Blackwell Attorneys Negotiate Aircraft Purchase Agreement
Blackwell Sanders attorneys David Agee and Britton Gibson recently represented Executive AirShare Corporation in the negotiation of an agreement with Embraer, a Brazilian aircraft manufacturer, for the purchase by Executive AirShare of seven new Embraer Phenom 100 very light jet (VLJ) aircraft and options to acquire seven additional Phenom 100 jets. The total value of the order, assuming the exercise of all option aircraft, is estimated at approximately $40 million based upon 2005 list prices. Delivery of the first aircraft is scheduled for Summer 2010.

With its current 12 aircraft fleet, Executive AirShare is one of the nation’s largest regional fractional aircraft ownership companies with clients in Kansas, Missouri, Oklahoma and Texas.

David Agee is the group leader of Blackwell Sanders’ aviation practice area which provides counsel for commercial airlines and a variety of business aircraft owners and operators, including charter operators and aviation maintenance and support facilities.

AKIN GUMP EXPANDS IP PRACTICE IN SILICON VALLEY
Intellectual property litigator Steven D. Hemminger has joined Akin Gump Strauss Hauer & Feld LLP as a partner in the Silicon Valley office, the firm announced today.

Mr. Hemminger’s practice encompasses all aspects of intellectual property protection, including litigation of patent, trademark and trade secret cases in the electronics, semiconductor, and computer software and hardware fields. During the course of his 20+-year career, he has litigated more than 35 major IP cases in numerous jurisdictions.

“Steve’s extensive experience related to infringement and validity analyses, and the licensing of international IP portfolios, will be of tremendous value to our clients, said R. Bruce McLean, Akin Gump’s chairman. “The addition of another first-chair IP litigator to our Silicon Valley team complements our goals of continuing to strategically grow our Silicon Valley office and IP practice, while simultaneously building upon our already strong international depth of expertise.”

Mr. Hemminger also manages patent and trademark portfolios related to wireless telephony and LANs, computers, mechanical devices and medical devices in the U.S. and foreign patent offices, and counsels clients on international licensing of intellectual property portfolios.

“I was impressed by Akin Gump’s efforts to expand the Silicon Valley IP practice, particularly with the number and quality of active patent litigation successes the firm has achieved in a relatively short period of time,” noted Mr. Hemminger. “I've been practicing IP law in Silicon Valley for over 20 years, and Akin Gump seems to have found the right formula. Mr. Hemminger received his B.S. in mechanical engineering from the Rensselaer Polytechnic Institute in 1974 and his J.D. magna cum laude from the Southwestern University School of Law in 1983. He joins Akin Gump from White & Case in Palo Alto, where he was a partner. He began his career at Lyon & Lyon, where he was the managing partner of its Silicon Valley office.
