TAX INCENTIVE CUTS THE COST OF HIRING INTERPRETERS FOR THE DEAF - DISABILITY ACCESS CREDIT OFFERS BUSINESS OWNERS RELIEF WHEN COMPLYING WITH ADA
Most professionals and business owners have an obligation under the Americans with Disabilities Act (ADA) to provide deaf and hard of hearing individuals with full and equal access to their goods, services, facilities, privileges, or advantages. Yet many are unaware of the financial relief that is available under the U.S. Tax Code in the form of a Disabled Access Credit.

Stephanie Neal, an advocate for the deaf and hearing impaired and an attorney at Smith Haughey Rice & Roegge who holds an LL.M in Taxation, likes to remind business owners about the help available to cover the cost of compliance with ADA regulations, such as the cost of providing interpreters for the deaf and the hearing impaired. “As a matter of public policy, the cost of compliance with the ADA is borne by the business community in order that individuals with disabilities will be better able to have equality of opportunity, full participation, and economic self-sufficiency. Business owners looking to do the right thing for the disabled, often overlook the tax benefit available to them.”

The Disability Access Credit is available to eligible small businesses in the amount of 50% of eligible access expenditures that exceed $250 but do not exceed $10,250 for a taxable year. Eligible access expenditures include amounts paid or incurred to provide qualified interpreters or other effective methods of making aurally delivered materials available to individuals with hearing impairments. A business may take the tax credit each year that it makes an eligible access expenditure.

The Disability Access Credit can be based on a series of expenses paid throughout the tax year. For example, a physician who sees a deaf patient may be billed about $100 - $150 for the services of a qualified interpreter (assuming a 2 hour minimum plus mileage). When the same patient returns for a follow up visit or the physician sees another deaf patient during the taxable year, the total qualified interpreter expenses may range from $250+. Under this scenario, the Disabled Access Credit will cut the cost of the physician’s compliance with the Americans with Disability Act in half. A taxpayer may also combine qualified interpreter expenses, for example, with eligible access expenses from the other four categories to satisfy the minimum threshold necessary to claim a tax credit. The amount is capped at $10,000 per tax year or a $5,000 nonrefundable income tax credit.

Ms. Foster is a 1998 graduate of Chicago Kent College of Law – Illinois Institute of Technology where she earned her juris doctorate with honors. She has her B.S. from Western Michigan University.

GSA Chief Acquisition Officer Emily Murphy, Joins Miller & Chevalier
Miller & Chevalier Chartered today announced that Emily Webster Murphy has joined the firm's Government Contracts group as Counsel. Murphy formerly served as Chief Acquisition Officer at the U.S. General Services Administration.

"Miller & Chevalier's government contracts practice is focused on providing clients with both legal and business advice. Our group assists companies that have traditionally provided services and products to the federal government, as well as new entrants to this market, to achieve their business objectives," said Angela Styles, former Administrator of the Office of Federal Procurement Policy, Office of Management and Budget, and Chair of Miller & Chevalier's Government Contracts Department. "We are very excited that Emily is joining Miller & Chevalier and believe her unique insight into the federal procurement process will be of great value to clients. Her senior government experience will enable her to proactively guide companies through the federal contracting arena, rather than just reacting to problems as they arise."

Miller & Chevalier's Government Contracts attorneys have extensive experience in federal, state, and international procurements, and represent contractors in nearly every industry involved in public business. They advise clients on a broad range of contract and subcontract issues from contract formation to protests and claims litigation. The practice has depth in complex issues such as the False Claims Act, defective pricing, suspension and debarment, cost accounting, and intellectual property. About Emily Murphy

As Chief Acquisition Officer, Murphy helped strengthen GSA's acquisition activities to assure that the best value of services were delivered to federal agency customers in support of their missions of service. Murphy was responsible for ensuring compliance with procurement laws, overseeing acquisition decision-making, assuring full and open competition for contract awards, developing the acquisition workforce, and ensuring excellent service through GSA's "Get It Right" program, an effort to train employees on proper contracting procedures in the wake of procurement abuses by one of GSA's former divisions, the Federal Technology Service, which was absorbed into the Federal Acquisition Service. On behalf of GSA, Murphy signed the December 2006 Memorandum of Agreement with the Department of Defense, laying out the ground rules for interagency contracting between the two agencies.

Prior to working at GSA, Murphy was the Senior Advisor for Government Contracting and Business Development, the Acting Associate Administrator for Policy Planning and Liaison, and the Acting Associate Administrator for Government Contracting at the Small Business Administration. Before that, she was an Associate in Government Contracts, Government Affairs, Health Care, and Insurance Practices at a Washington, D.C. law firm.
In addition to her responsibilities with GSA, Murphy served as the Co-Chair of the Chief Acquisition Officers Council Working Group on Emergency Contracting, as a member of the CAOC's Acquisition Committee for E-Government, and on the Board of Directors for the Federal Acquisition Institute. She continues to serve as the Co-Chair of the Small Business and other Socioeconomic Programs for the American Bar Association's Public Contract Law Section. She is also a national founding partner of Women Impacting Public Policy, a bipartisan organization of 500,000 women-owned businesses.

She holds a J.D. from the University of Virginia School of Law, and an A.B. from Smith College.

MCDONALD HOPKINS PRESIDENT PASSES UNEXPECTEDLY
It is with profound sadness that the members of McDonald Hopkins announce that their friend and partner, Joseph J. LoPresti Jr., president of the Cleveland–based law firm, passed away suddenly this morning.

A resident of Shaker Heights, Mr. LoPresti is survived by his wife, Cathy; his two sons,
James and Matthew; his parents, Joseph J. Sr. and Theresa; and his brother, Robert. He was preceded in death by his son, Daniel.

Mr. LoPresti had served as McDonald Hopkins' president since 1999. Prior to that, he was chair of the firm’s Corporate Law Department and a member of the management committee for 17 years. In his practice, he provided counsel in the areas of mergers and acquisitions, commercial banking, finance, and strategic planning.

Mr. LoPresti served on the boards of the Applewood Centers, (i)Cleveland, and the Greater Cleveland Chapter of the American Red Cross. He was co-chair of the Great Lakes Theater Festival and vice chairman of the executive committee of the Greater Cleveland Sports Commission.

Lindquist & Vennum Adds Three Attorneys in Denver
Lindquist & Vennum is increasing its bench strength in the construction and real estate industries with the addition of three attorneys in the firm’s Rocky Mountain regional office. Tiffanie Stasiak joins as a partner in the firm’s Construction Litigation practice, along with associate attorney Michael Bonifazi. Both bring extensive experience and knowledge of the construction industry to the firm. Matthew McElhiney joins as a partner in the firm’s Real Estate practice group, helping to extend its established Midwestern real estate practice to the Rocky Mountain region.

Bloomington City Council Approves PUD Preliminary Development Plan for United Properties
Linda Fisher, real estate and land use attorney, obtained Bloomington City Council approval of a PUD Preliminary Development Plan for United Properties' proposed 8200 Tower, the fifth office tower in Normandale Lake Office Park. The 8200 Tower is a 285,000 square foot, 11 story office building with an adjacent 1,114 square foot parking ramp.

The building will be located at 8200 Norman Center Drive in the southwest quadrant of Interstate 494 and Highway 100 and is a $60 million project. Construction start may be this year subject to approval of the PUD Final Development Plan.

Cooley IP Practice Announces New Leadership Position, Reflecting Nationwide Growth and Momentum
Cooley Godward Kronish LLP announced today new leadership for one of the practice areas within its Intellectual Property practice group. Partner Tom Friel will become the leader of the firm’s national Intellectual Property litigation practice. He joins partners Anne Peck, head of Trademark, Copyright & Advertising, and Frank Pietrantonio, head of the Patent Counseling & Prosecution team, as an Intellectual Property practice group leader. Pietrantonio will continue to lead the firm’s overarching Intellectual Property practice, comprised of nearly 100 attorneys, patent agents and professionals nationwide.
