McDermott Again Recognized for its Leading Trademark Practice
McDermott Will & Emery is pleased to announce that its Intellectual Property, Media & Technology Department was recognized in Intellectual Property Today's "Top Trademark Firms" survey, published in its May 2007 issue. The Firm’s Trademark Practice Group was ranked among the top 10 most active trademark firms. The list is based on the number of trademark registrations issued by the U.S. Patent and Trademark Office in the previous calendar year. With 533 trademarks issued in 2006, McDermott placed in the top 5 percent among the 169 firms surveyed.

Brian Schoenborn was recognized in Minnesota Lawyer's "Bar Buzz" column on May 14 for being honored with the President's Award for his work with Minnesota Hockey. He also was the subject of the May 16 entry on the Minnesota Lawyer blog site.

BTI Reports that Jenner & Block is Once Again Named to its “Power Elite” List
The BTI Consulting Group (Wellesley, MA ), the industry leader in evaluating client satisfaction for professional services, recently named Jenner & Block to its “Power Elite” list.

It is the second year in a row that the Firm has been named to The BTI Power Elite, which includes “go-to” law firms that have been identified in BTI’s research as having “higher client satisfaction” and “more often exceeds client expectations.”

According to BTI, its researchers interviewed in recent months 427 corporate counsel at large and Fortune 1000 organizations.

"Relying on their candid feedback, we analyzed the underlying strength of clients' relationships with law firms," noted Michael B. Rynowecer, President at BTI. "Clients discussed more than 350 individual firms during the course of our research. Of these, just 20 stand out for their exceptional relationships and ranking with clients. These are The BTI Power Elite."

Gregory S. Gallopoulos, Jenner & Block's Managing Partner, said the Firm's repeat appearance on the prestigious BTI list is a testament to its attorneys' ongoing commitment to client service: “Exceeding client expectations is one of the core values of the Firm, and we greatly appreciate this continued recognition from the corporate counsel community.”

Firm Urges Second Circuit to Reconsider Prior Ruling on Attorney Fee Awards, Warns of Dire Impact on Civil Rights Enforcement
Jenner & Block today filed an amicus brief urging the U.S. Court of Appeals for the Second Circuit to reconsider its recent decision suggesting that statutory attorneys’ fee awards should be reduced for litigants represented by public interest and pro bono attorneys.

The amicus brief, which was filed on behalf of 29 public interest organizations, legal service organizations, and civil rights law firms, was submitted in support of a petition for panel rehearing or rehearing en banc in Arbor Hill Concerned Citizens Neighborhood Association v. County of Albany. Jenner & Block Partner Harry Sandick and Associate Joshua Block worked on the amicus brief in collaboration with co-counsel Leon Friedman of Hofstra Law School and David Udell, Laura Abel, and Deborah Goldberg from the Brennan Center for Justice at New York University School of Law.

The Second Circuit panel’s April 24, 2007 decision propounded a market theory of attorneys' fee awards under the Voting Rights Act and 42 USC § 1988: that in calculating the fee award a court should consider “what a reasonable, paying client would be willing to pay.” Among the factors the court should consider, the panel stated, are “whether a lawyer is willing to offer his services in whole or in part pro bono, or to promote the lawyer's own reputational or societal goals.”

The amicus brief highlights the devastating practical consequences that the opinion’s reasoning could have on enforcement of civil rights laws for litigants who rely on the civil rights bar, legal service organizations. The brief argues that the court’s reasoning is inconsistent with Supreme Court and Second Circuit precedents requiring that attorneys litigating civil rights cases should receive the same fees as attorneys litigating comparable complex federal litigation. In addition, the brief contends that instead of focusing on the bargaining capabilities of a “thrifty, hypothetical plaintiff” the panel should have looked to objective criteria such as prevailing market rates. Amici argue that the panel’s approach would ironically use civic-minded attorneys to subsidize the conduct of wrong-doing defendants by reducing the amount of fees they will have to pay.

Participating amici include: the American Civil Liberties Union Foundation, the New York Civil Liberties Union Foundation, and the American Civil Liberties Union Foundation of Connecticut; Children’s Rights; the Brennan Center for Justice; Community Service Society of New York; Connecticut Legal Services; Greater Hartford Legal Aid; the Impact Fund; The League of Women Voters of New York State; Legal Services of Central New York; MFY Legal Services; the National Association of Consumer Advocates; the National Consumer Law Center; the National Employment Lawyers Association; National Senior Citizens Law Center; National Women’s Law Center; Natural Resources Defense Council; New Haven Legal Assistance Association; New York Lawyers for the Public Interest; New York Public Interest Research Group; Public Citizen Litigation Group; and the Urban Justice Center.

Gibson Dunn Adds Litigation Attorney to Los Angeles Office
Gibson, Dunn & Crutcher LLP is pleased to announce that Heiko Kai Schultz has joined the Los Angeles office as of counsel. Previously a partner with Kirkland & Ellis LLP, Schultz practices commercial litigation.

Schultz's practice covers a wide range of disputes, including commercial, intellectual property, bankruptcy, securities, accounting malpractice and environmental litigation. He has experience representing companies and individuals in the medical, financial, accounting, aircraft and electronic industries.

Recent matters include his representation of the debtors in 1,600 adversarial cases arising out of the In re Fleming Companies bankruptcy; a surgeon and inventor in a patent and contract dispute case with a medical device firm; and Arthur Andersen in an accounting malpractice case brought by Frederick's of Hollywood.

Schultz received his law degree from the University of Virginia in 1997 and a degree in history from the University of California in 1994.

Chadbourne & Parke Listed Among "Power Elite" in Survey of Corporate Counsel
The international law firm of Chadbourne & Parke LLP earned a place among the top 20 firms in the “Power Elite” ranked by The BTI Consulting Group in its new report BTI Power Rankings: The BTI Client Relationship Scorecard 2007.

The BTI results were based on interviews with 427 corporate counsel at Fortune 1000 companies. Selection criteria included primary relationships with clients, clients’ vote of confidence as a go-to law firm, clients’ enthusiastic recommendations to peers, and superior levels of client satisfaction.

“This report reflects the confidence our clients have in Chadbourne’s services,” said Managing Partner Charles O’Neill. “The quality, responsiveness and impact of our work sustains strong, on-going relationships of the type that led to our position in this important survey.”

Jim Kizziar to Chair University of Texas Law School Conference
Bracewell & Giuliani LLP partner James H. Kizziar, Jr. has been selected to chair the 15th Annual University of Texas Law School Conference. The conference will focus on Labor and Employment law and is scheduled for May 2008.

In private practice since 1978, Mr. Kizziar represents management in all aspects of labor and employment law before federal and state agencies and courts. His practice includes litigation and preventative counseling of management on issues such as discrimination, harassment, union organizing and wage-hour issues.

Mr. Kizziar previously served as chairman of The University of Texas Law School Conferences on the Americans With Disabilities Act and chairman of The University of Texas Law School Conferences on Developments in Labor and Employment Law.
