Robert Wilens Wins Victory Against Jomar International
Partner, Robert Wilens, received a jury verdict in Springfield, MO for $408,727.41 against Jomar International, the manufacturer and distributor of the Add-A-Valve. The case involved a 1" copper pipe dislodging from one end of an Add-A-Valve that had been installed 6 months prior to the incident on the 5th Floor of Cox Hospital in Springfield, MO. The incident caused a release of hot water, causing property damage to 4 floors of the hospital and a small BI loss. The hospital and the insurer were both named as Plaintiffs. The allegations included an improper installation by Jess Wood Plumbing and Heating, a local Springfield company, and strict liability and breach of warranty against Jomar.

The jury found that the Add-A-Valve had defects in that the cutter took too much of the copper pipe when it cut thus leaving the remaining bridges vulnerable to breakage due to loads. The jury also found that the valve body did not have a barb or other mechanical device to keep the copper pipe within the valve body, if the bridges broke after the pipe was cut and the valve was installed. The jury was also critical of Jomar for not keeping a better paper trail for its development and testing of the valve. The installer, Jess Wood Plumbing, was found not guilty, despite failing to use pipe hangers to support the line, and using both sealants provided, Teflon and Tighter Than Tight; both contrary to the instructions provided by Jomar.

Cadwalader Adds Special Counsel
Cadwalader, Wickersham & Taft LLP, one of the world’s leading international law firms, announced the recent hires of Special Counsel Jonathan S. Kanter, Anthony V. Nanni, and Erik Remmler

Jonathan S. Kanter joins Cadwalader’s Antitrust Group in Washington, D.C. He will counsel clients in the full range of antitrust matters, with a specific focus on mergers and acquisitions, joint ventures, and investigations by the U.S. Department of Justice and the U.S. Federal Trade Commission. Prior to joining Cadwalader, Mr. Kanter worked as an antitrust attorney in the Washington, D.C. office of Fried, Frank, Harris, Shriver and Jacobson LLP. Mr. Kanter also worked for the Federal Trade Bureau of Competition, where he investigated a number of significant mergers and acquisitions. He has antitrust experience in a variety of industries, including software, Internet -related products and services, lodging, gaming, media, cable, consumer products, pharmaceutical, retail, semiconductor, and oil. Mr. Kanter served as Associate Editor of, and was a regular contributor to, The Party Line, a publication of the American Bar Association’s Section of Antitrust Law, Communications Industry Committee. He received his J.D. from Washington University and his B.A., cum laude, from the State University of New York at Albany.

Also joining the Antitrust Group is Anthony V. Nanni who concentrates in federal antitrust and fraud investigations and prosecutions involving both corporate and individual clients. He has provided antitrust counseling and conducted intensive internal investigations for numerous major corporations. Prior to joining Cadwalader, Mr. Nanni was Of Counsel to Fried, Frank, Harris, Shriver and Jacobson LLP. From 1985-2002, he served as Chief of the National Criminal Enforcement Section (formerly Litigation) in the Antitrust Division of the U.S. Department of Justice. While he held this position, he was awarded the Presidential Rank Award of Distinguished Executive, as well as the Neil Roberts Award for Excellence in Antitrust Enforcement. He began his career as a trial attorney in the New York office of the Antitrust Division. Mr. Nanni received his J.D. from Fordham University School of Law, where he was a member of the Law Review, and his B.E.E. from Rensselaer Polytechnic Institute, where he was awarded Tau Beta Pi honors.

Erik Remmler rejoins the firm’s Capital Markets Department in New York. With more than fifteen years of capital markets experience, he has developed expertise in a number of areas, including derivatives, public finance, health care finance, credit enhancement, project finance, and turnkey facility contracts, among others. Mr. Remmler will focus his practice on the development, negotiation, and documentation of various financial products, including interest rate derivatives, liquidity facilities, credit enhancement, total return swaps, forwards, and other structured products. Previously, Mr. Remmler served as Special Counsel in Public Finance at Sidley Austin LLP and in the municipal derivatives group at Cadwalader. He received a B.A., with honors, from the University of Chicago and a J.D. from Pace Law School, where he was a member of the Law Review

Thomas J. Bonasera Elected to the Ohio State Bar Association’s Council of Delegates for District 7
The law firm of Buckingham, Doolittle & Burroughs, LLP is pleased to announce that Thomas J. Bonasera has been elected to the Ohio State Bar Association’s Council of Delegates for District 7, which is comprised of Franklin County. Mr. Bonasera was one of fifteen members of the Council elected based on a vote by all of the members of the Ohio State Bar Association in Franklin County. His two-year term will commence on July 1, 2007. Mr. Bonasera has been a member of the Council of Delegates since 1986.

The Council of Delegates reviews proposed legislation and court rule changes recommended by OSBA sections and committees. They also decide broad questions of policy sometimes referred to them by the Board of Governors.

Mr. Bonasera is a Shareholder in BDB’s Columbus office, focusing primarily on trust and estate administration and litigation, estate planning and closely held business matters. Mr. Bonasera advises his clients on a broad range of trust and estate planning and litigation matters, obligations and liabilities of trustees and other fiduciaries and trust and estate beneficiary rights and closely held business matters including business disputes.

Mr. Bonasera earned his J.D., with honors, from Capital University Law School (1975). In addition, he received his B.S. from The Ohio State University (1970). Mr. Bonasera currently serves on the boards of the American Red Cross of Greater Columbus, the Legal Aid Society of Columbus as President-Elect, the Franklin County Alcohol, Drug Addiction and Mental Health Board as Chair and the Ronald McDonald House Charities of Columbus, where he is the immediate past president. Mr. Bonasera is a former Board Member of the Alzheimer’s Association of Columbus and he has served as past president of the Columbus Bar Association and the Ohio State Bar Association. He has been recognized as a Super Lawyer by the publishers of Law & Politics a Cincinnati Magazine, as one of the Best Lawyers in Columbus by Columbus’ Business First and a Top 50 Lawyer in Ohio.

Mr. Bonasera resides in Columbus, Ohio with his wife, Julie.

Greenberg Traurig Expands its Albany Office with the Addition of Kevin M. Lang
The international law firm Greenberg Traurig, LLP announced today that Kevin M. Lang has joined its Albany office as Of Counsel in the Energy and Natural Resources Group. Prior to joining Greenberg Traurig, Kevin was a Managing Attorney at the New York State Department of Public Service. Kevin concentrates his practice in the energy and public utility fields, representing clients in regulatory, siting, other administrative, and judicial proceedings and providing advice on their energy-related issues. In his nine years with the Department, Kevin litigated major rate cases filed by two of New York's largest electric and gas utilities and proceedings involving the siting of major electric generating facilities across the State. He was lead attorney on regulatory matters involving New York's largest electric and gas utility, including prosecuting a prudence proceeding against that utility involving the Indian Point 2 Nuclear Generating Station. He was also lead attorney on proceedings involving the divestiture of the utilities’ generating facilities and was instrumental in the sales of the utilities’ nuclear generating facilities.

Kevin also represented the Public Service Commission in federal and state judicial proceedings, primarily defending the Commission’s decisions from legal challenges. As Managing Attorney, he was responsible for regulatory proceedings involving New York's natural gas and water utilities, supervised the attorneys assigned to those proceedings, and developed legal and regulatory policies for issues confronting those utilities. Prior to joining the State, Kevin's practice focused on tax certiorari and commercial litigation. He represented electric and gas utilities, pipelines, and telecommunications companies operating in New York State in tax certiorari proceedings and on related matters.

Simpson Thacher Represents the Managers in a $300 Million Convertible Bond Offering by Taiwan High Speed Rail
Simpson Thacher recently represented Deutsche Bank and several other managers in a $300 million offering by Taiwan High Speed Rail Corporation of Zero Coupon Convertible Bonds due 2012. Taiwan High Speed Rail owns and operates the recently opened 345 kilometer high speed (maximum speed of 305 kilometers per hour) rail along the Western corridor of Taiwan pursuant to a 35-year build-operate-transfer agreement with the government of Taiwan. The $15 billion High Speed Rail represents a significant and technically challenging infrastructure project for Taiwan. The transaction is believed to be the first fully marketed pre-IPO convertible bonds by a Taiwan issuer. The transaction is also a rare marketed convertible bond deal to finance a project.

The Simpson Thacher team for this transaction included Chris Lin, Gene Buttrill and Townshine Wu.

Sidley Austin LLP Ranks Second in 2007 BTI Power Rankings
Sidley Austin LLP announced today that the law firm has been ranked second in the 2007 BTI Power Rankings: The BTI Client Relationship Scorecard, a survey of corporate counsel at large and Fortune 1000 companies. The firm was also named to the prestigious BTI Power Elite group for the third consecutive year, one of only 12 firms to do so. Sidley was awarded first place in the BTI Power Rankings in 2006.

The BTI Power Rankings reports market position among law firms based on client relationships. The 2007 rankings are based on interviews with 427 corporate counsel that determine number, strength and quality of client relationships. In this year’s rankings, Sidley had the most primary relationships and tied as the firm with the most unprompted recommendations.
