Webinar: The Practical Aspects of E-Discovery Presented February 8, 2007
The amendments to the Federal Rules of Civil Procedure addressing e-discovery became effective. The amendments mark the beginning of a new era in business litigation. The lesson is clear: e-discovery can no longer be an afterthought; business litigants and their counsel must consider e-discovery and the role of e-documents at the outset of litigation.

On February 8, Pepper Hamilton presented a webinar offering an understanding of the changes to the Rules of Civil Procedure, discussed the importance of an effective information management plan before potential litigation, and explored best practices for creating an effective e-discovery plan in the event of litigation.

Orrick Litigators Explain Significance of Lawyers' Role in Crisis Management
Litigation partners Lanny Davis and Adam Goldberg and associate Joshua Galper, who recently co-authored an article on crisis communication, were quoted in a Daily Journal article about crisis management practice groups at law firms. The three Orrick lawyers are in agreement on the importance of Orrick's strategic communications and crisis law sub-practice, which has five members in Washington and New York.

Davis believes that, in severe situations, attorneys are best-suited to speak on behalf of their clients. "It is inconceivable that there can be effective crisis management by somebody who doesn't have attorney-client privilege," he said. "No public relations consultant can be given access to all the facts, good and bad, and, therefore, reporters are never going to be confident that they are talking to someone who knows all the facts."

"There's a consensus that clients need a multidisciplined approach to solving problems," said Goldberg. "Taking the more traditional approach of 'no comment, we'll fight this in a court of law, not the court of public opinion,' is antiquated."

According to Galper, "It's three legs of a stool: communications, politics and, of course, the law.

Former Federal Prosecutor Joins Orrick's White Collar Defense Practice
Orrick, Herrington & Sutcliffe LLP announced today that Thomas McConville, formerly an assistant United States attorney focusing on fraud and public corruption prosecution, has joined the firm as of counsel in its Los Angeles and Orange County offices. Honored with a “Director’s Award,” one of the highest honors bestowed on federal prosecutors, McConville is the eighth former federal prosecutor to join Orrick's white collar defense group.

"Federal and state regulatory and law enforcement agencies are devoting unprecedented attention to the investigation and prosecution of businesses and their executives," said Ed Woodsome, chair of Orrick’s litigation practice.. "The increasing criminalization of business practices presents companies with a wide range of complicated issues. With the addition of Tom McConville, we now have former federal prosecutors in New York, Washington, D.C., and Northern and Southern California and are uniquely positioned to offer clients counsel on a wide range of white collar issues."

During his 10 years in the U.S. Attorneys Office, Mr. McConville secured convictions and conducted grand jury investigations into elected and other high-ranking officials, defense contracting fraud, computer crimes, trademark infringement, trade secret theft, healthcare fraud, the False Claims Act and violations of the Foreign Corrupt Practices Act. He also served for 3 years as the Deputy Chief of the Southern Division of the Central District of California.

"The attorneys in the White Collar group are outstanding and well-regarded throughout the country," said McConville. "I'm excited by the opportunity to work with them, and the other talented Orrick lawyers throughout the world, to help clients navigate through difficult times."

McConville received a J.D. from the Georgetown University Law Center in 1991 and an A.B. in Public Policy from Stanford University in 1987. Before entering public service, he was a litigation associate at McKenna and Cuneo in Los Angeles and Washington, D.C.

Former Ober|Kaler Lawyer Pamela White Sworn in as Circuit Judge for Baltimore City
Ober|Kaler attorney Pamela J. White has been appointed Circuit Judge for Baltimore City. Ms. White was sworn in on February 8. A public investiture is scheduled for April 19 at the Clarence Mitchell Courthouse.

Formerly chair of Ober|Kaler's Employment & Labor Group, Ms. White, 55, joined the firm in 1977 and became Ober|Kaler's first female partner in 1985. A highly regarded Maryland lawyer, Ms. White's commitment to professionalism and community service has earned her a high profile. She has received Mayoral and Gubernatorial Citations, been honored by the press as one of Maryland's Top 100 Women, and has received the Women's Bar Association of Maryland's highest award.

Ms. White maintains a rigorous schedule serving on numerous professional and community boards including, by Governor appointment, the Maryland Legal Services Corporation and the Baltimore and Maryland Bar Foundations. Ms. White is a past-president of the Maryland State Bar Association and former chair of the Professionalism Committee, the Legal Education and Bar Admissions Section, and the Gender Equality Committee of the State Bar. Upon appointment by Chief Judge Robert Bell, she served on the "Ethics 2000" Committee to update the Maryland Rules of Professional Conduct. A former president of the Women's Bar Association of Maryland, Ms. White is a recipient of the Rita C. Davidson Award, the Bar's highest honor.

Ms. White is a Distinguished Alumna and former member of the Board of Trustees of Washington and Lee University, where she graduated in the second co-ed class of the law school, and a Distinguished Alumna of Mary Washington College (now, the University of Mary Washington).

A nationally respected employment lawyer, Ms. White appears in the peer review The Best Lawyers in America, and Chambers USA, America's Leading Lawyers for Business.

Norris McLaughlin Attorneys to Participate in Rutgers Environmental Seminar
Norris McLaughlin & Marcus associate Patrick T. Mottola will speak about “Solid and Hazardous Waste” at a course offered by the Rutgers University Cook College Office of Continuing Professional Education entitled Environmental Law and Regulation. The two-day course will be hosted and moderated by Norris McLaughlin & Marcus member Martha N. Donovan on February 7-8, 2007 at the Middlesex County Fire Academy in Sayreville.

This course is designed to give attendees a better understanding of compliance with environmental laws and regulations in New Jersey from the perspective of both a private attorney and a regulatory official who is responsible for administering and/or enforcing applicable laws and regulations.

A resident of Warren County, Mottola devotes his practice to environmental compliance, regulation and litigation. He regularly serves clients on environmental issues including ISRA compliance, site remediation and Brownfields redevelopment projects, underground storage tank laws, and permitting, including air, water, waste and wetlands. Mottola has served in litigation and enforcement matters relating to wetlands delineation, CAFRA, hazardous waste, insurance coverage for mold contamination, and the New Jersey Spill Compensation and Control Act.

Mottola is a member of the American and New Jersey State Bar Associations, The New Jersey Chamber of Commerce Environmental Committee, the Environmental Business Council of the Commerce and Industry Association of New Jersey, the Association of Engineering Geologists, and is a Barrister of the Justice Stewart G. Pollock Environmental American Inn of Court. He has been published in the New Jersey Law Journal and Commerce Magazine, and has spoken on “Environmental Law and Regulation” for the Rutgers University-Cook College Continuing Professional Education Program.

Mottola received his J.D. from Seton Hall University School of Law and his A.B. in Philosophy and Geology from Hamilton College.

A resident of West Windsor, Donovan practices in the area of complex litigation, including environmental property damage, toxic tort, and insurance coverage. She has handled a number of Superfund litigation matters as well as various other matters (both regulatory and litigation) arising from contamination to the environment. She has made presentations to various trade groups and associations on topics ranging from lender liability under Superfund to the availability of insurance coverage for various aspects of business-related accidents.

Donovan represents clients in administrative and judicial proceedings before state and federal courts, and agencies including the New Jersey Department of Environmental Protection and the Environmental Protection Agency. She regularly counsels clients on a variety of environmental issues including ISRA compliance, lender liability, underground storage tank laws, and permits and approvals for hazardous waste storage, transportation and disposal.

She has litigated matters relating to the generation, storage, discharge or release of hazardous substances, including representation under “CERCLA” and “Superfund,” and has defended against actions filed by adjoining, predecessor, and successor property owners alleging physical injuries, emotional distress, or lost property values. In addition, she aids in the resolution of matters involving air emissions, waste water discharges, noise pollution, and responses to spill events.

Donovan received her J.D. from the University of Virginia School of Law in 1985 and her B.A., magna cum laude (and Phi Beta Kappa) in Chemistry from Randolph-Macon Woman’s College in 1982. She is a member of the American and New Jersey State Bar Associations and is the author of the Environmental Law chapter of the New Jersey State Bar Association’s “New Jersey: A Basic Legal Guide for Foreign Businesses.
