NLRB Region Rules in Favor of Nelson Mullins Hospital Client
The Regional Director of the Denver Region of the National Labor Relations Board ("NLRB") issued a 47-page decision finding that charge nurses at a hospital represented by the Firm in Salt Lake City were supervisors within the meaning of the National Labor Relations Act and therefore should have been excluded from a bargaining unit of all nurses sought by the United American Nurses Union. This decision followed the NLRB's landmark trilogy of decisions in September 2006 known as the Oakwood Healthcare trilogy involving the status of charge nurses at hospitals.


A team of Nelson Mullins labor attorneys headed by Dan Shea and including Matt Gomes and Chris Enloe tried a three-day evidentiary hearing in the case late last fall that resulted in this ruling. The case had been remanded from the NLRB where it had been on appeal since an adverse ruling in 2002. This was the first favorable decision for the healthcare industry following the Board's decision in Oakwood. All other post-Oakwood decisions found that charge nurses and foremen were not supervisors. The union has not decided whether to appeal the ruling. To view the decision.

VINOCUR JOINS SMITH HAUGHEY AND EXPANDS THE FIRM'S HEALTH LAW DEPARTMENT
Smith Haughey Rice & Roegge is pleased to announce that P. David Vinocur has joined the firm as a shareholder in the Traverse City office. Dave will focus his practice on health law, specifically in the areas of behavioral health law, Medicaid, HIPAA, hospital law, managed care contracting, and compliance issues.

A practicing attorney for 30 years, Dave most recently served as in-house counsel for Northern Lakes Community Mental Health Authority. A member of the State Bar of Michigan, Health Care Compliance Association, and American Health Lawyers Association, Dave is active in his profession and industry. He also sits on the Bioethics Resource Committee for Munson Medical Center.

Dave received a Bachelor of Arts degree from Yale University, a teaching certificate from Northern Michigan University, and his Juris Doctor from Syracuse University College of Law.

Miller Johnson Attorney to Moderate Panel at Emerging Energy Strategies Forum
James P. Enright , an environmental law attorney at Miller Johnson, will moderate the “Next Practices – Case Studies in Energy Innovation” session at the Quarterly Issue Forum: Emerging Energy Strategies on Monday, March 12, 2007. The forum is sponsored by the Grand Rapids Area Chamber of Commerce and the Center for Sustainability at Aquinas College.

Mr. Enright received his B.S. with distinction from the University of Wisconsin in 1979 and his law degree, cum laude, from the University of Wisconsin Law School in 1988. His practice focuses on environmental law issues affecting businesses, municipalities, and individuals. Mr. Enright was chair of the Grand Rapids Bar Association’s Environmental Law Section. He is active in the Grand Rapids Area Chamber of Commerce, the State Bar of Michigan’s Environmental Law Section, and the American Bar Association Section on Environment, Energy, and Resources. He is also a member of the Air and Waste Management Association.

The “Next Practices – Case Studies in Energy Innovation” session will focus on what innovative energy technologies are being utilized by area companies. The business leaders serving on the panel are:

Miller & Chevalier Attorney Larry Gibbs Receives Federal Bar Association Taxation Section Honor
Miller & Chevalier Chartered today announced that Larry B. Gibbs, a member in the firm's Tax Department, has been selected to receive the 2007 Kenneth H. Liles Award for Distinguished Service from the Federal Bar Association (FBA) Section of Taxation.

The Kenneth H. Liles award is presented by the FBA Section of Taxation annually to recognize individuals for outstanding service and dedication to tax policy and administration, as well as their contributions to the bar and the legal profession. Ken Liles founded the modern day Federal Bar Association Section of Taxation and helped to establish its high standards for service to the Federal Bar, as well as education and policy work. Past recipients of the award include present and former Commissioners of the Internal Revenue Service, Chief Counsels for the Internal Revenue Service, Assistant Secretaries for Tax Policy at the Treasury, Federal Judges, Chiefs of Staff from the Congressional Joint Committee of Taxation, and officials from the Justice Department. Gibbs will be recognized March 9 in a ceremony following the FBA's Section of Taxation annual Tax Law Conference at the Ronald Reagan International Trade Building.

"Larry has made a lifetime commitment to the practice of law that can be seen through his high standards of professional competence and ethical conduct," said Samuel Maruca, Chair emeritus of Miller & Chevalier. "We are pleased that the FBA Section of Taxation has recognized him for his extraordinary dedication to the field of tax law, and we all congratulate him on this honor."

Gibbs has a general tax practice in which he counsels large corporations and other businesses on how to solve their domestic and international tax problems, including those involving planning, compliance and controversy matters, administrative and legislative matters, and litigation.

He served as Commissioner of the Internal Revenue Service from August 1986 to March 1989 and was a recipient of the U.S. Department of the Treasury's Alexander Hamilton Award and the Tax Executives Institute's Distinguished Service Award. As Commissioner, Gibbs was responsible for administering the U.S. federal tax system, including the audits, collection and criminal investigation functions, as well as representing the Internal Revenue Service before the Administration, U.S. Congress, international tax officials, state tax authorities, the media, and the public.

Gibbs is presently a member of the Tax Foundation Policy Committee; the American Tax Policy Institute Board; the American College of Tax Counsel; the American College of Trust and Estate Counsel; the American Law Institute; and the Committees on Government Relations, Formulation of Tax Policy, Administrative Practice, and Corporate Tax of the Taxation Section of the American Bar Association. He is a Trustee of the Southern Federal Tax Institute and a member of the Advisory Board of Tax Management.

Gibbs holds an LL.B. from the University of Texas Law School (1963) and a B.A. from Yale University (1960).

Haynes and Boone Presents "Building a Medical Device Company on a Shoestring"
Haynes and Boone L.L.P. is hosting the March Meeting of the Dallas Forum for BioMedical Technology featuring Lea Ellermeier Nesbit, Cofounder & CEO, Lingualcare, Inc., on Wednesday, March 7, 2007.

George A. Pisaruk Joins Gust Rosenfeld
George A. Pisaruk joins Gust Rosenfeld P.L.C. as an Associate in our business and finance departments. Having more than 15 years experience in law and business, Mr. Pisaruk has a proven track record of providing counsel to companies on a variety of issues, including corporate governance, intellectual property, securities/business combinations, employment, Sarbanes-Oxley compliance and transactional matters.
