Michael W. McNatt Joins Roetzel & Andress as a Partner in the Orlando Office
The law firm of Roetzel & Andress is pleased to announce Michael W. McNatt has joined the Orlando office as a partner.

With a practice focusing on real estate, banking and finance, Mr. McNatt brings to the firm extensive experience in a developing area of law—green or sustainable development. He counsels clients in all aspects of sustainable development that arise during site location and acquisition, construction, financing and leasing. The concepts of sustainable development have been shown to boost productivity and reduce employee absenteeism by maximizing the use of natural light, fresh-air ventilation and eliminating toxins through emission-free paints, carpets and other interior components. It also decreases energy consumption and thus lowers operating costs.

Currently, Mr. McNatt serves as lead counsel for a 170,000 square foot commercial office development that is the first project to achieve Leadership in Energy and Environmental Design (LEED) Platinum pre-certification in Florida. LEED is the nationally accepted benchmark for the design, construction and operation of high performance green buildings, issued by the U.S. Green Building Council; Platinum certification is the highest level of LEED certification.

Stated Michael S. Yashko, Partner-in-Charge of the Orlando office, “Mike is a welcome addition not only to the Orlando office, but also to the firm as a whole. His experience with green and sustainable development issues will position Roetzel & Andress in the forefront of this rapidly growing area of law. In addition to his green and sustainable development focus, Mr. McNatt has significant real estate development experience in acquisition, financing, leasing and all phases of development of commercial, residential, office and mixed-use projects. As a former corporate lender for a large Florida bank, he has represented both lenders and borrowers in complex loan transactions. He also counsels clients on general corporate matters.

Mr. McNatt earned his juris doctorate with honors from the University of Florida College of Law. He received an M.B.A from the University of Florida and a B.B.A, cum laude, from Stetson University.

Firm's Attorney Patricia Yoedicke Honored with an American Bar Association Pro Bono Publico Award
Robins, Kaplan, Miller & Ciresi L.L.P. is pleased to announce that Patricia Yoedicke, an attorney in the firm's Minneapolis office, is the recipient of the Ann Liechty Pro Bono Award, a special American Bar Association Pro Bono Publico Award honoring a lawyer who has provided outstanding pro bono legal services to children in custody or adoption cases. Ms. Yoedicke will receive the honor during the Pro Bono Publico Awards Assembly Luncheon at the Moscone West Convention Center on Monday, August 13, 2007 during the ABA Annual Meeting in San Francisco.

"We are so pleased that Pat has been selected as this year's recipient of this prestigious award," says Katie Crosby Lehmann, chair of the firm's Pro Bono Committee. "Pat embodies the firm's commitment to pro bono work with her undeterred passion to fight for the rights of children, one of the most vulnerable groups in our society. She works tirelessly to advocate for her pro bono clients with care and compassion making her truly deserving of this honor."

Ms. Yoedicke has logged more than 800 pro bono hours representing children through the Children's Law Center of Minnesota, an organization which assists volunteer attorneys in advocating for children in foster care. Over the past six years, she has represented several state wards-children whose parents' rights have been terminated. For some of these children, Ms. Yoedicke is one of the few constants in their lives. She often drives more than 90 minutes and over state lines to see a case through. As examples of her efforts, she helped to keep sisters placed together after a potential adoptive parent proposed to take only one of them. She secured special tutoring for a high school client who had difficulty reading, and was later invited to the graduation ceremony and took the only picture that her client has of that momentous occasion. She has helped several clients to get adopted by the persons of their choice.

In addition to her work with the Children's Law Center of Minnesota, Ms. Yoedicke has also served as an Attorney Coach for South High's Mock Trial Team, an inner-city public school. South High won the Minnesota State Championship and went on to National Competition in five of the eight years she served as coach. She also worked as the firm's coordinator for the Lawyers for Literacy Project and served as a board member, legal counselor and peer counselor for the Chrysalis Center for Women.

Ms.Yoedicke focuses her practice on Personal Injury, Products Liability and Wrongful Death. She received her undergraduate degree, with distinction, from Stanford University and her J.D., cum laude, from the University of Minnesota Law School. She is admitted to the Minnesota State Bar, U.S. Court of Appeals, Eighth Circuit and the U.S. District Court, Minnesota.

About the Pro Bono Publico Awards

The Pro Bono Publico Awards were established by the American Bar Association in 1984 to recognize lawyers and law firms for extraordinary noteworthy contribution to extending legal services to the poor and disadvantaged. The recipients exemplify the volunteer tradition of the legal profession. The Association's Standing Committee on Pro Bono and Public Service administers the program.

Jones Day Obtains Supreme Court Win in Title VII Pay Discrimination Suit
In an important decision for employers, the Supreme Court held on May 29, 2007 that Title VII bars a private plaintiff from bringing an intentional pay discrimination claim challenging pay decisions that occurred outside of the statutory limitations period, even if those decisions continue to have adverse effects on paychecks received during the limitations period. The petitioner, Lilly Ledbetter, worked for Jones Day's client, The Goodyear Tire & Rubber Company, Inc., for 19 years. During that time, several different managers made discrete annual decisions regarding what merit increase Ledbetter should receive in her salary. Ledbetter filed an EEOC charge, and subsequently a complaint, challenging the cumulative effect of these 19 years of salary determinations and asserting, among other things, an intentional pay discrimination claim under Title VII. The Supreme Court rejected Ledbetter's argument that she could bring an intentional pay discrimination claim under Title VII where the disparate pay was received during Title VII's limitations period, but was the result of allegedly discriminatory pay decisions occurring outside that period.

Justice Alito, writing for the Court, explained that Title VII's limitations period begins to run when "the alleged unlawful employment practice occurred," which, in the case of an intentional pay discrimination claim, means when "each allegedly discriminatory pay decision was made and communicated to" the plaintiff. Ledbetter did not claim before the Supreme Court that intentionally discriminatory conduct occurred during the limitations period, but rather that Goodyear's nondiscriminatory conduct during the limitations period gave present effect to pay decisions made outside of that period. Such "current effects" of past conduct "alone," the Court concluded, "cannot breathe life into prior, uncharged discrimination." The Court stressed the need to "give effect to the statute as enacted" by Congress, including the limitations period included in Title VII, which protects employers against "stale claims" and encourages "the prompt resolution of employment discrimination allegations." In adopting Goodyear's argument and holding that Ledbetter's claim was time-barred, the Court rejected the positions of seven out of nine courts of appeals that had previously considered the application of Title VII's limitations period to intentional pay discrimination claims.
The Court held that the plaintiff's claim was time-barred where she received disparate pay during the limitations period, but her salary was the result of allegedly discriminatory pay decisions that were made outside that period.

Jaeckle Fleischmann Expands Bioscience Team
Jaeckle Fleischmann & Mugel, LLP, a law firm with offices in Rochester, Buffalo and Amherst, New York, and Phoenix, Arizona, is pleased to announce that Andrew K. Gonsalves and Paul T. Lavoie have joined the Firm's Intellectual Property practice group. They will practice from the Firm’s Rochester office, bringing the Firm's Intellectual Property group to a total of 15 legal professionals covering a full range of scientific disciplines.

Mr. Gonsalves and Mr. Lavoie join Andrew O. Scheinman, Ph.D. in expanding the Firm's team of attorneys concentrating in the area of bioscience. “Our emphasis in the bioscience area is in response to the growth in commercialization activity related to the technologies being developed by Universities and medical institutions in Upstate New York,” said Edward G. Piwowarczyk, Chairman and Managing Partner.

Andrew K. Gonsalves joins the Firm as an associate and a registered patent attorney concentrating his practice in preparing and prosecuting patent applications, conducting patentability evaluations and counseling clients on legal and strategic patent issues. Mr. Gonsalves also assists research and academic institutions in commercializing their technologies. His patent practice involves technologies from a broad spectrum of industries including cosmetics, pharmaceuticals, plant biotechnology, plant breeding, bioactive plant products, molecular diagnostics, recombinant DNA technology, vaccines, and human and animal disease treatments. Mr. Gonsalves holds a B.S. in Biological Sciences from the State University of New York at Buffalo, an M.S. in Botanical Sciences from the University of Hawaii and a J.D., cum laude, from Pace University School of Law. He is admitted to practice in New York State and before the United States Patent and Trademark Office.

Paul T. Lavoie joins the Firm as an associate and registered patent attorney. He has over twelve years experience in patent and trademark law in a wide variety of technological areas including ophthalmic pharmaceuticals, chemical processes and reactor technology in natural gas, pharmaceuticals for cancer therapy, medical products, diagnostic devices, test kits and protein and food chemistry. Prior to joining the Firm, he served as Patent Counsel at Bausch & Lomb and previously as Law Technology Counsel at Exxon Mobil. Mr. Lavoie earned his B.A. in Chemistry, M.B.A. and J.D. from Brigham Young University. He is admitted to practice in California, Texas and before the United States Patent and Trademark Office.

Partner Andrew Scheinman, Ph.D. joined the Firm in September 2006, and is engaged in all aspects of U.S. and foreign patent preparation and prosecution, opinion letter preparation, strategic portfolio management, licensing agreements and intellectual property litigation. Dr. Scheinman has particular expertise in animal and plant molecular biology, cell biology, gene therapy, genomics and stem cell transplantation. Prior to joining the Firm, he was with Rosenbaum & Associates in Chicago, Illinois, where he drafted key SARS patents for the Chinese National Human Genome Center and the Harbin Veterinary Research Institute, and acted as liaison to the Technology Transfer Office of the Shanghai Institute of Biological Sciences. Dr. Scheinman holds a B.S. in Biochemistry from the University of Illinois and a Ph.D. in Biology and Molecular Biology from the University of California at Los Angeles, where he received University and National Institute of Health Fellowships. He received his J.D. from the California Western School of Law and is admitted to practice law in North Carolina and before the United States Patent and Trademark Office.

Two Holland & Knight Lawyers Listed Among Top Lobbyists In Washington, D.C.
Former Congressman Gerry Sikorski (D-MN), head of Holland & Knight's Government Section, and Rich Gold, head of the firm's Public Policy and Regulation Practice Group, have been recognized by Washingtonian magazine as two of Washington, D.C.'s top 50 lobbyists.

According to the publication, the "Hired Guns" list was compiled by researching lobby disclosure reports and identifying those who are considered 'heavy hitters' that get things done and have the best connections and influence in Washington, D.C.

Recently, both were named to The Hill's annual list of top lobbyists in Washington, D.C., which lists those whose names "never fail to arise when talk turns to a given issue," as well as those who enjoyed big legislative wins in the past year or have high-profile legislation before Congress.

Gold also was recognized in the March 30 issue of the National Journal as one of the leading Democratic lobbyists in Washington, D.C. Since 2000, under his leadership, Holland & Knight has secured more than $2.6 billion in appropriations for its clients.

Sikorski, who served in the U.S. House of Representatives from 1983-1993, recently was named by his peers to the 2007 edition of The Best Lawyers in America for Government Relations Law.

Holland & Knight continues to be ranked among the top U.S. lobbying firms having consistent revenue growth. The firm was ranked 13th among the top lobbying firms in the country by the National Journal and ranked 6th among lobbying practices at law firms that earned more than $7 million in revenues in 2006 by Influence and The American Lawyer magazines.
