Ted Zangari - NJ Gov. Sees Redevelopment as Key to Growth
This article features a write-up on the recently held NAIOP Symposium where Governor Jon Corzine was the key note speaker. Corzine tied success to "improving the climate of what people think of government." The symposium panel was moderated by Ted Zangari who stated: "Simply put, a lot of the state is off-limits to development, and redevelopment is the key...The realities of economic growth involve urban cores, train stations and brownfields, coupled with the challenges of high costs, taxes, soft markets. The latter factors could force 'a tipping point of redevelopment.

California Supreme Court Rules in Favor of Orrick Client
The California Supreme Court ruled to enable public agencies in California to help finance construction at schools controlled by churches. Orrick was counsel to the California Statewide Communities Development Authority, which in 2002 decided to issue tax-exempt bonds to finance construction at a Christian high school and two religious universities based in Southern California.

The Supreme Court majority concluded that the lower courts should have focused on "the substance of the education" and not the religious nature. Sacramento litigation partner Norm Hile, who argued for the CSCDA joint powers authority, doesn't foresee the schools having any trouble meeting the majority's test to prove that the schools offer a "broad curriculum in secular subjects" and use coursework that is "neutral with respect to religion" to teach secular subjects. "These are educational institutions. They're not churches," said Hile.

Milbank Advises on India Telecom IPO
The international law firm Milbank, Tweed, Hadley & McCloy LLP announced today that it was proud to have advised on the Idea Cellular Limited IPO. The offering raised Rs. 24.44 billion (approximately US$ 553 million), including the green shoe option, representing 12.4% of the post-IPO capital of the company, which is part of the Aditya Birla Group, one of the largest business groups in India.

Milbank advised the underwriters to the offering, with JM Morgan Stanley and DSP Merrill Lynch acting as the Book Running Lead Managers and Citigroup and UBS acting as the Senior Co-Book Running Lead Managers.

Idea Cellular Limited is one of the leading mobile telecommunications operators in India, with operations currently in 11 of India’s 23 mobile “circles”, and operations expected to commence in two additional circles in the near future.

Tom Siebens, the partner who led Milbank’s team, said “The Indian IPO market remains very active and telecoms is one of India’s most dynamic sectors. We were delighted to be part of the Idea Cellular transaction.”

Milbank also advised the underwriters in the US$600 million IPO of Reliance Petroleum Limited in May 2006.

Nine Nelson Mullins Attorneys Named Georgia 'Super Lawyers'
Nine Nelson Mullins Riley & Scarborough attorneys have been selected by their peers to the list of Georgia "Super Lawyers" in eight practice areas.

The attorneys listed are Richard B. Herzog, Jr., bankruptcy & creditor/debtor rights; Stanley S. Jones, Jr., health care; Caroline C. Kresky, business litigation; Wade S. Malone, business litigation; Kenneth L. Millwood, business litigation; Kamyar Molavi, construction/surety; Daniel M. Shea, employment & labor; Anita W. Thomas, general litigation; and Charles D. Vaughn, mergers & acquisitions.

Attorney Richard HerzogMr. Herzog also was listed as among the Top 100 Georgia attorneys. He leads the debt finance and restructuring practice and chairs the Firm's Property, Government and Finance Group. He is currently president of the Atlanta Bar Association where he has served as an officer or director since 1998. He has been a trustee of the Georgia Legal History Foundation since 1988 and is a Trustee and Fellow of the Atlanta Bar Foundation, a Fellow of the Georgia Lawyers Foundation, and the American Bar Foundation.

Attorney Stan JonesMr. Jones has more than 25 years of experience in the practice of health care law, government relations and administrative law. He serves on the Executive Committee of the Dean's Council for the Emory University School of Public Health. He is a member of the board of directors and the executive committee of Georgia Health Decisions and serves as chairman of the board of Visiting Nurse Health Systems, Inc. He also is a founding board member of the Atlanta Community Court Foundation. Mr. Jones has been extensively involved in the mental health movement in Georgia since working on gubernatorial and presidential commissions for the Carter family. Mr. Jones has also served on several other community boards and currently serves on the board of advisors of the Metropolitan Atlanta Chamber of Commerce and participates on the Governor's Roundtable.
Attorney Caroline KreskyMs. Kresky is a commercial litigator who handles complex civil litigation in federal and state courts. She has extensive experience in arbitration and mediation. Ms. Kresky's practice includes business and real estate litigation, intellectual property cases (copyright, trademarks, covenants, and trade secrets), high asset family law matters (ante-nuptials, post-nuptials, divorce, trusts, probate, and estates), and alternative dispute resolution. She serves on the faculty of the Emory trial advocacy program and the Atlanta College of Trial Advocacy.

Attorney Wade MaloneMr. Malone practices in the areas of business litigation and products liability defense. Mr. Malone’s complex litigation practice has included representation of both plaintiffs and defendants in a broad range of complex litigation in both state and federal courts, including business, personal injury/product liability, antitrust, restrictive covenant and construction litigation. He serves in the House of Delegates of the American Bar Association as a representative of the Atlanta Bar Association. Mr. Malone is a past president of the Atlanta Bar Association and Atlanta Legal Aid Society. He has been co-chair since its inception in 1993 of the Atlanta Bar Association's Summer Law Internship Program that provides paid internships for Atlanta high school students.

Attorney Ken MillwoodMr. Millwood is a senior litigation partner and managing partner of the Nelson Mullins Atlanta office and is the Firm's General Counsel. He is a member of the Firm's Executive Committee and practices in the areas of business, securities and financial litigation, and antitrust and trade regulation. He has extensive experience in litigation against corporate officers and directors surrounding financial and accounting issues.
torney Kamy MolaviMr. Molavi practices in the areas of construction litigation and advice, suretyship, and commercial litigation. Before joining the legal profession, Mr. Molavi obtained a Master's degree in civil engineering and worked in the commercial construction industry as a project manager and estimator from 1983 to 1988. For two years he was adjunct professor of construction law at Southern Polytechnic State University. He was appointed by the Construction Management Association of America as a judge for the 2005 and 2006 CMAA Project Awards. He is currently on the board of directors of CHIRS Kids, Inc., a nonprofit organization focused on assisting troubled or abused youth and their families.

Attorney Dan SheaMr. Shea has a national practice and represents management before state and federal courts and government agencies. He frequently lectures on labor relations at seminars and conferences. Mr. Shea has extensive experience in matters relating to collective bargaining, union arbitration, trial practice, particularly of employment discrimination cases, and roughly 25 to 40 percent of his practice during the last 10 years has been with respect to restrictive covenants-employment agreements on a nationwide basis. Mr. Shea's FLSA practice has also been a significant part of his work for 30 years, including the trial of several wage-hour cases, including collective action claims. He is a member of the College of Labor and Employment Lawyers.

Attorney Anita ThomasMs. Thomas practices in litigation involving general commercial litigation, product liability, pharmaceutical litigation, employment litigation and toxic tort. She has a vast amount of experience in all aspects of product liability litigation. Ms. Thomas and the Firm’s automotive litigation group represent vehicle, tire and equipment manufacturers in product liability actions across the United States. She has served as trial counsel and MDL counsel in pharmaceutical and toxic tort cases across the country. She also has successfully defended clients against charges of employment discrimination, harassment and wrongful discharge, and represents employers in all aspects of hiring, employing and firing employees.

Attorney Charles VaughnMr. Vaughn's practice focuses on corporate finance and related matters. He represents public and emerging growth companies in private and public offerings of securities and in mergers and acquisitions. He has represented issuers of real estate-related securities since the early 1980s. Mr. Vaughn devotes a significant portion of his practice to counseling public companies about compliance with the Sarbanes-Oxley Act and related SEC regulations.

Elizabeth Laffitte Joins Nelson Mullins in Charleston
Elizabeth Harrison Laffitte has joined Nelson Mullins Riley & Scarborough in Charleston and practices in the areas of corporate, mergers and acquisitions, real estate, and securities law.

Admitted to practice in Georgia and South Carolina, Ms. Laffitte is a member of the American Bar Association and the Charleston County Bar Association. Prior to joining Nelson Mullins, Ms. Laffitte worked for a law firm in Atlanta where she practiced in corporate finance.

Ms. Laffitte authored "Model Rule 1.14: The Well-Intended Rule Still Leaves Some Questions Unanswered," Geo. J. Legal Ethics Vol. XVII, No. 2 (Winter 2004). She co-authored "The Potential Effects of SEC Regulation of Attorney Conduct Under the Sarbanes-Oxley Act," Geo. J. Legal Ethics, Vol. XVI, No.4 (Summer 2003).

In 2004, Ms. Laffitte earned a Juris Doctor from Georgetown University Law Center, where she served as administrative editor of the Georgetown Journal of Legal Ethics. Ms. Laffitte interned with the Honorable Robert H. Hodges, Jr., of the United States Court of Federal Claims during her third year at Georgetown. In 2001, she earned a Bachelor of Arts in English with a minor in Business Administration, magna cum laude, from the University of South Carolina Honors College where she was a Palmetto Fellow and Valedictory Scholar. While attending the University of South Carolina, Ms. Laffitte was inducted into Phi Beta Kappa and Omicron Delta Kappa and was a recipient of the Outstanding University Senior Award.

Crystal McCall Tapped for A Child's Haven Board
Nelson Mullins Riley & Scarborough LLP Associate Crystal C. McCall has been named to the board of directors for Greenville's A Child's Haven, a specialized therapeutic treatment program for children ages 2 to 5 whose development has been delayed by poverty, neglect, and abuse.

Ms. McCall practices in Greenville in the areas of business litigation, product liability, and class action defense and litigation. A member of the South Carolina Bar (Young Lawyers Division), Ms. McCall is also a member of the American Bar Association, the Greenville County Bar Association and the South Carolina Defense Trial Attorneys' Association.

In 2004, Ms. McCall earned a Juris Doctor, cum laude, from the University of South Carolina School of Law, where she served as associate articles editor of the South Carolina Law Review and received a CALI Award in Real Property. In 2001, Ms. McCall earned a Bachelor of Science in Business Administration from Erskine College.
