Walter D. Cupkovic Recognized as one of the Top Commercial Real Estate Lawyers
Chairman of FagelHaber LLC's Real Estate and Real Estate Tax Assessment Departments, has been recognized by Midwest Real Estate News as one of the top commercial real estate lawyers. The honor was announced in the publication's May 2006, "Best of the Best" issue. Midwest Real Estate News is the region's premier commercial real estate magazine, distributed to more than 18,000 commercial real estate professionals across the Midwest each month.

Mr. Cupkovic has over 25 years of legal experience in the acquisition, development and sale of commercial, industrial and residential properties for corporate and real estate clients nationally and internationally. He further assists clients with the resolution of title, environmental and governmental issues arising out of such transactions, and leasing of commercial and industrial properties, representing both landlords and tenants.

In addition, he has reviewed and negotiated numerous construction contracts, construction loan documentation and has prosecuted a substantial number of construction claims, including mechanics’ lien and surety bond claims, many of which have involved complex bankruptcy issues.

FagelHaber LLC and the St. Louis law firm of Thompson Coburn LLP will merge to create a major presence in two of the region’s largest business centers. The merger will create a 330-lawyer firm, and give Thompson Coburn a significant presence in the Chicago legal market. FagelHaber and its clients will benefit from having access to a broader range of practice groups.

Robin L. Cohen Named One of The Nation’s Most Influential Female Lawyers
Robin L. Cohen, Managing Partner of Dickstein Shapiro LLP’s New York office and a partner in the Insurance Coverage Practice, has been recognized as one of The 50 Most Influential Women Lawyers in America by the National Law Journal. This prestigious list acknowledges female attorneys who have had a national impact in their field and exhibit a demonstrated power to change the legal landscape.

As one of only a limited number of female managing partners nationwide, Ms. Cohen is among an elite group of attorneys. Within the firm, she serves on the compensation committee and leads an office of more than 100 attorneys. In addition to her leadership role, she is a widely known insurance coverage litigator. Ms. Cohen also is a distinguished national advocate for the advancement of women. Ms. Cohen litigates some of the most significant, cutting-edge insurance coverage cases, having recovered more than $1 billion for her clients, including through settlements and trials, where her trial teams have obtained substantial judgments against insurers.

Dechert LLP

Dechert LLP Advises on Key Cross Border Media Acquisition
International law firm Dechert LLP represented Index Ventures, the founders and other selling shareholders in Last.FM, the leading London-based music and social networking site acquired by media giant CBS Corporation for US$280m, making it the largest UK Web 2.0 acquisition to date.

Last.FM was founded in the UK in 2002 and is now the the world's largest social music platform and has more than 15 million active users in over 200 countries, including almost 2 million in the UK and some 3.5 million in the US. It allows users to connect with other listeners with similar music tastes, to custom-build their own radio stations and to watch music video-clips. As part of the acquisition, the Last.FM management team, including founders Felix Miller, Martin Stiksel and Richard Jones, will continue independently to run the online network. CBS radio is the largest radio group in the United States, with 179 stations in the top 50 markets covering news, rock, country and urban music.

Last.FM founding member Martin Stiksel said the deal proved that Web 2.0 companies did not have to be based in the United States to succeed: "Being in London has helped us; it's the best place to do things with music full stop. It's the place that leads the world."

The Dechert LLP team advising the Last.fm selling shareholders was led by London corporate partner Graham Defries, assisted by Mark Taylor, David Willbe and Arabella Ure. A team from Weil Gotshal led by Mike Francies advised CBS on the transaction.

Rothgerber Johnson & Lyons

RJ&L Attorneys Win Client's Appeal to Wyoming Supreme Court
Congratulations are in order for Rothgerber Johnson & Lyons LLP's client, Colorado Casualty Insurance Company, which prevailed on a recent decision issued by the Wyoming Supreme Court regarding the scope of coverage of replacement cost insurance policies.

In the appeal handled by RJ&L attorneys Brian J. Spano and Stephen E. Csajaghy (and argued before the Supreme Court by Brian Spano), the Wyoming Supreme Court reversed an Order entered by the trial court, and determined that the trial court improperly determined that the Plainitff was entitled to a depreciation holdback under the Policy. The Supreme Court remanded the case to the trial court for further proceedings, and held that the the clear language of the Policy demonstrates that the Plaintiff may only recover those amounts that he "actually and necessarily" expended for property that was "lost or damaged" in a fire. The decision is available at 157 P.3d 460.

Jack Proud, an associate with Porter Wright Morris and Arthur, was recently named the Chairman of The University of Dayton Board of Trustees. Mr. Proud, who begins his term in July, is an alumnus of The University of Dayton and a current Trustee. Mr. Proud is a former president of the University of Dayton Alumni Association as well as a former chairman of the University of Dayton Leadership with Virtue Award and Symposium.
