Paul Hastings Advises International Investor Consortium on the Cirebon Independent Power Project
Paul, Hastings, Janofsky & Walker LLP (Paul Hastings), a leading international law firm, is representing PT Cirebon Electric Power, a consortium led by Japan's Marubeni Corporation, which will build and operate a 660 megawatt coal-fired power plant and sell power from the plant to PLN, the Indonesian state owned government utility.

The consortium signed a 30 year power purchase agreement in Jakarta last week in front of Japanese Prime Minister Shinzo Abe and Indonesian President Susilo Bambang Yudhoyono, during the Japanese prime ministers’ visit to Indonesia earlier last week.

The plant, which will be located on the coast of western Java, will supply power to Jakarta and other parts of the region, where power shortages are expected as demand is likely to outpace supply because of Indonesia's rapid economic growth.

The total investment will be about US$750 million. The plant is scheduled to start commercial operations by August 2011. Marubeni owns 32.5% in the consortium, while South Korean power company Korea Midland Power Co. has a 27.5% stake. Indonesian engineering company PT Tripatra Engineers & Constructors has a 20% stake and South Korea's Samtan Inc. holds the remaining 20% stake.

The project is the first international independent power project in Indonesia to be signed since the 1997 financial crisis.

Commenting on the deal, Brett King, partner at Paul Hastings, said, “We are delighted to be advising the consortium on this landmark project, which marks the return of international investors to Indonesia's project finance sector after nearly ten years. I am confident that with the success of PT Cirebon Electric Power, we will see more international investment in Indonesian power projects."

Paul Hastings is the only international law firm advising on this deal. The team was led by finance partners Brett King, Alex Regan and associate Christian Petersen in Hong Kong.
