Robert Lesley Joins Lathrop & Gage
Robert O. Lesley, a seasoned trial attorney with significant experience in intellectual property and consumer products liability litigation, has joined Lathrop & Gage L.C. as a member.

Lesley has 23 years of trial practice experience and has tried nearly two dozen cases, including disputes involving copyright, trade secret, trademark, patent infringement, products liability and technology. Recognized as a Missouri/Kansas Super Lawyer, Lesley has litigated cases in nearly every state, representing some of the country’s best-known brands, including Black & Decker, Toastmaster (now Salton), Vornado and Hallmark Cards.

Previously, Lesley was a partner with Sonnenschein Nath & Rosenthal LLP; earlier, he was with Stinson Mag & Fizzell (now Stinson Morrison Hecker LLP) for 22 years, several of which he served as the firm’s IP practice chair.

“I’ve watched Lathrop & Gage grow into a litigation powerhouse with national reach – it’s impressive what the firm has accomplished,” Lesley said. “The variety and volume of work is second to none in Kansas City and exceptionally strong regionally and nationally. Add to that a very collegial work environment, and this is the perfect place for me and my clients.”

With more than 180 litigators, Lathrop & Gage has one of the largest litigation practices in the region. Lesley joins a growing stable of high-profile trial attorneys, including IP stalwart Bill Hansen in New York; Phill Lorenzo in Denver; Brent Baldwin in St. Louis; Gary Cunningham in Springfield; and former U.S. Attorney Jean Paul Bradshaw, among others, in Kansas City. Both Baldwin and Cunningham are Fellows in the American College of Trial Lawyers, comprised of the best of the trial bar in the U.S. and Canada.

Moreover, with the addition of Lesley, Lathrop & Gage is now home to 44 IP attorneys. In this area, Lesley is the second significant addition in January alone: Earlier this month, the firm announced the addition of Dean Bierkan, who formerly oversaw the IP portfolio of Heinz Corp. as an in-house attorney, to its New York office.

Tom Stewart, the firm’s managing partner, said it has been part of the Lathrop & Gage’s long-term strategy to develop the most dominant litigation and IP litigation practices in its markets.

“Lathrop & Gage is committed to a growth path that builds on the exceptional quality and expertise that an attorney like Bob Lesley brings,” he said. “We are delighted he chose to join our firm, and to add his considerable trial expertise in service to our clients.”

Lesley earned his undergraduate degree from Westminster College and his law degree from Washington University School of Law. He is admitted to practice in Missouri and Kansas.

Heller Ehrman Serving As Counsel To Independent Committee Of The Starr Foundation
Heller Ehrman LLP is serving as counsel to the Independent Committee of the Starr Foundation, which today has issued its report in response to a December, 2005 report issued by the Office of the New York State Attorney General. Lawrence J. Zweifach, Chair of Heller Ehrman’s New York Litigation Department, is leading the Heller Ehrman team representing the Independent Committee. Also serving as counsel for the Committee is Farrell Fritz, P.C., led by John J. Barnosky.

The background of the Independent Committee is as follows:

On December 14, 2005, the Office of the New York State Attorney General issued a report entitled “Report on Breaches of Fiduciary Duty by Executors of the Estate of Cornelius Vander Starr.” This report contends that The Starr Foundation has possible claims for breach of fiduciary duty against the surviving executors of the Estate of Cornelius Vander Starr either (i) in their capacity as executors for entering into certain alleged conflicted transactions, or (ii) in their capacity as directors of The Starr Foundation.

In response to this report and a recommendation made by the New York State Attorney General’s Office in correspondence with The Starr Foundation, the Board of Directors of The Starr Foundation appointed an independent committee of disinterested persons on January 31, 2006, to investigate the issues identified in the report. The Board of Directors authorized, empowered, and directed the Independent Committee of The Starr Foundation to: (i) conduct its investigation by taking all action determined by the Independent Committee to be appropriate, including, without limitation, reviewing documents and interviewing witnesses; (ii) provide the results of such investigation to The Starr Foundation’s Board of Directors; and (iii) pursue all rights and remedies of The Starr Foundation, including pursuit of any litigation or other courses of action, which the Independent Committee may determine exist and are, in the reasonable judgment of that committee, in the best interests of The Starr Foundation to pursue.

The Independent Committee consists of three members: Hon. William C. Thompson, a retired Justice of the Appellate Division of the Supreme Court of the State of New York, Second Department; Hon. C. Raymond Radigan, a former Surrogate of Nassau County; and Florence A. Davis, the current President of the Foundation and a member of its Board of Directors. None of the Independent Committee members had any involvement in any of the transactions at issue in the New York State Attorney General’s Office’s report, nor did any of them serve as Executors or as directors of the Foundation during any of the years in question.

The Independent Committee of The Starr Foundation conducted a comprehensive and thorough investigation of the factual and legal issues raised in the report issued by the Office of the New York State Attorney General. That report focuses on three transactions entered into by the executors of the estate of C.V. Starr in 1969 and 1970. The New York State Attorney General’s Office contends that, in each instance, the Executors breached their fiduciary duties to the Estate, and its residual beneficiary, The Starr Foundation, by selling assets of the Estate for far less than their actual value.

During the course of its twelve-month investigation, the Independent Committee and its counsel have collected over 650,000 pages of documents, and interviewed or received written responses to its questions from nearly all of the surviving participants or witnesses to the matters alleged in the report of the New York State Attorney General’s Office.

The conclusion to the Executive Summary of the Independent Committee’s 174-page report states as follows:

After completing its investigation, and carefully considering the issues raised by the report issued by the Office of the New York State Attorney General, the Independent Committee of The Starr Foundation has determined that the executors of the Estate of C.V. Starr acted in good faith and prudently performed their duties, and that there is no basis for the report's contention to the contrary. Accordingly, in the circumstances presented here, the Independent Committee has concluded that it would not be appropriate, nor would it be in the best interests of The Starr Foundation, to pursue any litigation or other course of action against the executors, whether in their capacity as executors or as directors of The Starr Foundation.

The Report of the Independent Committee of The Starr Foundation can be found on The Starr Foundation website located at: www.starrfoundation.org/news.html.
