Carlos A. Kelly Publishes Article on Eminent Domain in The Florida Bar Journal and Presents at the Association of Eminent Domain Professionals' Annual Meeting
Henderson Franklin, is pleased to announce that Stockholder Carlos A. Kelly's article entitled "How to Obtain an Order of Taking", which discusses how to obtain an order of taking in eminent domain, was published in the October 2006 edition of The Florida Bar Journal. Additionally, Kelly was recently invited to present his article at the Association of Eminent Domain Professionals' Annual Meeting on November 2, 2006 in St. Petersburg Beach, Florida.

Kelly represents individuals and entities at the trial court level. He focuses his practice on real property disputes, including eminent domain matters. He also represents clients in business tort claims, construction claims, creditors’ rights matters, and contract-based disputes.

In addition to his legal practice, Kelly is actively involved in the community and, over the years, has served the United Way, the American Heart Association, the City of Fort Myers Economic Development Advisory Board, the Department of Children and Families, and Teen Court. He has also served in The Florida Bar and the Lee County Bar Association.

Jason D. Scott has been named a partner in the law firm of Hawley Troxell Ennis and Hawley LLP.
Scott is a member of the firm's commercial litigation practice group, with expertise on disputes within the jurisdiction of federal courts. Before joining the firm, he served a two-year clerkship for U.S. District Judge B. Lynn Winmill.

Scott also has passed the certified pubic accountant examination and serves as contributing editor of "Tort Law Desk Reference: A Fifty-State Compendium," published annually by Aspen Publishers. He is a graduate of Idaho State University and Duke University School of Law.

Hand Arendall Opens a Fairhope Office
Hand Arendall is pleased to announce the opening of its Fairhope, Alabama office to expand the range of services it provides to Baldwin County clients. The firm’s office is located at 71 North Section Street, Suite B. This is in addition to the firm’s other Baldwin County office in Foley, Alabama opened in 1998.

Waggoner Appointed by Governor Riley to Serve on State Commission
Mark Waggoner has been appointed by Governor Bob Riley to serve on the board of the Red Mountain Greenway and Recreational Area Commission for a six year term. Mr. Waggoner is a partner with Hand Arendall, L.L.C., in its Birmingham office.

Waggoner is chair-elect of the Alabama State Bar Environmental Law Section and serves on the Birmingham Regional Chamber of Commerce’s Environmental Committee. He also serves on the Board of Trustees for the National Multiple Sclerosis Society - Alabama Chapter

Lee Martin Joins Hand Arendall
Hand Arendall is pleased to announce A. Lee Martin has joined the firm’s Birmingham office. Mr. Martin has worked in public finance for thirty years, serving as bond counsel, disclosure counsel, underwriter's counsel and trustee counsel.

Although Mr. Martin practices is all areas of traditional public finance, his major areas of emphasis are in financings to construct or repair affordable and low income housing, financings to construct or refinance healthcare facilities, and refunding issues, including those involving swap transactions.

Mr. Martin graduated from Vanderbilt University (B.A., 1971) and obtained his J.D. from the University of Chicago in 1974.

Health Care Group Receives Second Consecutive Defense Verdict
Jim Braze, an attorney in Gordon & Rees' Health Care Group, obtained a unanimous defense verdict for his client, a Residential Care Facility for the Elderly (RCFE). This is the second consecutive defense verdict for the Health Care group.

The allegations began when the 91 year old woman suffered a fall 6 weeks after transferring to the RCFE facility. The patient was then moved between hospice care, and an acute care facility. When she was returned to the RCFE, her condition had declined and her status was no longer an appropriate placement under application regulations for the RCFE. However, the family insisted on her return to the RCFE. The RCFE then obtained authorization from the Department of Social Services to evict the patient. She was moved to another RCFE where she died 30 days later.

Plaintiffs alleged their 91 year old mother suffered "transfer trauma" and plaintiffs sued the RCFE for negligence, fraud and elder abuse. Plaintiffs asked the jury to award $2.5 million at trial. The plaintiffs further asserted the last move was not motivated by a change in their mother's condition but by a desire to get rid of the troublesome family who had been harassing and verbally abusing the RCFE staff.

The jury deliberated for three days before returning the defense verdict on all allegations.
