Pierce Atwood LLP Hires System Engineer
Pierce Atwood LLP has hired Jim Devon as system engineer in the law firm’s IT department.

Most recently, Mr. Devon was a network administrator with the Denver, Colorado law firm Holland and Hart.

In 1996, Mr. Devon earned his bachelor’s degree from New England College in Henniker, New Hampshire. He and his family reside in Portland.

Pierce Atwood LLP is the largest law firm based in northern New England and has 120 attorneys who serve regional, national and international clients from offices in Portland and Augusta, Maine; Portsmouth and Concord, New Hampshire and Boston, Massachusetts.

T&K Attorney Recognized as 2007 Outstanding Tax Lawyer
The international law firm of Thompson & Knight is proud to announce former Managing Partner Buford P. Berry has been selected as the recipient of the 2007 Outstanding Texas Tax Lawyer Award. The award is bestowed by the State Bar of Texas Section of Taxation for a lifetime of significant contributions and experience relating to taxation law and will be presented at the Texas Tax Institute in San Antonio, Texas, on Friday, June 8.

Mr. Berry began his legal career in 1963 at Thompson & Knight in Dallas. He served as the Firm's Managing Partner from 1986-1998, and has a national reputation as one of the top oil and gas tax lawyers and tax litigation lawyers in the country. Mr. Berry has represented large corporate taxpayers, including Texaco Inc., Sun Oil Co., Gulf Oil Corporation, Hamilton Brothers, Hermes, Mapco, and Texas Instruments, Inc. During his career, he has been involved in 37 reported tax cases, of which, a number involved precedent setting issues in the petroleum industry and other areas of tax law; examples include Sun Company Inc. v. Commissioner, which established for the oil and gas industry that the costs of drilling offshore exploratory oil wells are deductible as intangible drilling costs, and Texas Inc. v. Commissioner, which involved the transfer pricing of Saudi Arabian crude oil over the period 1979-1981 and was the largest alleged tax deficiency ever before the Tax Court to date. He currently serves as Of Counsel at Thompson & Knight, a Director of Holly Corporation, and an Independent Manager of Dorchester Minerals Management L.P.

Additionally, Mr. Berry is a Fellow of the American College of Tax Counsel, the American Bar Foundation, and the Texas Bar Foundation. He was very active in the American Bar Association Tax Section and served as Chair of the Natural Resources Committee. He also served as Chair of the Southwest Legal Foundation Oil and Gas Institute and as the Vice Chair of the Advisory Board of the Institute for Energy Law of the Center for American and International Law.

T&K Attorney Publishes Article on Government Funding of Clean Coal
As in every policy debate, in many ways it comes down to how to finance solutions. Funding clean coal technology and infrastructure suggests a new conceptual approach to address the challenge of foreign sources of hydrocarbons and emissions of carbon dioxide. The new concept that should be considered is government funding in whole or in part of an infrastructure to capture carbon emissions from coal-fired power plants" according to Thompson & Knight Partner Scott D. Deatherage. Deatherage's article, "How Government Can Help Finance Clean Coal," was published in the May 23, 2007 issue of Energy Law360.

The article discusses ways to fund the development of regional CCS (carbon capture and storage) facilities and the construction of pipelines to bring emissions to CCS facilities from power plants, refineries, and other major CO2. Deatherage explains how the establishment of such a program "could be a model for other countries and could serve as a significant part of any negotiations over post-Kyoto climate change agreements."

He suggests various ways Congress could consider funding this program, including what he calls "carbon bonds," and he hopes "Congress and the White House will include carbon capture and sequestration in the debate over how to reduce greenhouse gas emissions and dependence on foreign sources of oil and natural gas."

According to Deatherage, "as our country looks for ways to reduce our dependence on foreign oil, coal seems, from an importation and abundance perspective, to be a desirable alternate energy source. Finding a solution to the coal-climate conundrum would appear to be a major issue for government and private industry. Climate change and dependence on foreign oil are converging as a unified concern."

Deatherage focuses his practice on permitting, compliance, administrative law, and judicial litigation in environmental matters. In the area of environmental management and corporate governance, he has counseled companies on reporting protocols to boards of directors, development or review and revision of environmental management systems, compliance audits, and developing operating procedures and policies to address environmental issues.

He is heading the Firm's new Climate Change and Renewable Energy Practice.

Additionally, Deatherage authors two blogs relating to the environment. One blog is entitled "The New Carbon Cycle," http://lawandenvironment.typepad.com/newcarboncycle/. Here he offers news and analyses of the rapidly evolving law and policy surrounding carbon trading and markets, climate change, and renewable energy. On his other blog "Law and the Environment," http://lawandenvironment.typepad.com/, he publishes articles, commentary, and analyses of the ever-evolving legal, policy, and practical developments in environmental law, management, corporate governance, and financial disclosure. This blog also discusses how affected corporations as well as their management and directors are evolving to survive and prosper in this dynamic regulatory environment.

Jerry Comizio Quoted on Lake Shore Bancorp's Stock Compensation Plans
Jerry Comizio was quoted in the article, "Lake Shore stockholders defeat exec pay proposals," regarding Lake Shore Bancorp's investors' vote against proposed amendments to the company's stock compensation plans. Jerry Comizio defended the proposed amendments as commonplace, "Hundreds if not more federal thrifts subject to this process have routinely adopted such amendments. To characterize adoption of these amendments as a surprise has to be compared to the overwhelming track record of thousands of shareholder votes. The board is required to obtains shareholder approval at least two times.

Doug Lineberry Receives Forty Under 40 Award
The Charleston Regional Business Journal has selected Douglas Lee Lineberry as a 2007 Forty Under 40 Award winner, an annual honor that recognizes those under the age of 40 who capture the spirit of volunteerism as well as the dynamism of Charleston's business community.

The honorees are chosen by a panel of past Forty Under 40 winners who judge nominees on three criteria: career accomplishments, professional expertise and community and charitable involvement.

Mr. Lineberry is a partner in the Charleston office who practices in the areas of business and employment litigation, intellectual property, and ERISA benefits. A member of the South Carolina Bar, he is admitted to practice before the United States Patent and Trademark Office and the U.S. District Court for the District of South Carolina.

Mr. Lineberry is a member of the American Bar Association, the Charleston County Bar Association, and the South Carolina Defense Trial Attorneys' Association. He has taught numerous CLE presentations and authored several articles.

In 1998, Mr. Lineberry earned a Juris Doctor from the Walter F. George School of Law at Mercer University. During law school, he was a member of the Gabrielli Domestic Relations Moot Court Team that won Best Team and Best Brief awards at the National Domestic Relations Moot Court Competition. He was also a member of Phi Delta Phi (vice president, 1996-98), the Student Activities Committee (chair, 1996-98), the Student Bar Association (representative, 1995-96), the Florida Workers Compensation Moot Court Team, and the Mercer Moot Court Board (Selection Committee). Mr. Lineberry earned a Bachelor of Science in Biology and a Bachelor of Arts in Chemistry, summa cum laude, from Emory & Henry College in 1995.

Three Nelson Mullins Paralegals Honored for Pro Bono Work
Whitney Horn of Charleston, Leslie Sackett of Columbia, and Janice Morreale of Myrtle Beach received the 2006 E.W. Mullins Sr. Paralegal Pro Bono Awards during the Firm's recent paralegal retreat.

Ms. Horn was recognized for her work assisting Cherie Blackburn and Stephanie Lewis in a case involving an Ethiopian who had been fired as a Human Resources manager.

Following his termination there were allegations that he broke into the facility and statements by the manager that he was "one of them" (referring to 9/11 terrorists). The Firm received the case just before trial, but the litigation had been going on for five years. The case involved claims for defamation and breach of contract. Ms. Horn spent countless hours getting the case ready for trial in a very short time period. The trial lasted 10 days, with Ms. Horn keeping attorneys organized, dealing with witnesses, handling deposition designations and other matters with opposing counsel. The jury returned a verdict in favor of the Firm's client for $307,000 on the defamation claim. Ms. Horn also assisted attorneys representing indigent individuals through the Crisis Ministries Legal Clinic and recorded 453 pro bono hours in 2006.

Ms. Sackett was recognized for her work representing a client who was informed by the S.C. Department of Health and Human Services that she was no longer eligible for Medicaid Waiver services to live in a group home. The client had been receiving services under this waiver based on medical information that she was mentally retarded and had a related disability. The S.C. Department of Disabilities and Special Needs later determined she did not have a severe enough disability and that her waiver would be taken away. Ms. Sackett worked extensively to organize the records gathered by co-counsel and prepared documents to be used by experts and witnesses in a five-day hearing. An appeal was filed after the hearing, and Ms. Sackett was instrumental in gathering information from a multi-volume Record on Appeal for a 76-page initial brief and 25-page reply brief. In addition, she compiled information for a PowerPoint presentation for an oral argument in front of the administrative law judge. Ms. Sackett recorded 518 pro bono hours in 2006.

Ms. Morreale was recognized for her work with attorney Tom Moran in handling the estate of a victim on behalf of the children. Ms. Morreale worked with Mr. Moran on every aspect of the probate pro bono matter. She helped open the estate and set up conservatorships for two minor children. She arranged for funds to be received through the S.C. State Office of Victim Assistance. She negotiated with creditors, assisted in obtaining life insurance proceeds, and handled many other probate issues.

The awards are named for Ed Mullins Sr., a founding partner at Nelson Mullins, and honor paralegals who exemplify the Firm's commitment to pro bono service.
