RDB and ACLU Obtain Significant Victory In Freedom of Speech Case
RDB partner Kevin Kieffer and associates Becki Kieffer and Jenece Solomon obtained a significant victory for a pro bono client and a published opinion in the California Court of Appeal on California’s Anti-SLAPP statute.

As co-counsel with the American Civil Liberties Union, RDB represented William Alnor, a journalist who runs a “watchdog” Web site reporting on the fundraising and spending practices of various religious organizations. After reporting on what he believed to be the questionable fundraising practices of a large, national religious organization, Alnor was sued by the organization and its president for defamation.

On behalf of Mr. Alnor, RDB filed an Anti-SLAPP motion – a special motion to strike available to those sued for, among other things, exercising their right to free speech. The Court of Appeal reversed an earlier decision and directed the trial court to enter an order granting the motion and dismissing the case.

Vivendi Represented by Orrick in Continued Dispute with Deutsche Telekom
Litigation partner Lanny Davis and Paris European finance partner George Rigo are both quoted in this article about Vivendi’s lawsuit against T-Mobile USA, Deutsche Telekom AG and Zygmunt Solorz-Zak, a wealthy Polish investor. Orrick represents Vivendi in this case and is trying to bring the case under American jurisdiction, using the argument that the defendants used phone and e-mail networks in the U.S. to commit a crime.

Davis, who filed the suit, said “Congress passed the RICO Act (Racketeer Influenced and Corrupt Organizations Act) to combat racketeering in the United States and where racketeering seriously harms U.S. citizens. That is exactly what the complaint alleges.”

A Polish appeals court recently overturned a lower court ruling in Vivendi's favor, but Vivendi lawyers suspect the German company may ignore this ruling. “Based on Deutsche Telekom’s and T-Mobile’s record of violating and failing to respect court orders, injunctions and arbitral awards in this matter,” said Rigo. “We have no expectation they will respect these most recent decisions.

David J. Rosenberg Prevails in Two Superior Court Cases
Weber Gallagher partner David J. Rosenberg represented prevailing parties in two recent decisions issued by the Pennsylvania Superior Court. In Ivory v. Collins, issued on February 20, 2007, a three-judge panel unanimously affirmed the trial court’s denial of the plaintiff’s motion for relief from a judgment of non pros because the motion was not timely filed, and did not contain a reasonable explanation or legitimate excuse for the plaintiff’s inactivity or delay or set forth a meritorious cause of action.

In Cornelissen v. Zahorchak, issued on February 22, 2007, a divided panel affirmed the trial court’s grant of summary judgment to a deck hockey player whose shot struck a spectator in the eye, causing permanent blindness. Six days prior to the accident, a referee told the plaintiff she could not observe from the players’ bench area unless she signed a waiver and release or liability form; she signed the release that day. After the plaintiff sued for negligence, the player filed a motion for summary judgment, arguing the plaintiff’s claim was barred by waiver, the “no duty” rule, and assumption of risk. The majority upheld the trial court’s decision to dismiss the case based on the application of the “no duty” rule and the waiver doctrine.

Former Nassau County Attorney Joins Northeast Florida's Largest Law Firm Jacksonville
Michael S. Mullin joins Rogers Towers, P.A. as a Shareholder. His practice will include local and State government, civil litigation, real property including zoning and comprehensive planning matters.

Prior to joining Rogers Towers, Mullin served as Nassau County Attorney both part-time and full-time for the past 25 years. As County Attorney, he represented the Board of County Commissioners, the Clerk of the Court, and the Supervisor of Elections. He provided legal assistance to the Board, and its staff, Planning and Zoning Board, and advisory boards, and represented the Board of County Commissioners in litigation and administrative proceedings.

“We are very fortunate to add to our firm a lawyer of Mike's experience and expertise,” said Douglas A. Ward, managing director of Rogers Towers. “Rogers Towers is very excited to enter the Nassau County community with Mike Mullin on our team.”

From 1982-1999, Mullin also had a private practice devoted primarily to civil litigation, criminal jury trials, real property matters, and domestic matters. In 1972, he served as Legislative Assistant with the Florida Legislature, and as Director of the Florida House in Washington, D.C. from 1972-1977.

Mullin earned his J.D. from Stetson College of Law in 1980, and his B.A. from the University of West Florida in 1972. He is a member of The Florida Bar, Nassau County Bar Association, Jacksonville Bar Association, Federal Bar Association (Jacksonville Chapter) and the International Municipal Lawyers Association. He is admitted to practice before the United States District Court for the Middle District of Florida and United States Circuit Court of Appeals for the Eleventh Circuit.

Miller Johnson Announces Two New Members
Attorneys Robert W. O’Brien and Susan H. Sherman have been elected to Membership at Miller Johnson, the firm announced today. The members voted to promote both of them from associates to members at a Tuesday meeting.

Mr. O’Brien’s business and litigation practice focuses on real estate and construction. In addition, he is a member of the Fraud and Embezzlement Recovery practice group. Admitted to practice law in 1999, Mr. O’Brien graduated summa cum laude from Michigan State University-Detroit College of Law, and earned his bachelor’s degree from Franciscan University.

Ms. Sherman is an integral member of the firm’s Employee Benefits practice group and concentrates on assisting employers in designing and administering health care and retirement plans. Admitted to the bar in 1998, she graduated magna cum laude from Wayne State University Law School, and earned her bachelor’s degree magna cum laude from Central Michigan University.

New Partners Named in Growing Business and Corporate Law Practice
The law firm of Lowndes, Drosdick, Doster, Kantor & Reed is pleased to announce that, with the expansion of its business and corporate law group, attorneys Paul Mandelkern and Zachary Bancroft have been elevated to partners of the firm.

Paul Mandelkern's primary areas of practice include corporate and securities, healthcare, and mergers and acquisitions. He has a Martindale-Hubbell AV rating; the organization’s highest distinction. Mandelkern earned his law degree from Duke University School of Law (J.D. 1974) and his graduate degree (L.L.M. in Taxation 1982) from University of Florida. He earned his undergraduate degree from Tulane University (B.A.1971.) Admitted to practice law in Florida since 1974, Mandelkern is on the board of directors for the Kinneret Council on Aging, Inc. and active with the Florida Academy of HealthCare Attorneys.

Zachary Bancroft's primary areas of practice include bankruptcy and creditors' rights with other specialty practices and industries areas including general business litigation, commercial loan workouts and bankruptcy litigation. He earned his law degree from Wake Forest University School of Law (J.D. 1998) and his undergraduate degree from Binghamton University (B.S. 1995.) Bancroft is admitted to practice law in Florida and with the U.S. District Court, Middle District of Florida. He is a member of the American Bar Association, Business Law section, the Orange County Bar Association, the Central Florida Bankruptcy Law Association, the American Bankruptcy Institute and Florida Citrus Sports.
