of jurisdiction does not violate the Suspension Clause of the Constitution.

The Simpson Thacher team, working from the Palo Alto office and in conjunction with Prof. Beth Van Schaack of the Santa Clara University Law School, filed the amicus brief on behalf of a distinguished group of international humanitarian law experts, including scholars, lawyers and a former principal of the International Committee of the Red Cross. The brief provided the Court with justifications, grounded in international law, to reverse the D.C. Circuit's ruling. The brief argued that the Third Geneva Convention provides prisoners of war with substantive and procedural rights and that, in considering whether to retain jurisdiction over Petitioners' pending habeas petitions, the Court should be mindful of these and other international legal obligations to which the United States is bound.

The Simpson Thacher team included partners Buzz Frahn and Patrick King, and associates Angela Moore, Adam Anderson and Michael Lizano, all of whom are resident in the Palo Alto office.

Gregory B. Mann Honored as One of Law Bulletin's "40 Under Forty"
The Law Bulletin Publishing Company, publisher of the Chicago Daily Law Bulletin and Chicago Lawyer, has named Gregory B. Mann to its 2007 list of "40 Illinois Attorneys Under Forty to Watch." The selection committee based its decisions on the attorneys' career achievements (successful settlements, verdicts, acquisitions or transactions), how quickly the nominees have risen in their areas of practice, and their contributions to the community and the profession.

According to the publisher, this group of young attorneys are "outstanding individuals who are much more than their favorable settlements, verdicts and appeals. They are individuals who are passionate about their work, their clients and their community."

A Principal of Much Shelist and Vice Chair of the firm’s Wealth Transfer & Succession Planning practice group, Greg designs and implements estate and gift tax plans for individuals and family groups. His work also includes implementing succession planning techniques for closely held corporations, administering probate estates, income tax planning, and preparing gift and estate tax returns.
