Nine Phillips Lytle LLP Attorneys From The Firm’s Rochester Office Named New York State Super Lawyers
Nine attorneys with the Rochester office of Phillips Lytle, a full service law firm with statewide coverage, have been named by New York State Super Lawyers magazine as being among the top attorneys in New York State for 2007. Only five percent of the lawyers in the state are named by Super Lawyers. Forty attorneys across four of the firm’s offices were recognized by Super Lawyers, the most attorneys from a single law firm selected to the list of Upstate New York Super Lawyers. Upstate New York Super Lawyers includes Buffalo, Jamestown, Rochester and Albany.

“To be named by Super Lawyers is certainly an honor for each of our forty attorneys recognized this year and is representative of the high quality of talent Phillips Lytle has throughout the state,” said Morgan G. Graham, Managing Partner.

Attorneys from Phillips Lytle’s Rochester office named Super Lawyers include: Richard M. Beers, Jr., Thomas R. Burns, Michael R. Law, Albert M. Mercury, Mark J. Moretti, Jacqueline Phipps Polito, Linda Prestegaard, Paul A. Vick and Robert F. Zogas.

The selections for Super Lawyers are made by Law & Politics, a division of Key Professional Media, Inc. of Minneapolis, MN. Each year, Law & Politics undertakes a rigorous multi-phase approach that includes a statewide survey of lawyers, independent evaluation of candidates by the Law & Politics’ attorney-led research staff, a peer review of candidates by practice area and a good-standing and disciplinary check. Law & Politics has been publishing Super Lawyers magazines across the country since 1991.

Partner Theodore Howard Secures Major Pro Bono Victory to Reduce DC Jail Overcrowding
A significant victory secured in part by Wiley Rein Insurance and Litigation partner Theodore A. Howard on behalf of DC Jail inmates will require the DC government to remedy jail overcrowding after nearly four years of non-compliance with the inmate population cap imposed by the DC Jail Improvement Act of 2003.

Enacted to address “unsafe, unhealthy and inhumane conditions” attributed to overcrowding, DC Council unanimously passed the Jail Improvement Act following two murders and a third near-fatal stabbing at the Jail in December 2002.

In granting summary judgment to the plaintiffs in Anderson v. Fenty, DC Superior Court Judge Melvin Wright categorically rejected the District of Columbia’s argument that the prisoners lacked standing to sue because they could not point to any specific injury they have suffered as a result of the DC government’s failure to take concrete action under the Jail Improvement Act. Citing the statute’s unambiguous and mandatory language, the judge ruled the city must submit in writing its plan to adhere to the 2003 legislation and reduce overcrowding by October 5, 2007.

Mr. Howard worked on this pro bono matter in conjunction with the DC Prisoner’s Project of the Washington Lawyers’ Committee for Civil Rights and Urban Affairs, where he serves on the Board of Directors. Wiley Rein associates Justin Heminger and Swati Kabaria assisted Mr. Howard with research and analysis.

Sutherland Asbill & Brennan LLP Announces Management Team Changes
Sutherland Asbill & Brennan LLP announces changes to the firm’s management structure with the appointment of three new Partners-in-Charge, who will serve as managing partners of the Atlanta, Houston, New York and Washington, D.C. offices.

In Atlanta, Eric R. Fenichel has been selected Partner-in-Charge. As a member of the Corporate Practice Group, his practice encompasses a broad array of financing transactions, including structured finance and securitization, derivatives and structured products, commodity financing arrangements and general corporate finance.

Don E. Wood and Rachel Giesber Clingman will serve as Co-Partners-in-Charge of the firm’s expanding Houston office. Mr. Wood is a partner in the Corporate Practice Group, where his practice focus includes representing community, regional, national and international financial services institutions - including banks, thrifts, trust companies, credit card issuers, service organizations, insurance underwriters and agencies, title companies and small loan companies.

Ms. Clingman, who joined Sutherland earlier this month, heads the firm’s national Business Litigation Practice Group, which includes energy and environmental litigation. She is an experienced trial lawyer, who has handled numerous jury trials and appeals across the country. In addition to energy and commercial litigation, her trial experience includes aviation claims, shareholder disputes and international litigation arising from alleged acts of terrorism in the Middle East.

In Washington, D.C., Richard G. Murphy is now Partner-in-Charge. A member of the Litigation Practice Group, Mr. Murphy has represented organizations in various industries, including banking, factoring, telecommunications and nuclear energy in court and in various forms of alternative dispute resolution. As the senior litigator in the firm’s Business Restructuring and Bankruptcy Group, his particular emphasis is on disputes involving creditors’ rights and bankruptcy-related issues. Rick replaces W. Mark Smith, who served as Partner-in-Charge for seven years.

William H. Bradley remains Partner-in-Charge of the New York office. Mr. Bradley, a member of the Corporate Practice Group, has extensive experience in timber taxation and finance. He has also handled complex tax controversies at all administrative levels within the Internal Revenue Service and has litigated tax issues in the Tax Court, the United States District Court, the Court of Federal Claims and in the Eleventh and Ninth Circuit Courts of Appeals.

Firm Managing Partner Mark D. K&L Gates Recognized for Business Innovation
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) has received CIO magazine’s annual CIO 100 Plus One Award, recognizing five recipients of the CIO 100 who have demonstrated outstanding achievement toward a specific business goal. K&L Gates received the Plus One Award in Business Innovation for its legal information system.

One example of innovation within the industry is K&L Gates' legal information system (LIS), which provides technology-enabled solutions for creating and sharing legal knowledge and products with clients through a platform that allows for anywhere/anytime access.

K&L Gates received its most recent CIO 100 Award in August and is named regularly by the CIO 100 program. Its recognitions from 2002-2004 made K&L Gates the first law firm in the world to receive three consecutive awards.

White & Case Advises Aviation Capital Group
White & Case LLP recently represented Aviation Capital Group in a $270 million unsecured senior debt private placement to ten financial institutions and their affiliates.

"This is an important transaction for ACG and represents the next step in ACG's access to the broader capital markets," said partner Sylvia Chin.

The financing, which involved two tranches of fixed rate notes and a tranche of floating rate notes, all of which were rated investment grade by Fitch, represented the first unsecured debt financing transaction for our client.

Sylvia Chin was the lead partner in the deal, along with partners Raymond Simon and Michael Smith, and assisted by associate Mehtap Cevher Conti in New York.

Thompson Hine Grows Life Sciences Practice
Caroline Rogers has joined the Atlanta office of the law firm Thompson Hine LLP as an associate in the firm’s Life Sciences practice group. Prior to joining Thompson Hine, Ms. Rogers was an associate with the law firm Epstein, Becker & Green in Washington, D.C.

Ms. Rogers focuses her practice on the laws and regulations pertaining to the development, promotion and distribution of food, drugs, devices and other FDAregulated products. Her practice also includes providing counsel on internal and government investigations, compliance programs, HIPAA privacy regulations, federal antitrust issues and mergers and acquisitions as they relate to both the life sciences and health care industries.

Ms. Rogers received her J.D. from the Mercer University Walter F. George School of Law and her B.A. from The University of North Carolina at Chapel Hill. She is currently completing a Master of Public Health degree at Mercer University School of Medicine. She is a member of the Georgia Bar Association and the American Bar Association.
