Robinson & Cole Appellate Chair Serves As Member of Faculty at Three-Day Appellate Institute
Linda A. Morkan spent three days serving as a faculty member at the Appellate Advocacy Institute, sponsored by the Connecticut Bar Association's Appellate Advocacy Committee. The Institute takes an intensive "hands-on" approach to training lawyers on how to best construct and argue state and federal appeals, with experienced appellate practitioners and state appellate judges serving as instructors and working with the students in an interactive setting.

Rice University, Fulbright & Jaworski Announce Energy Industry Board Conference
Executives and board members from international energy companies such as Anadarko, Halliburton and Shell are among those expected to lead a two-day education program for directors of global energy and chemical companies.

The inaugural Energy Industry Board Conference of the Rice University/Fulbright & Jaworski L.L.P. Corporate Directors’ Institute will allow board members from companies spanning the energy sector to gather this October at Rice University. Board members will participate in discussions led by industry leaders, experts and distinguished scholars about challenges and issues facing board members of energy and chemical companies.

“We have tailored our first director education program to provide in-depth, practical tools for energy directors to use in carrying out their board responsibilities,” said William B. Lee, associate dean for Executive Education at the Jesse H. Jones Graduate School of Management at Rice University. “In designing the program, we listened to our constituents who desire real-world, industry-specific advice. With Houston being the ‘Energy Capital of the World,’ there is no better focus for our first director education conference.”

Houston is home to more than 3,600 energy-related businesses, 13 of the nation’s 20 largest natural gas transmission companies, nearly 600 exploration and production firms and 170 pipeline operators, according to the Greater Houston Partnership. Rice University is an ideal place for industry leaders to gather in close proximity to where the action happens.

“Everyone has a vested interest in making sure the leaders of energy companies have current information to provide effective oversight,” Lee said. “At Rice, we take pride in our stature as one of the world’s pre-eminent business schools. We are uniquely positioned to work alongside Fulbright’s leading international lawyers to move corporate governance education to the next level for the leaders of the world’s top companies.”

Fulbright partner Peggy A. Heeg, who is a member of Fulbright’s Executive Committee, says the exclusive program is set up to foster an open, inquisitive and free-flowing environment in which board members can discuss the issues that impact them most directly.

“Energy and chemical company boards are faced with unique regulatory, political and public relation challenges that are not often addressed in traditional director education programs,” Heeg said. “With the rules, regulations and expectations for energy and chemical companies changing at a rapid pace, there is a need to address industry specific governance. We will move beyond theoretical discussions of corporate governance and provide board members with the tools to carry out their fiduciary and strategic oversight responsibilities.”

Among the topics that will be covered in the two-day Energy Industry Board Conference this fall are:

* Strategic planning in the energy industry: The proper relationship between the board and management
* Accounting hot topics in the energy industry
* The board’s evolving role in environmental, health and safety oversight

The program will be accredited through Institutional Shareholder Services. The accreditation is considered when it comes to rating public companies on governance structure and practices.

Beyond the Energy Industry Board Conference, the Rice University/Fulbright & Jaworski L.L.P. Corporate Directors’ Institute will offer a series of director education lectures and customized director education programs.

Cozen O’Connor Presents “Win at the Subrogation Ball Game” Seminar
Cozen O’Connor’s National Subrogation and Recovery Department recently presented its “Avoid Losses and Errors: Win at the Subrogation Ball Game” seminar, a half-day, educational legal seminar at The Diamond in Richmond, Va., home of the Richmond Braves Baseball Club.

The program was comprised of a series of substantive presentations by firm attorneys James D. Golkow, Peter G. Rossi, Mark E. Opalisky, B. Elizabeth Gast, John W. Reis and Floyd Douglas Banks. Topics discussed included:


* Basic Principles of Product Liability

* Infrastructure Failures

* Advanced Theories of Subrogation and Recovery

* Loss Site Investigation, Scene Preservation and Spoliation of Evidence

* Subrogation Jeopardy


After the program, seminar participants attended a Richmond Braves vs. Scranton Wilkes-Barre Yankees baseball game.

Shefsky & Froelich Welcomes Summer Associates
Shefsky & Froelich is pleased to welcome two summer associates to the firm.
Daniel Saeedi comes to us from John Marshall Law School, where he just completed his second year. Daniel will be working with our Litigation practice group.

Cameron Williams, who will also be a third-year law student this fall, attends Chicago-Kent College of Law. Cameron will be working with our Corporate practice group.

Mitchell Silberberg & Knupp Partners Pat Benson and Samantha Grant Selected as Two of the Daily Journal's Top Women Litigators
Mitchell Silberberg & Knupp LLP, a mid-sized law firm which has provided integrated legal and business solutions for nearly 100 years, announced that Pat Benson, a partner in the firm’s Intellectual Property & Technology practice, and Samantha Grant, a partner in the Labor & Employment practice, have been selected as two of the Daily Journal’s ‘Top Women Litigators.’

The Daily Journal received approximately 200 nominations throughout the state of California for this year’s prestigious award. The winners were selected by the publication’s editors and featured in the Los Angeles Daily Journal and San Francisco Daily Journal. Selected lawyers were based upon significant court victories over the past year, as well as for their leadership credentials, career achievements and contributions to the legal profession.

Benson was selected as one of the ‘Top Women Litigators’ for the fifth year in a row. Her receipt of the award this year was based, in part, on her advocacy skills in the high-profile copyright infringement case, Arista Records, Inc. et al v. Flea World, Inc. Filed in the New Jersey District Court, Benson won a summary judgment on behalf of 14 record companies against the operators of the largest flea market on the East Coast. Benson then successfully argued the judgment be upheld before the Third Circuit Court of Appeals – the first of its kind to hold corporate operators of flea markets liable for sales of counterfeit merchandise by individual vendors who rented space at their properties.

Grant was selected for the award, in part, for her contributions in successfully representing Warner Bros. Television Production, several writers, and an independent production company in Lyle v. Warner Bros. Television Production. The plaintiff, hired as a writers' assistant on the hit television show “Friends,” alleged that the use of sexual jokes, stories, comments and expressive gestures by the show's writers constituted sexual harassment. In a unanimous decision, the seven justices of the California Supreme Court rejected Lyle's harassment claims, ruling that because the alleged conduct was not directed at or about her, the conduct did not violate California law. The Court explained that it is not the use of sexual speech that is prohibited by state and federal employment laws but rather speech and conduct that is directed at an employee or group of employees because of their gender. Grant’s nomination comes on the heels of being named one of the “10 Up and Coming African American Lawyers to Watch” in Diversity & the Bar.

Both Benson and Grant are also known for their contributions and dedicated involvement to the legal profession. Benson lectures extensively on a variety of civil litigation matters and is the former Trustee of the Los Angeles County Bar Foundation. Grant is serving a three-year term as a Ninth Circuit Judicial Conference Lawyer Representative, is an officer of the Black Women Lawyers Association of Los Angeles, and a frequent lecturer on emerging trends in employment and labor law for a variety of legal professional organizations, including the American Bar Association.

Solheim, Laitinen and Novak obtain summary judgment for chemical treatment center under peer review statute
Larson King attorneys Mark Solheim , Steve Laitinen and Tony Novak were recently successful in obtaining summary judgment in a negligent diagnosis claim asserted against a chemical dependency treatment center. The case arose when a physician who was suspected to be abusing alcohol while on-call was required to undergo diagnosis and treatment. In the resulting lawsuit, the physician claimed that he was negligently diagnosed and that he was defamed by his employer in communications with the treatment center. In defending the treatment center, Larson King successfully argued that the parties had engaged in a qualified peer review and were entitled to immunity under Wisconsin’s Peer Review Statute. The Wisconsin Circuit Court agreed, holding that both the hospital and the treatment center were participants in a qualified peer review and were entitled to immunity.

Larson King attorneys Mark Solheim and Tony Novak obtain summary judgment for national manufacturer in defamation case on grounds of “Common Interest” Privilege
Larson King attorneys Mark Solheim and Tony Novak recently obtained summary judgment on behalf of a national manufacturing client in a defamation claim. The claim arose when several individuals engaged in dangerous activities in a populated warehouse. The involved employees were terminated for involvement in the activity and/or failure to cooperate with the Plant’s internal investigation. Plaintiff, one of the terminated employees, claimed that he was defamed during Safety Meeting held by the Plant Manager during which the Plant Manager discussed the safety implications of the behavior. Larson King argued that the Plant had a qualified “common interest” privilege in plant safety that it shared with its employees and further argued that the allegedly defamatory statements were substantially true such that no claim for defamation existed. The Wisconsin Circuit Court agreed, dismissing Plaintiff’s claims in their entirely and finding that no genuine issues of fact existed and that the Plant was entitled to summary judgment.
