K&L Gates’ Finance Practice Continues Growth with Addition of Partner Sean E. Hayes
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) welcomes partner Sean E. Hayes to its finance practice. Hayes joins the firm from Morgan Lewis & Bockius LLP.

Hayes represents private equity sponsors, issuers, and underwriters in debt and equity transactions primarily in connection with leveraged finance transactions. His particular focus is on high yield debt offerings. Hayes also represents public and private companies in straight debt and equity offerings and counsels clients on covenant interpretation and corporate governance issues.

K&L Gates’ Washington Offices Combine on K Street
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) has combined its legacy Washington, DC offices, bringing together more than 200 experienced lawyers and government affairs professionals. It is now one of the 20 largest law offices in the District of Columbia.

K&L Gates’ Washington office is known nationally for its work in the diversified financial services area and offers one of the largest such practices in the country. It includes a preeminent investment management practice and one of the country’s largest mortgage banking/consumer credit groups. The firm’s premier bipartisan public policy and lobbying group, the majority of which had practiced for three decades as Preston Gates Ellis Rouvelas & Meeds LLP prior to January 2007, has made K&L Gates the fifth-largest lobbying firm in the nation.

Arrival of Washington Partner Boosts K&L Gates’ Energy Practice
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) welcomes partner Andrew B. Young to its energy practice. Young comes to the firm from White & Case LLP.

Young’s practice focuses on regulatory and transactional aspects of the energy industry, including the representation of electric utilities, transmission providers, independent power producers, power marketers, qualifying facilities, public utility holding companies, large consumers, and debt and equity investors in a variety of matters. He routinely practices before the Federal Energy Regulatory Commission, the U.S. Department of Energy, a variety of state utility commissions and federal courts.

Mintz Levin Expands New York Real Estate Practice
Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C., a full-service, 480-lawyer AmLaw 100 firm with offices throughout the U.S. and in the U.K., announced that Jeffrey M. Schwartz, a veteran real estate attorney, has joined the firm's New York office as a member practicing in the Real Estate Section. Prior to joining Mintz Levin, Mr. Schwartz was a partner at the law firm of Wolf Haldenstein Adler Freeman and Herz, LLP.

Over the course of his career, Mr. Schwartz's practice has focused on transactional matters in both the commercial and residential real estate industries. His wide-ranging experience includes dealing with issues such as the financing, leasing, acquisition and sale of commercial properties, as well as the operation, conversion, development and sale of residential properties. Mr. Schwartz is also counsel to a significant number of cooperative and condominium buildings throughout the metropolitan area.

In recent years, Mr. Schwartz has chaired symposiums on commercial leasing and the purchase and sale of real estate in New York. A member of the New York State Bar Association's Committee on Cooperatives and Condominiums, Mr. Schwartz has also served on the New York City Bar Association's Committee on Cooperatives and Condominiums.

"Jeff's expertise and knowledge of both the commercial and residential real estate markets enhances our existing capabilities in the New York metro area and builds upon our ability to service our clients nationally," said Robert I. Maxwell D. Solet Named Chair of IRS Advisory Committee on Tax Exempt and Government Entities
Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. attorney Maxwell D. Solet has been appointed the Chair of the Internal Revenue Service's Advisory Committee on Tax Exempt and Government Entities (ACT) for 2007-2008. A member of the committee for the past two years, Mr. Solet served as one of three tax-exempt bond representatives.

Established in May 2001 under the Federal Advisory Committee Act, the ACT is comprised of 21-members appointed by the Secretary of the Treasury upon the recommendation of Senior IRS officials. It provides an organized public forum for discussion of relevant issues affecting the tax exempt and government entities. The ACT is a formal body of external stakeholders and representatives who give regular input with respect to the development and implementation of tax policy concerning employee plans, exempt organizations, tax-exempt bonds and federal, state, local and Indian tribal government issues.

"Mike's appointment to the chair of this national committee is a well deserved honor for him and brings great distinction to the firm's public finance practice" said Rich Moche, Chair of the firm's Public Finance Section. "The committee will benefit greatly from Mike's distinct leadership ability and vast experience."

Mr. Solet is a member in the firm's Boston office, where he practices in both the Tax and Public Finance Sections. He has principal tax responsibility in connection with the firm's role as bond counsel, underwriter's counsel and bondholders' counsel on numerous state and local bond issues. Mr. Solet has also represented a large number of multi-state companies in connection with Massachusetts tax issues, primarily involving the corporation excise (income) tax and sales and use taxes.

Mr. Solet is a past chairman of the Tax Section of the Boston Bar Association and chairman of its State Tax Committee and its Subcommittee on Multistate Taxation. He is a member of the Steering Committee for the Annual Bond Attorneys Workshop sponsored by the National Association of Bond Lawyers. He received his A.B., magna cum laude, from Harvard College (1970), and his J.D., cum laude, from Harvard Law School (1974).

Danbury Bar Association Awards Atty. James Wu For Pro Bono Work
The Danbury Bar Association has cited Atty. James Wu, of counsel at Koskoff, Koskoff & Bieder, for his exceptional pro bono service in the community.

Wu was given the association’s annual Pro Bono Award as a result of his providing several hundred hours of free service over more than two years by assisting clients of a deceased lawyer.

The plaque that cites Wu reads, “In recognition of your efforts to provide equal access to justice."

Wu, a resident of Litchfield, Connecticut, manages the KK&B Danbury office. He concentrates his practice on personal injury resulting from automobile and motorcycle crashes, property hazards, dog attacks and falls. Wu is known for his effective courtroom advocacy as well as his negotiating skills. He is a former partner at the Waterbury firm of Carmody & Torrance.

Harris Beach Launches Diversity Compliance Counseling Service To Help Organizations Meet New York State’s MWBE Requirements
The law firm of Harris Beach PLLC has launched a significant initiative to help businesses and organizations interested in procuring New York state contracts to meet the state’s new agenda of increasing the utilization of qualified Minority and Women-Owned Business Enterprises. Governor Eliot Spitzer signed an executive order in February 2007 creating an Executive Leadership Council and Corporate Roundtable to promote opportunities for minority and women owned businesses. The executive order noted that three percent (approximately $445 million) of the state’s contracts (approximately $11 billion) were awarded to minority and women owned businesses during fiscal year 2005-2006.

The Harris Beach Diversity Compliance Team advises minority and women owned businesses, as well as majority owned businesses on New York state’s diversity compliance requirements in the procurement process. The Diversity Compliance Team also provides advice to local municipalities, including school districts, on diversity compliance issues related to public projects.

Leading the Harris Beach team is H. Todd Bullard, a member of the firm who practices in the Public Finance & Economic Development and Business & Commercial Litigation Practice Groups. In the economic development and public finance area, Mr. Bullard advises municipalities and public benefit corporations, and contractors conducting business with state agencies and local municipalities. Mr. Bullard served as legislative majority counsel to the Erie County legislature, and in that capacity, he was the primary drafter of a local law which addresses the utilization of minority and women-owned businesses in Erie County. He is currently involved in drafting the Rochester City School District’s Facilities Modernization Project Act. Mr. Bullard is also involved in assisting in the drafting of the M/WBE and DBE diversity compliance policy for Monroe County to ensure contractors involved in Renaissance Square meet the goals associated with Minority and Women Owned Business Enterprises and Disadvantaged Business Enterprises. Mr. Bullard also advises minority-owned contractors involved in public projects.

Mr. Bullard said: “New York state is serious about enforcing its Minority and Women-Owned Business Enterprise Program. All state agencies under the direction of MWBE Development Executive Director Michael Jones-Bey will have to measure their procurement practices to meet MWBE utilization. This new era of accountability creates tremendous opportunities for businesses throughout New York state.
