Rounder Records Group receives 13 nominations for 2005 Grammy Awards
"The Rounder Records Group, a client of Fish and Richardson P.C., received 13 nominations for the 48th Annual Grammy Awards, as announced by The Recording Academy in New York City on December 8, 2005. The Cambridge, MA-based Rounder Records Group, founded in 1970, produces and distributes a wide range of historic, traditional, and contemporary recordings in many genres. Since 2002, Fish & Richardson has served as the company's corporate and intellectual property counsel.

Most notably, Alison Krauss and Union Station led the way with three Grammy nominations, while Rhonda Vincent and The Rage, Blue Highway, and The Grascals dominated the Best Bluegrass Album category with three out of five nominations. Three-time Grammy Award-winner and Marsalis Music/Rounder recording artist Branford Marsalis also picked up his ninth nomination while 14-time Grammy Award-winner and Polka king Jimmy Sturr picked up his 19th nomination. Two-thousand and four and 2005 Grammy Award-winners Cathy Fink and Marcy Marxer were nominated for best musical album for children, which is their 11th nomination.

The 48th Annual GRAMMY Awards , will be held on Wednesday, February 8, at Staples Center in Los Angeles and broadcast live on CBS from 8 - 11:30 p.m. (ET/PT)."

F&R's Jonathan Singer named a Client Service All-Star
Jonathan Singer, a principal in Fish & Richardson's Twin Cities office, has been named as one of 134 attorneys in the country that deliver the absolute best client service. The list, called "The BTI Client Service All-Stars Team," is compiled annually by BTI Consulting Group, a Boston-based market research firm. BTI interviewed over 200 corporate counsel at large and Fortune 1000 companies to determine their satisfaction with the law firms they work with. As part of this independent survey, companies are asked to name the individual attorney who truly delivers turly outstanding client service. The survey evauluates such qualities and skills as proactivity in addressing clients' upcoming needs; efficiency in managing clients' time and money; using deep knowledge of the client's industry and business as the backdrop to deliver exceptional legal advice. "These 134 individual attorneys are described by companies as having incomparable levels of responsiveness and accessibility, which position them in a league of their own," according to BTI Consulting Group. "They have an unquenchable thirst for understanding their clients' business, goals, and hot buttons." Of the 134 All Star attorneys on list, only three are from the Twin Cities area. "We are very proud to have Jonathan Singer singled out as one of the best of the best on this prestigious list of attorneys," said Mark Ellinger, Managing Principal of Fish & Richardson's Twin Cities office. "Most big companies work with many lawyers from different law firms for different projects, so it is even more significant to be named by this elite group of in-house counsel as being so extraordinary.

Bolia, Young, and Garver join DLA Piper’s Government Affairs group in Atlanta
DLA Piper US LLP announced that three government affairs professionals have joined the firm’s Atlanta office, expanding DLA Piper’s highly regarded Government Affairs practice further into the Southeast region.

The three government affairs professionals are Don M. Bolia, Joseph D. Young and Mathew G. Garver.

The addition of this government affairs team represents the latest milestone in the expansion of the firm’s Atlanta office. Since entering the Atlanta market in May of 2006, DLA Piper has added more than 30 attorneys throughout key practice groups, including Corporate and Securities, Finance, Litigation and Real Estate.

“Don, Joe and Mathew’s arrival highlights the firm’s strategic commitment to strengthening the nationwide presence of the Government Affairs practice,” said Mark E. Grantham, managing partner of DLA Piper’s Atlanta office. “All three are highly regarded and seasoned professionals who have a unique background in public and private infrastructure. With the growing interest in toll road projects throughout the Southeast, their extensive experience expands our ability to advance key client initiatives tied to this and other legislative matters.”

About the Government Affairs Team

Don Bolia is a government affairs consultant who provides industry leaders with strategic advice on how legislative trends will impact their businesses and assists them in shaping policy debates at the Georgia state, county and local levels.

He manages clients’ relationships before the Georgia General Assembly, as well as numerous city and county governments and agencies. Because of his key relationships at the municipal level, his clients are able to clearly communicate their message to the pertinent decision makers.

Bolia began his political career working for then-Congressman Newt Gingrich. In 1992, he was appointed the political director of the Georgia Republican Party, where he was directly responsible for managing the GOP’s statewide effort to elect Republicans to the Georgia General Assembly. He was then named chief of staff for the Fulton County Commission chairman.

Bolia was appointed executive director of the Georgia Republican Party in 1994 and currently serves as chairman of the Board for the Georgia Chapter of the Arthritis Foundation

He received a B.A. from Emory University.

Joseph Young is an attorney specializing in providing practical legislative advice and sophisticated bill drafting services to business and government.

In 1996, Young became assistant legislative counsel to the Georgia General Assembly, after nine years of complex commercial litigation practice. Two years later, he joined Gov.-elect Roy E. Barnes’ senior staff as legislative director and legislative counsel. In that position, he supervised the implementation of the governor’s legislative agenda, acting as chief administration lobbyist while working with the governor and other staff to develop numerous initiatives in transportation, finance, taxation and other fields.

For example, Young worked with the governor in 2001 to craft legislation that would transform the state’s small toll road authority into an innovative transportation finance vehicle, the Georgia State Road and Tollway Authority. He recently served on the Board of this authority for two years, which under the leadership of its chairman, Gov. Sonny Perdue, has issued billions of dollars in guaranteed revenue bonds and Grant Anticipation Revenue Vehicles (“GARVEE bonds”) for road construction, utilizing the mechanisms introduced in 2001.

He was also instrumental in the creation of the Georgia Regional Transportation Authority, a regional transportation planning agency for the rapidly growing metropolitan Atlanta area.

He received a J.D. from Harvard Law School and a B.A. from Emory University.

Mathew Garver is a government affairs consultant with extensive experience representing clients on public private partnerships and privatization projects. His representation is focused on private finance for public assets such as ports, security infrastructure, transportation and wastewater plants.

Prior to joining DLA Piper, Garver was a principle with Liberty Street Capital, a boutique investment banking firm focused on public-private finance, public finance and private equity.

Garver also served as business development director for Scientific Games International, Inc., one of the largest lottery systems companies in the world. There he managed more than 40 lobbyists and consultants in the United States and Europe, including the U.K. and France.

Garver is a board member of Lyceum Investment, LLC, a private investment firm with several positions in middle market companies throughout the United States. He serves as a consultant to several of the companies in the portfolio relating to corporate development, mergers and acquisitions, financial management and other executive leadership functions.

He is also the former vice president of the Georgia Chamber of Commerce and a former policy analyst for the Georgia House of Representatives

He received a B.A. from Michigan State University and completed Harvard Business School’s Executive Education and Valuation Programs.

GARRIGUES HEADS THE NEW CHAMBERS EUROPE RANKINGS IN 12 PRACTICE AREAS
Garrigues placed extremely well in the rankings published today in the new Chambers Europe guide. Focusing exclusively on the European legal market, the latest guide contains new ranking categories.

Specifically, Garrigues was ranked in Band 1 (the highest level) in twelve categories: Administrative law, Arbitration, Insolvency, Energy and Natural Resources, Tax, Real Estate, Labor and Employment, Environment, Private Equity, Project Finance, Telecoms, New Technologies and Zoning, a category in which Garrigues is the sole Band 1-ranked firm.

The firm’s healthy position is borne out by comments from clients, including opinions such as “Garrigues has the most comprehensive telecom and new technologies practice in the Spanish market”, “the finest team the Spanish market has to offer in zoning law” and “the best all-round private equity team on the market”. Garrigues was also described as one of the firms “with the greatest creativity and flexibility, with first class negotiating skills.”

Special mention is made in the Chambers Europe Leading Lawyers ranking of the firm’s lawyers Ricardo Gómez (Tax) and José Guardo (Project Finance) –both of whom were classed as star performers – and the firm’s managing partner, José María Alonso, who receives four mentions and is described as “one of the most sought after international arbitrators, at both Spanish and pan-European level”.

Service Of A Kansas Mechanic’s Lien Via Certified Mail – Restricted Delivery Is Ineffective Service Absent Proof Of Actual Receipt And Prejudgment Interest Accrues On A Mechanic’s Lien Against The Owner Even If The Owner Disputes The Amount Of Lien
Homeowners took title to property by quit claim deed from general contractor after general contractor defaulted. As a result of homeowners’ first appeal to the Kansas Court of Appeals, Kansas changed the law regarding service of lien statements on “equitable owner of record” after supplier lien claimant filed suit. Court ruled that even though homeowner refused to claim certified mail – return receipt requested – homeowners’ actual receipt of the lien statement as attachment to petition in the lawsuit prior to the amendment of the statute was sufficient service of the lien statement under the amended mechanic’s lien service statute. Homeowners are also required to pay pre-judgment interest from the day they took title to the property, even though homeowners disputed the amount of the lien claim.

Jim Parsons of Taft Stettinius & Hollister Appointed to Blue Ribbon Commission by Governor Fletcher
James E. Parsons, an attorney in the Covington, Kentucky office of Taft Stettinius & Hollister LLP, recently was appointed by Governor Ernie Fletcher to serve on the Governor’s Blue Ribbon Commission for Public Employees Retirement Systems.

The 24-member commission will study methods to address the current unfunded liabilities accrued by these individual retirement plans, including pension and health insurance benefits. Over the coming months, the commission will develop a plan to fulfill its retirement obligations to current retirees and employees while examining the appropriate level of benefits for future employees.

Parsons, a resident of Newport, is a member of the firm’s Public Law and Public Finance Practice Groups, as well as a registered lobbyist with the firm’s affiliate, Focused Capital Solutions. He previously served as Administrator and Deputy Judge Executive of Boone County, and as Assistant City Solicitor, City Solicitor and City Manager for the City of Newport, where he was involved in developments such as Newport on the Levee and the Newport Aquarium.

Parsons received his J.D. from Salmon P. Chase College of Law of Northern Kentucky University, where he also obtained his B.A. and graduated cum laude. Parsons previously served as an adjunct instructor in the Public Administration Department at NKU, teaching Executive Management and Urban Administration. Parson serves on the Executive Committee for the Brighton Center; serves as board chairman for the Newport Housing Development Corporation; and serves as a board member for OKI.

Charles G. Misko Appointed to Missouri Real Estate Commission
Stinson Morrison Hecker LLP attorney Charles G. Misko was recently named a member of the Missouri Real Estate Commission. Misko is one of seven voting members on the commission.

The mission of the Missouri Real Estate Commission is to protect the public from incompetence, misconduct, gross negligence, fraud, misrepresentation, or dishonesty; to license only "qualified" real estate professionals by examination and evaluation of minimum competency; to enforce standards in the real estate industry by implementing legislation and administrative rules; and to encourage economic development and partnership with existing small businesses. Other responsibilities include investigating complaints generated by consumers against licensed Missouri real estate brokers and salespersons, and auditing real estate escrow accounts to verify proper handling of third party funds.

Misko, the managing partner of the St. Louis office, provides counsel on corporate finance, real estate, and general corporate matters to a number of publicly and privately held businesses. His community involvement includes membership in Downtown St. Louis Inc. Professionally, he is on the board of directors of the St. Louis Chapter of the Building Owners & Managers Association and the Missouri Growth Association. He also is a member of the International Council of Shopping Centers. He is a 1968 graduate of St. Benedict's College and a 1974 graduate of the St. Louis University School of Law. He is licensed to practice law in Missouri, Illinois and Tennessee.
