Jere White Appointed to Serve as Lead Counsel for Governor Riley and Commissioner of Insurance Bell in Fraud Action
Jere White, a founding partner of LF&W, has been retained by the Governor of Alabama, Bob Riley, and the Commissioner of the Department of Insurance, Walter Bell, to represent them in a lawsuit filed in the Circuit Court of Montgomery County. The claims alleged include fraud, defamation and intentional interference with business operations.

SIX LAMB McERLANE ATTORNEYS NAMED “PENNSYLVANIA SUPER LAWYERS” FOR 2007
Lamb McErlane, PC, a full-service boutique law firm since 1948, announced today that six of the firm’s 23 attorneys have been named “Pennsylvania Super Lawyers” for 2007 by Law and Politics magazine and are featured in the June issue of Philadelphia magazine. Three of the attorneys were recognized for accomplishment in Appellate Law; two for General Litigation, and one for Business Law. Of the 19 named top appellate lawyers state-wide, three are from Lamb McErlane.

Pennsylvania Super Lawyers, a statewide survey and contest, identifies the top five percent of Pennsylvania’s attorneys across all practice areas each year. Super Lawyers are nominated by their peers and then evaluated on their career history, pro bono work, participation in important cases, published papers, and other professional criteria.

Kelley Drye Represents Expressway Lube Centers
Kelley Drye represented Expressway Drive Thru Lube Centers (“Expressway”) in the sale of a chain of 23 fast-lube and oil service centers and underlying real estate, throughout Connecticut, New York, and Rhode Island, to Galena Associates LLC. Expressway, a privately owned company based in Norwalk, Connecticut, which began operations in 1980, is one of the top U.S. fast-lube and oil change companies. Galena Associates is Valvoline’s largest franchise holder.

Firm Represents Transervice Companies in Complex Closing
Kelley Drye represented clients Transervice Lease Corp., Transervice Logistics Inc., and TSFX Holding Corp. ("Transervice Companies"), and their stockholders Ed Flannigan and Dennis Schneider, in the closing of the sale of a controlling interest in the Transervice Companies to The ZS Fund L.P., a New York based private equity fund. The sale took over a year from letter of intent to consummation, and had significant legal hurdles in the areas of ERISA, tax, and transaction structuring. The Transervice Companies are engaged in the business of transportation logistics, vehicle leasing and vehicle maintenance throughout the United States and recently in Canada, providing services to a wide array of customers, such as The New York Times, Krogers, Walgreens, Bell Canada and Stroehmann Bakeries.

Kelley Drye Represents CIBA Vision
Kelley Drye defended CIBA Vision against claims by plaintiff TransCanada, Inc., a manufacturer of contact lenses, that CIBA Vision was in breach of contract and committed fraud in connection with a technology license dating back to 1986. Plaintiff was seeking damages of up to $75 million. In granting Summary Judgment and dismissing all claims, the Supreme Court found that CIBA Vision was not in breach of the contract because it had no duty to exploit the licensed technology since the agreement was non-exclusive; that CIBA Vision did not owe royalties from 1986 to the present, since it never utilized the technology; and that CIBA Vision did not engage in any fraudulent conduct in the course of its dealings with TransCanada

Christopher FitzPatrick Receives Equal Justice Medal
Partner Christopher FitzPatrick received an Equal Justice Medal at the Equal Justice Awards Reception sponsored by Legal Services of New Jersey and the New Jersey State bar. The medal honors those who have made extraordinary contributions to the cause of equal justice for all. This recognition is in honor of Mr. FitzPatrick’s considerable pro bono efforts on behalf of low-income clients whose cases he has accepted from the Domestic Violence Representation Project at Legal Services of New Jersey. The Awards Reception was held at the New Jersey Law Center in New Brunswick, New Jersey.
